The Epilepsies: Their Effect On The Biological Family, The State-Decreed Family, And Civil Liability In California, Gerard Smolin Jr.
San Diego Law Review
Medical advancements in diagnosis and treatment of the epilepsies have changed the epileptic's life dramatically. Approximately twenty years ago, society began to understand the effect of these advancements. Thereafter, some changes in anachronistic laws occurred almost immediately. But, although initial changes occurred, the epileptic, nevertheless, is unnecessarily set apart. If the epileptic ever is to exercise the rights and privileges of full citizenship, the adjustment of social response to medical fact must continue.

A Judge's Personal Perspective On Criminal Sentencing, Solie M. Ringold

The imposition of sanctions on convicted offenders is a principal vehicle for accomplishing the goals of the criminal law. An appropriate sentencing disposition is as important to the integrity of our system of justice as is the just determination of guilt. Yet the problems, questions, frustrations and self-analysis involved in the sentencing process are complex and heavy burdens. Each judge required to impose a criminal sentence is faced with the difficult tasks of determining the future life of the individual before him or her, balancing the impact on the individual with the needs of society, and drawing the line between …

United States v. Allery, 526 F.2d 1362 (8th Cir. 1975).
The United States Court of Appeals for the Eighth Circuit in a case of first impression among the federal courts, considered whether the federally recognized anti-marital facts privilege which bars the adverse testimony of one spouse against the other should be applied where the defendant is charged with a crime against the child of either spouse. By its holding in United States v. Allery, the court broadened the established exception to the anti-marital facts privilege, which federal courts had previously limited to offenses committed against the person or property of …

Toward A Critical Theory Of Female Criminality, Ann Curry Thompson
IUSTITIA
Twentieth-century theories about female criminality are the weakest link in conventional criminology, representing the most conservative and unscientific thinking about human nature and social organization. Traditional thinking about female criminality reflects the general inability of conventional theorists to examine categories of sex, race, and class oppression as determined by the basic social structure of a particular society and as they relate to deviance and crime. The result has been that female deviance has been analyzed solely in light of assumptions about women's biological nature. The Right To Religious Freedom And World Public Order: The Emerging Norm Of Nondiscrimination, Myres S. Mcdougal, Harold D. Lasswell, Lung-Chu Chen

Discrimination based upon religious beliefs and expressions forms the basis for some of the most serious deprivations of civil and political rights. The religious beliefs and expressions that are commonly the ground for discrimination include all of the traditional faiths and justifications from which norms of responsible conduct--that is, judgments about right and wrong--are derived. These beliefs may be theological in the sense that they refer to a personalized transempirical source of an unchallengeable message or metaphysical in the sense that they are grounded upon nonpersonalized transempirical conceptions; sometimes they are more empirical, based upon varying conceptions of science or …
