Trade, Environment, And Sustainable Development: A Primer, Robert Housman, Durwood Zaelke

UC Law SF International Law Review

Free trade policy and environmental policy are often at odds. Experts on both sides, however, are beginning to realize that sustainable development is the best hope for long-term international economic prosperity. Given the environmental crisis the world is facing, both sides must work to reconcile the legal relationship between trade agreements and environmental agreements if sustainable development is to be achieved and maintained. Accordingly, this Article surveys trade agreements, including the General Agreement on Tariffs and Trade, and environmental agreements for possible conflicts. The Article concludes with a brief discussion of options for reducing or eliminating such conflicts.

The summer of 1991 will certainly be remembered in the history of the Soviet nation as a crucial period leading to the final disintegration of the Soviet empire. The aborted coup of August 19-21 by the conservatives, immediately followed by Gorbachev's resignation of his post as Secretary-General of the Communist Party, significantly accelerated the reforms in progress in the Soviet Union since Gorbachev's accession to power in 1985. Even the most experienced Sovietologists, if requested to take a stand before those summer events of 1991, would never have dared to envisage 1992 without the Soviet Union. Problems Of Fisheries Management On The Patagonian Shelf: A Decade After The 1982 Falklands (Malvinas) Conflict, Gustavo A. Bisbal

Marine Affairs Theses and Major Papers

The armed conflict between Argentina and Britain over the Falkland Islands (Islas Malvinas) early in 1982, resulted in a confusing partition of the maritime area around these islands. The military strategies and policies developed by both countries during and after the war created an unclear situation regarding limits and jurisdictions, thus delaying managerial actions and regulation enforcement over the fishing resources of the area. Several foreign fishing fleets operating in the region at the time, took advantage of the lack of protective legislation and recognized authority, resulting in overfishing of species such as squid and hake. Home health care is a compassionate, cost-effective, and practical alternative for some individuals who require long-term or constant care. However, the coverage of home health care costs is far from comprehensive under the Medicare, Medicaid, and private pay systems. A uniform and comprehensive coverage system is necessary.

Protein Pharmaceuticals: Altering The Scope Of Product Patents To Accomodate Recombinant Dna Technology, Bret Field

UC Law SF Communications and Entertainment Journal

As recombinant DNA technology has evolved into a prominent tool to synthesize new products in the pharmaceutical industry, courts have been faced with novel infringement issues involving the scope of patents granted to protein pharmaceuticals. This note analyzes the way courts have interpreted the scope of product patents granted to purified product of nature inventions and recombinantly synthesized products. The note highlights the current problems with the judiciary's interpretation of the Patent Act. The note then discusses a better approach to the infringement issues, an approach based on the Food and Drug Administration's procedure when faced with analogous issues raised …

Two Legal Constructs Of Motherhood: "Protective" Legislation In Mexico And The United States, Antoinette M. Sedillo Lopez

The theme of this symposium, "Reconstructing Motherhood," requires an examination of laws designed to further traditional motherhood roles. Societal constructs of motherhood-women as child bearers and nurturers-have profoundly affected women's involvement in paid employment. Conversely, women's participation in paid employment affects how women experience motherhood. For example, a woman who does not work outside the home has a dramatically different mothering experience than a woman who works outside the home and leaves her children with a day-care provider. The legal system can affect the relationship between motherhood and employment opportunities for women by means of employment laws and policies. Sometimes …
