Murder, She Wrote Or Was It Merely Selective Nontreatment?, George P. Smith Ii Jan 1992

Murder, She Wrote Or Was It Merely Selective Nontreatment?, George P. Smith Ii

Scholarly Articles

This article will both explore and thereby establish the medical, ethical, and legal validity of selective nontreatment of severely handicapped newborns. A construct for principled decision-making, tied to a basic recognition of the right of self-determination, as shaped by compassion and validated principles of triage and cost-benefit analysis, will be seen as the most effective means for the states-and not the federal government-to evaluate the intensely complex issues associated with allocating scarce medical resources to defective infants. Governmental intrusions into the familial decision- making forum in these circumstances must be kept to a minimum and allowed only in grave cases.

Future Of Fishery Management And Its Impact On The Seafood Industry: A Comparison Of United States And Canadian Fishery Management Policies After Unclos Iii, Ferdinand J. Iii Gallo Jan 1992

Future Of Fishery Management And Its Impact On The Seafood Industry: A Comparison Of United States And Canadian Fishery Management Policies After Unclos Iii, Ferdinand J. Iii Gallo

Northwestern Journal of International Law & Business

The United States and Canadian fishery management regimes each professes to fulfill the goals of conservation enumerated under the United Nations Convention on the Law of the Sea of 1982 (UNCLOS III). These goals include conservation of scarce fish stocks and "optimum utilization" of those limited resources. The Canadian regime of centralized authority, informality and flexibility, however, actually comes closest to fulfilling these goals. While the United States may adopt some of the key elements of the Canadian regime, several barriers exist to such reforms.Another method for reconciling the differences between U.S. and Canadian policies would include the implementation of …

Chronic Drug Users As Parents, Judy Howard Jan 1992

Chronic Drug Users As Parents, Judy Howard

UC Law Journal

In her Essay Dr. Howard presents a progressive overview of parental drug and alcohol abuse. The Essay surveys general trends in substance abuse, and discusses the chemically dependent lifestyle. Highlighting the disparity between children with developmental problems who are being raised in chemically dependent families and those growing up in families where substance abuse is not an issue, Dr. Howard explains how newborn behavior and developmental patterns of older children are influenced by environmental as well as biological factors. She concludes that comprehensive and coordinated services must be provided by those who work with chemically dependent families and suggests an …

Medical Monitoring Funds: The Periodic Payment Of Future Medical Surveillance Expenses In Toxic Exposure Litigation, Amy B. Blumenberg Jan 1992

Medical Monitoring Funds: The Periodic Payment Of Future Medical Surveillance Expenses In Toxic Exposure Litigation, Amy B. Blumenberg

UC Law Journal

For many Americans, exposure to toxic substances has become a sad reality of life. While the medical and scientific communities have recognized the need for timely presymptom, postexposure medical diagnosis to detect and treat exposure-related diseases, the legal community has responded more slowly to the problems faced by toxic exposure victims. Nonetheless, the individual and public health interests in early detection and treatment of exposure-related diseases have motivated an increasing number of courts to recognize claims for presymptom, postexposure medical surveillance. In most such cases litigants have pursued or courts have awarded a traditional common-law lump sum of monetary damages. …

The Question Of Family: Lesbians And Gay Men Reflecting A Redefined Society, Libby Post Jan 1992

The Question Of Family: Lesbians And Gay Men Reflecting A Redefined Society, Libby Post

Fordham Urban Law Journal

The cutting edge issue in the gay community is now the fight for domestic partnership rights. The absence of domestic partnership rights have resulted in the unequal treatment of an entire class of citizens, with gays and lesbians routinely denied jobs, housing, economic benefits such as health care, insurance, public accommodations, and may even result in these individuals being fired or facing eviction solely because of their sexual orientation. The author argues that to rectify these injustices, we must redefine the definition of family to be more in line with that used in New York's Braschi v. Stahl Assocs. Co., …

The Fordham Urban Law Journal: Twenty Years Of Progress, Constantine N. Katsoris

Fordham Urban Law Journal

After Fordham University moved the School of Law to the cultural hub at Lincoln Center, the problems associated with our urban areas began to accelerate. It became apparent that a closer focus had to be directed specifically at the urban problems of the nation, with particular emphasis on the affairs of its then largest city and state - New York. Thus, the Fordham Urban Law Journal (ULJ or Journal) published its first issue in 1972, exactly 20 years ago. This article commemorates the 20th anniversary of the Urban Law Journal, reflecting on the Journal's most notable accomplishments and tracing its …

The Miner's Canary: Tribal Control Of American Indian Education And The First Amendment, John E. Silverman Jan 1992

The Miner's Canary: Tribal Control Of American Indian Education And The First Amendment, John E. Silverman

Fordham Urban Law Journal

One legacy of America's mistreatment of its indigenous peoples has been an educational policy that has run roughshod over Native American Free Exercise rights. Today, American Indian tribes widely seek increased control over the education of their children. This position has received broad congressional and presidential support since the Nixon Administration, but more than twenty years later, Native Americans are still fighting to attain their goals. Federal statistics that rank American Indians as our least educated, most addicted, shortest-lived citizens suggest tremendous room for improvement in Indian education. Despite certain circuit court Free Exercise Clause decisions that unreasonably hold Indian …
