Diminishing Marginal Utility Of Income And Progressive Taxation: A Critique Of The Uneasy Case, Mark S. Stein

Northern Illinois University Law Review

A recurring issue in law, economics and politics is how progressive the tax system should be. In 'The Uneasy Case for Progressive Taxation,' a famous article of forty years ago, the authors pronounced themselves unconvinced by arguments for progressive taxation. In this article, Mark Stein contends that 'The Uneasy Case's' uneasiness is based on a faulty analysis of whether income has diminishing marginal utility.

The Disfranchisement Of Fertile Women In Clinical Trials: The Legal Ramifications Of And Solutions For Rectifying The Knowledge Gap, L. Elizabeth Bowles

Vanderbilt Law Review

Twice as many women as men receive treatment for clinical depression, yet men benefit more than women from antidepressant drug treatment. Likewise, women use more prescription drugs than men, but suffer proportionally more side effects.' Such disparities stem from the traditional attitude of pharmaceutical companies and researchers to- ward the use of women in clinical trials. In general, researchers have tested drugs on young white males without regard for gender differences, often assuming that data extrapolated from studies on males are readily applicable to females. The Foreign Commerce Clause And The Market Participant Exemption, David E. Dreifke

In this Note, the author argues that, despite the strictures of the Foreign Commerce Clause, under an expansive conception of the market participant exemption, states should be able to place restrictions on the export of state-owned or state-nurtured natural resources. In light of the current trade imbalance between Japan and the United States and by way of example, the author discusses Japan's importation of United States natural resources and the competing interests that argue for and against its continuance. The abduction, trial, and execution of Adolf Karl Eichmann by the state of Israel, fifteen years after the shutdown of the crematoria at Auschwitz, challenged the American Jewish intelligentsia to confront the Jewish question.4 What does it mean to be a Jew in America and who is an American Jew? Is the Jewish history of anti-Semitism and the Holocaust also a part of American-Jewish history? The Aids Blood-Transfusion Cases: A Legal And Economic Analysis Of Liability, Ross D. Eckert

San Diego Law Review

Through 1991 over 4,000 persons contracted AIDS through transfusion. Statutes in forty-nine states exempt blood banks from strict liability, and the usual negligence rule is weak. Analyzing the medical literature, regulation, and case law, Eckert argues that blood bankers have superior information for reducing risk and that stronger liability rules should be reconsidered. He finds that industry-wide standards of care often emerge from agreements among the three associations of blood banks, and that joint liability for blood banks should be considered. Reinvigorating Educational Malpractice Claims: A Representational Focus, John G. Culhane

Washington Law Review

For the past twenty tears, courts have faced a wide array of claims alleging misconduct by schools and their officials. These claims have involved diverse injuries, including: negligence in permitting functional illiterates to pass through the school system; negligent misdiagnosis of learning disabilities; and failure to deliver a promised package of educational skills and services. The judiciary has almost uniformly refused to allow recovery, in tort or otherwise, for such injuries. Some courts have conceded that, on the pleadings, a good case might be made out. Forensic scientists have long hoped for the ability "to identify the origin of blood and body-fluid stains with the same degree of certainty as finger- prints."' Recent advances in recombinant deoxyribonucleic acid ("DNA") research offer scientists the necessary technology. Consequently, DNA technology now provides the judicial system with a powerful new test to identify criminal suspects and to trace paternity. This Comment discusses the current law regarding DNA fingerprinting.

In July 1889, Mary O'Brien, a young, Irish, immigrant woman traveling to Boston in steerage on the "Catalonia," a ship of the Cunard Steamship Company, was given, against her will, a smallpox vaccine by Dr. I.T.M. Giffen, the ship's doctor. The vaccine left her body covered with sores and blisters. Two years later, in O'Brien v. Cunard Steamship Co.,' the Supreme Judicial Court of Massachusetts in an opinion written by Judge Knowlton held that the trial court had ruled correctly that Mary O'Brien's claims for battery and negligence could not even go to the jury.
