Examining a recent case in which the U.S. Supreme Court approved the collection of blood and urine samples from railroad employees, the authors conclude that, in attempting to improve railroad safety, both majority and minority opinions reflected undue emphasis on technical issues and inadequate attention to the intangible social values underlying traditional Constitutional rights to privacy.

Status Of Sex-Specific Fetal Protection Policies, The, Elizabeth A. Phillips
Missouri Law Review
Many commentators and judges consider cases involving fetal protection policies the most important sex discrimination cases since Congress enacted Title VII of the Civil Rights Act of 1964. With as many as twenty million workers potentially exposed to chemicals in the workplace that may cause reproductive health problems, employers have implemented fetal protection policies. The employers' motivation for enacting these policies is dual in nature: (1) to protect the health of future generations and (2) to protect themselves from potential tort liability. Regardless of the benevolence of employers' motives, the issue is whether individual employers should be allowed to close …

Repatriation And Cultural Preservation: Potent Objects, Potent Pasts, Peter H. Welsh

Parts I and II discuss the preservation idea itself and the history of museums' participation in cultural preservation efforts. Parts III and IV then look specifically at the repatriation issue, providing some background on initiatives that have influenced peoples' thoughts and actions. Finally, Part V outlines and discusses some of the issues that have made resolution of the repatriation issue particularly complex.

The Pariah Patient: The Lack Of Funding For Mental Health Care, Wayne E. Ramage

In all the furor over the provision of health care in the United States-especially over who will pay for the skyrocketing costs of medical treatment-one class of patient appears to have been overlooked: the mentally ill. This oversight is not new; Anglo-American society historically has viewed the mentally ill as outsiders. In England, for example, inmates at the infamous "Bedlam" hospital for the insane often were displayed for the amusement of the paying public.' Society's disdain of the mentally ill still exists and has led to public neglect of these unfortunates, especially in the provision of mental health care.

Applying U.S. Law To Halt Deforestation In Southeastern Myanmar: A Survey Of Potential Strategies, Douglas J. Kelso

As the twentieth century draws to a close, the threat posed by environmental degradation grows increasingly apparent. Climatic change, ozone depletion, hazardous wastes, and numerous other ecological concerns gain growing prominence in national and international policy debates. Environmental degradation causes the loss of valuable atmospheric, hydrological, geological, and biological resources. In terms of resource depletion, the rapid destruction of tropical rain forests poses one of the greatest ecological threats to our planet today. This paper proposes that proper application of United States law might discourage tropical deforestation abroad, using the nation of Myanmar (formerly Burma) as an example.

The National Wildlife Refuge System: Incompatible Recreational And Economic Uses Of Refuge Lands, Kimberley J. Priestley

This Comment addresses the problem of incompatible uses on refuge lands. Section I briefly summarizes the history and management of the NWRS and sets forth the basic tenets of the NWRS Administration Act's "compatibility" standard. Section II points out the problems of incompatible secondary uses on refuge lands. Section III examines the possible reasons behind the FWS's acquiescence to these incompatible recreational and economic uses and proposes solutions. Finally, this Comment concludes that an organic act, coupled with increased funding, would help the NWRS achieve its primary goal of providing protection for wildlife resources and their habitats.
