Beyond The Shut-Eyed Sentry: Toward A Theoretical View Of Corporate Misconduct And An Effective Legal Response, John C. Coffee Jr.

Like hard cases, festering scandals make bad law. As public perceptions shift so that conduct once tolerated becomes seen as illicit, political pressures develop that can result in hastily improvised responses by the legal system to fill the newly perceived vacuum. This generalization is advanced to question neither the inalienable right of the public to be scandalized, nor the need for corporate reform, but to approach a highly problematic dilemma: hurried, moralistic responses to a perceived evil often prove not only ineffective, but even counterproductive. During the survey period, the appellate courts of Georgia decided about 35 cases and the U.S. Supreme Court denied certiorari in one; the General Assembly passed three workmen's compensation bills in 1975 and none in 1976; and the State Board of Workmen's Compensation opened eight offices throughout the state and staffed each with an administrative law judge (a new name for directors and deputy directors).

Regulation of ECT has generally focused on whether the patient or his representative effectively consented to the treatment. The highly intrusive nature of ECT and the unique circumstances of those patients who are likely to receive it create particularly difficult legal issues concerning the validity of the patient's consent. This Note will examine the various methods that are available to protect the rights of patients for whom ECT is proposed. After briefly explaining the nature of the therapy, the Note will discuss the efficacy of judicial remedies with respect to both competent and incompetent patients. It will argue that, because …

There is probably no more difficult, albeit interesting, job in the state than the position occupied by the juvenile court judge. Each year brings an increasing number of state appellate decisions involving delinquents, status offenders, and deprived children. In addition, the United States Supreme Court has now rendered six decisions further clarifying the constitutional rights of juveniles in the juvenile justice system. As in the previous Survey, the first section of this article will deal with developments in the pre-adjudicatory stage, from "arrest" through the filing of a formal petition. This Article will discuss significant recent developments in immigration law. Important immigration legislation of the 94th Congress, regulations under the Immigration and Nationality Act since their yearly revision, and immigration decisions by the nation's courts within the past year will be noted and analyzed. The scope of this synopsis makes detailed analysis of each development impossible. However, interrelated developments will be discussed together and significant trends will be briefly explained.

The committee completed its work and reported in May 1972. The report, entitled The General Program for the Development of Psychiatric Services in Federal Correctional Services in Canada1 developed in the space of sixty pages, including appendices, a general program for expanding psychiatric services and facilities in the field of corrections in Canada. After the type for this article had been set, the US. Supreme Court decided two cases having potential implications for the constitutional rights of minors-Bellotti v. Baird, 44 US. L. W. 5221 (July 1, 1976) and Planned Parenthood of Central Missouri v. Danforth, 44 U.S.L. W. 5197 (July 1, 1976). In Belloti, a unanimous Court held that the lower federal court should have abstained from determining the constitutionality of a state statute requiring parental consent to an unmarried minor's abortion but providing for judicial order of consent "for good cause shown" after parental consent is refused.
