Mandatory Hiv Testing Issues In State Newborn Screening Programs, John M. Naber, David R. Johnson

The newborn screening model is fairly straightforward. Typically, before the infant is discharged from the hospital (around 24 to 36 hours of age), heel stick blood is placed on special filter paper, dried, and mailed to the state health department for testing. Medical and laboratory research has led to the discovery that other diseases could also be screened in newborns using these dried blood specimens. Currently, all states and the District of Columbia test all newborns for at least PKU and congenital hypothyroidism. There are generally five criteria to satisfy before a disease is considered appropriate for newborn screening: 1. …

This paper explores the range of legislation that has created the EIA mandate. A more comprehensive study of all EIA laws is under preparation by the Commission on Environmental Law of the International Union for the Conservation of Nature and Natural Resources, but this study will not be complete until 1992. In the absence of such an exhaustive analysis, this paper sketches the global legislative trends in EIA.

As we move into the twentieth century, environmental problems continue to receive a great deal of international attention and concern. It is recognized that the ongoing degradation of the world's natural resources combined with pollution and other environmental problems threatens the well being of us all. This article begins by exploring a number of regional environmental problems and looks particularly at the decay of the world's urban centers. An examination of the development of the planning process employed modernly in the United States follows. Hiv-Aids And Governmental Control Of Information: International Denial Of Human Rights, Michael L. Closent, Scott H. Isaacman

This article will identify two significant failures in the efforts to effectively combat the HIV-AIDS pandemic. Both problems deal with the collection and dissemination of HIV-AIDS information. The first topic of concern is what we call the AIDS "name game." The definition of AIDS varies from country to country and changes from time to time within a single country, with substantial negative consequences. In addition, too much attention is focused upon AIDS rather than upon HIVAIDS (or HIV infection). Secondly, the underreporting of HIV-AIDS is a serious problem resulting in the denial of important human rights to hundreds of thousands …

Realigning Maternal/Fetal Interests In The Battle Against Substance Abuse, Jeanette Lewis

America's "War on Drugs" has given rise to political and legal debate concerning the critical health problems presented by maternal drug abuse during pregnancy. The "War," largely characterized by criminal sanctions as opposed to preventative measures, indicates the social attitude and legal response to this crisis. Researchers estimate that 375,000 newborns may be harmed by maternal substance abuse in the United States each year. Furthermore, one in every ten babies born in urban areas has been exposed to cocaine in the womb. Tax Policy And Panda Bears, Douglas A. Kahn, Jeffrey S. Lehman

In this article, Professors Kahn and Lehman argue that the concept of tax expenditures is flawed as a tool for measuring the propriety of tax provisions. It assumes the existence of one true and correct standard of dederal income taxation that applies to all circumstances. To make that assumption, the proponents of the concept implicitly make a particular moral claim about the relative importance of a wide range of values, including efficiency, consumption/savings neutrality, privacy, distributional equity, administrability, charity, and pragmatism. They then measure a tax provision's "normalcy"exclusively by how it conforms to their Platonic concept of income.

The late Professor Thomas Emerson, a great civil libertarian, cautioned in 1976 that one of the hard problems of the First Amendment would soon be acknowledged as the extent to which the state could recognize scientific research. As he observed sagely, "It is hard to predict where these issues will lead." This essay will explore the pathway where these issues are leading in contemporary society.

A Psychiatric Perspective On Washington's Sexually Violent Predators Statute, Robert M. Wettstein, M.D.

This Article will critique Washington's Community Protection Act from the perspective of a clinical and forensic psychiatrist. Part II of the Article will address and examine problems with the statute's definitions and consider some of the problems in conducting evaluations of proposed sexual predators. Part III will then discuss some of the many difficulties inherent in providing treatment under the statute. Part IV will review the potential abuses, costs and risks to the participants presented by the statute. Finally, Part V will focus on the ethical issues in providing expert medical testimony pursuant to the statute.
