เอกัดศึกษานี้มีวัตถุประสงค์เพื่อศึกษาแนวทางในการกำหนดเวลาทำงานให้เหมาะสมกับลักษณะของงานเพื่อความเป็นธรรมของบริษัทสอบบัญชีโดยหลักการกำหนดเวลาในการทำงาน ภายใต้พระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 นายจ้างสามารถกำหนดเวลาในการทำงานภายใต้กรอบวิธีการกำหนดเวลาในการทำงาน 4 ประเภท ได้แก่ 1.งานทั่วไป 2. งานอันตราย 3. งานที่ไม่อาจกำหนดเวลาเริ่มต้นและสิ้นสุดของการทำงานได้และ 4. การทำงานจากที่บ้านหรือที่พำนัก และการทำงานทางไกล ซึ่งเกิดความไม่เหมาะสมในการกำหนดเวลาในการทำงานของบริษัทสอบบัญชี ที่มีลักษณะงานเฉพาะทางโดยแยกเป็นประเภทงานหลัก ๆ ได้แก่ : 1. งานตรวจสอบบัญชี (Audit): ต้องการความได้สัดส่วนระหว่างการทำงานตามเวลาเปิดปิดของกิจการ และการทำงานที่มีความยืดหยุ่นบางช่วงเวลา 2. งานที่ปรึกษาทางธุรกิจ (Advisory) : ต้องการการทำงานแบบยืดหยุ่นสูง 3. งานสนับสนุนการดำเนินงานภายในองค์กร (Support Functions) : ต้องการทำงานตามเวลาเปิดปิดของกิจการ ผลกระทบจากเวลาในการทำงานไม่สอดรับกับการทำงานที่แท้จริง ในลักษณะของการจัดการเวลาที่ไม่เหมาะสมทำให้พนักงานประสบปัญหาความไม่สมดุลระหว่างชีวิตและการทำงาน โดยหลักแบ่งออกเป็น 3 ประการ ได้แก่ ประการที่ 1 ความไม่สมดุลชีวิตและการทำงาน การจัดการเวลาที่ไม่เหมาะสมทำให้ลูกจ้างต้องใช้เวลาในการทำงานที่มากกว่าปกติอันส่งผลต่อสุขภาพจิตและร่างกาย ประการที่ 2 ความปลอดภัยชีวิตอนามัย ความเครียดสะสมและโรคแทรกซ้อนจากการทำงาน หมดไฟในการทำงาน ความเสี่ยงด้านความปลอดภัยและชีวิตอนามัยที่เพิ่มขึ้นจากการพักผ่อนไม่เพียงพอหรือการทำงานหนักเกินไป ประการที่ 3 ประสิทธิภาพในการทำงานลดลง เพิ่มข้อผิดพลาด และสร้างความไม่พึงพอใจในงานของพนักงาน ส่งผลต่อคุณภาพของงานและอัตราการลาออกอีกประการหนึ่งจากผลการศึกษาพบว่าในต่างประเทศ แม้ว่ามีการกำหนดเวลาการทำงานในรูปแบบกฎหมายแรงงานแล้ว แต่ยังคงออกแนวปฏิบัติเพื่อให้การทำงานของลูกจ้างสอดคล้องกับการทำงานรูปแบบใหม่ในปัจจุบัน โดยมุ่งเน้นการจัดการทำงานแบบยืดหยุ่นทั้งในด้านสถานที่ และเวลา เพื่อให้ลูกจ้างเกิดความสมดุลระหว่างชีวิตและการทำงาน และประโยชน์ทางอ้อมต่อนายจ้างในการประหยัดต้นทุนในการบริหารทรัพยากรบุคคล และในประเทศสิงค์โปร์มีการกำหนดหลักการเฉพาะ โดยกำหนดให้กลุ่มพนักงานจะต้องตกลงเวลาในการทำงานหลัก “Core hours" เพื่อให้การเลือกเวลาของพนักงานได้มีช่วงเวลาในการทำงานพร้อมกัน และเพื่อเป็นคู่มือในการสนับสนุนให้เอกชนจัดทำแนวปฏิบัติในการกำหนดเวลาในการทำงานให้เหมาะสมกับลักษณะงานของลูกจ้างอย่างราบรื่น

In the digital age, diverse walks of human life have reconfigured profoundly. In the Moroccan society, digitalisation plans and the skyrocketing numbers of internet users necessitate coping literacy policies. While several community initiatives have been taken to improve the quality of media literacy, they, as bottom-up efforts, cannot suffice to meet the needs of the whole Moroccan population. Rather, the absence of a central, nationwide, cross-sectoral media literacy policy significantly challenges the effective coordination of official strategies and community initiatives in media education. [Purpose/significance]This study aims to solve the problem of traditional short text matching models being difficult to apply to long text matching tasks such as legal case retrieval. [Method/process]For the task of legal case matching, this paper proposes a Legal Text Matching model based on RoFormer (LTMR). In the coding layer, the legal case is encoded through the RoFormer model and the legal feature extractor. In the reasoning layer, the context and interactive information of long text are further extracted by using interactive attention and self-attention mechanisms. The effect of pharmaceutical marketing on individuals is a universal concern. It can influence patients' health and wealth. Deepfakes—audiovisual recordings created using artificial intelligence (AI) technology to believably map one person’s movements and words onto another—are ubiquitous. They have permeated societal and civic spaces from entertainment, news, and social media to politics. And now deepfakes are invading the courts, threatening our justice system’s truth-seeking function. Ways deepfakes could infect a court proceeding run the gamut and include parties fabricating evidence to win a civil action, government actors wrongfully securing criminal convictions, and lawyers purposely exploiting a lay jury’s suspicions about evidence. When it comes to racism and the law, visual rhetoric has played and still plays an outsized role. Jason Aldean’s music video for “Try That in a Small Town” aptly illustrates this thesis. The video shows Aldean and his band performing in front of the Maury County Courthouse in Columbia, Tennessee, the same location where, in 1918, a white mob violently lynched a young Black man. To some (white) viewers, the Maury County Courthouse might symbolize justice. In combination with the song’s lyrics, however, the courthouse conjures up visuals of the lynching that occurred outside its doors, reminding viewers that …

ในประเทศไทยและเยอรมนี การแพทย์ทางไกลได้กลายเป็นส่วนสำคัญในการดูแลสุขภาพของประชาชนทั่วไป การบริการทางการแพทย์นี้มีความสำคัญอย่างยิ่งหลังการแพร่ระบาดของโรคโควิด-19 ไปทั่วโลก การบริการการแพทย์ทางไกลมีประโยชน์หลายประการทั้งการเข้าถึงการบริการด้านสุขภาพที่เพิ่มมากขึ้น ตลอดจนส่งเสริมความสามารถในการให้บริการด้านสุขภาพของผู้ให้บริการทางการแพทย์ อย่างไรก็ตาม การแพทย์ทางไกลได้ก่อให้เกิดความท้าทายทางด้านกฎหมาย โดยเฉพาะประเด็นที่เกี่ยวข้องกับเรื่องการทุรเวชปฏิบัติทางการแพทย์ทางไกลโดยเจ้าหน้าที่ทางการแพทย์และผู้ให้บริการการแพทย์ทางไกลซึ่งมีรูปแบบและลักษณะแตกต่างจากการให้บริการทางการแพทย์แบบดั้งเดิมปัจจุบัน การให้บริการการแพทย์ทางไกลโดยแพทย์ที่ได้รับใบอนุญาตนั้นจะต้องทำตามหลักเกณฑ์ตามประกาศแพทยสภา ฉบับที่ 54/2563 ซึ่งได้กำหนดความหมายของคำว่า “การแพทย์ทางไกล" ไว้เป็นการเฉพาะ และยังปรากฏว่ามีออกประกาศกระทรวงสาธารณสุขเรื่องมาตรฐานสำหรับสถานพยาบาลที่ใช้ระบบบริการการแพทย์ทางไกล พ.ศ. 2564 เพื่อกำกับดูแลการให้บริการการแพทย์ทางไกลของผู้ให้บริการสถานพยาบาล อย่างไรก็ตาม ยังไม่ปรากฏว่ามีกฎหมายที่เกี่ยวข้องกับการเรียกค่าสินไหมทดแทนจากทุรเวชปฏิบัติด้านการแพทย์ทางไกลไว้โดยเฉพาะเจาะจง การบาดเจ็บที่เกิดจากการกระทำทุรเวชปฏิบัติทางการแพทย์ที่เกิดขึ้นในกรณีการแพทย์ทางไกลจะอยู่ภายใต้มาตรา 420 ของประมวลกฎหมายแพ่งและพาณิชย์ของประเทศไทย เช่นเดียวกับกรณีการกระทำทุรเวชปฏิบัติทางการแพทย์เช่นเดียวกับการแพทย์แบบดั้งเดิมงานวิจัยนี้พบว่าภาระการพิสูจน์ของผู้ที่ได้รับบาดเจ็บภายใต้กรอบของกฎหมายการละเมิดทั่วไป ส่งผลให้ผู้ที่รับบริการการแพทย์ทางไกลมีภาระในการพิสูจน์เช่นว่านี้มากเกินสมควร เมื่อเปรียบเทียบกับระบบกฎหมายไทย ระบบกฎหมายของประเทศเยอรมนีได้สร้างกลไกที่เป็นระบบมาใช้เพื่อช่วยให้ผู้ให้บริการการแพทย์ทางไกลมีความรับผิดชอบต่อการบาดเจ็บนั้นมากขึ้นและคุ้มครองฝ่ายผู้รับบริการได้มากขึ้นในกรณีทุรเวชปฏิบัติในกิจการการแพทย์ทางไกล โดยงานวิจัยนี้มุ่งเน้นไปที่การเปรียบเทียบแนวปฏิบัติของศาลเกี่ยวกับกรณีทุรเวชปฏิบัติทางการแพทย์ระหว่างประเทศไทยและเยอรมนี และชี้ให้เห็นความแตกต่างและประเด็นที่อาจนำเอามาปรับปรุง แนวทางการปฏิบัติของศาลเยอรมนีเป็นตัวอย่างหนึ่งของแนวทางที่ครอบคลุมและแสดงออกถึงการใช้กลไกทางกฎหมายที่ซับซ้อนเพื่อรับรองความปลอดภัยของผู้ป่วยผู้รับบริการและสร้างความรับผิดชอบให้แก่ผู้ให้บริการเพื่อจัดการกับความท้าทายทางกฎหมายในด้านการแพทย์ทางไกล ประเทศไทยสามารถนำแนวทางปฏิบัติจากกรอบกฎหมายของประเทศเยอรมนีมาปรับใช้เพื่อลดภาระการพิสูจน์สำหรับผู้ป่วยและรับรองความรับผิดของผู้ให้บริการด้านการแพทย์ทางไกล เพื่อส่งเสริมความปลอดภัยของผู้ป่วยผู้รับบริการและการรักษาสิทธิของผู้ป่วยในกรณีที่อาจมีการเรียกร้องค่าเสียหายจากการรักษาพยาบาลของผู้ให้บริการการแพทย์ทางไกลในประเทศไทย และเพื่อรับประกันความปลอดภัยและความเป็นอยู่ที่ดีของผู้ป่วยผู้รับบริการการแพทย์ทางไกลในประเทศไทยมากกว่าปัจจุบัน

Even highly regulated labels, such as the organic label, have the potential for greenwashing. As recently as January 2023, a grain seller was indicted in federal court for a $43 million scheme that involved the sale of non-organic grain as USDA-certified organic. But today’s organic market is also full of sellers who follow the current federal organic regulations but fail to demonstrate the spirit of the organic movement—forgoing soil, animal welfare, and community for profit. The world’s largest online pornography conglomerate, MindGeek, has come under fire for the publishing of “rape videos,” child pornography, and nonconsensual pornography on its website, Pornhub. As in the “pornography wars” of the 1970s and 1980s, lawyers and activists have now turned to civil remedies and filed creative anti-trafficking lawsuits against MindGeek and third parties, like payment processing company, Visa. These lawsuits seek not only to achieve legal accountability for online sex trafficking but also to reframe a broader array of online harms as sex trafficking.

Although the use of fake videos and images are not new, advances in artificial intelligence have made deepfakes easier to make and harder to detect. Trump for inciting a violent insurrection, prosecutors made extensive use of video images of Trump supporters violently overtaking Capitol police and ransacking the Capitol building once they had forced their way inside. But the rally video that immediately preceded Trump’s January 6 speech was ignored completely. Should it have been brought into the prosecution’s case? Images are powerful. They shape how we see and understand the world and, in the process, challenge (or reinforce) our assumptions and perspectives. The images we use in the classroom are no exception, whether used passively as visual aids or as a “medium through which active learning is energized.”1 In this article we embrace the “pictorial turn” in university teaching and reflect on the use of images when teaching “development.”2 Development is an area that typically attracts students with an internationalist orientation and who seek to make a positive change in the world. This Article discusses the continuing legal education (CLE) visual advocacy documentary-style program, which Garrick Apollon (author of this Article) researched and developed. The case study for this CLE documentary-style program is the film Inside Lehman Brothers—a documentary film by Jennifer Deschamps which chronicles the story of the Lehman whistleblowers. The film presents Mathew Lee, former senior vice president overseeing Lehman’s global balance sheet; Oliver Budde, former in-house counsel (associate general counsel) of the Lehman Brothers; and the racialized female mid-tier manager whistleblowers, who all paid a steep price in the 2008 American subprime mortgage crisis, while many of the …

A primary goal of twenty-first century legal works is to communicate the law effectively to diverse audiences. Many of the most needful and most vulnerable audiences for legal information have members who lack basic literacy skills and suffer linguistic and cultural confusion from verbal textual media—namely, the printed word. Yet for centuries, legal rules and government restrictions have been communicated nearly exclusively through the printed word. Recent scholarship in visual legal rhetoric, visual literacy studies, and visual cultural studies is informed by cognitive psychology and neuroscience that all points to a solution: visual communication of the law. Due in part to the COVID-19 pandemic, enhancements in technology, as well as shifts in the macroeconomic and socioeconomic dynamics of globalization, Digital Transformation (DT) has become an enterprise-wide imperative for most multinational companies (MNCs). As a result, legal departments are being challenged to embrace enterprise DT and start their own departmental DT journeys. This Article is the first to present a comprehensive theory and style for using PowerPoint to teach law. The theory is that presentation software adds a channel of communication that enables the use of images in combination with words. Studies have shown that combination to substantially enhance learning. The style is based on an extensive literature regarding the use of PowerPoint in teaching law and other higher education subjects as well as the author’s experimentation with PowerPoint over two decades. The goal of this Article is to introduce a comprehensive methodology for the analysis of visuals used for communication in legal works, by which I mean transactional and litigation documents, legal instruments, primary and secondary sources of law, and legal informational materials. The Writing’S On The Wall: Using Multimedia Presentation Principles From The Museum World To Improve Law School Pedagogy, Cecilia A. Silver

Law school pedagogy is a relic. Nearly 150 years after Christopher Langdell pioneered the case method, the typical doctrinal course remains predominantly a verbal domain, featuring lectures, Socratic dialogue, and final exams. But the visual disconnect between legal education and legal practice does students a disservice. Under the proliferating influence of laptops, iPads, smartphones, and Zoom, students now read, work, and study electronically more than they ever have before. So instead of business as usual, it’s time to embrace “visualization”—using multimedia to enhance, or even supplant, the near-exclusive reliance on language—to build a more vibrant and inclusive learning environment.

Contending with the loss of a parent to a mass shooting in their workplace, a newsroom, I find myself suspended in time, in an office. Post-its, fans, button-ups, snow globes, clipboards, reporters notebooks, scrap paper, jot downs, keyboards hold me up. I crave the comfort of repetitive cumulative hand work. Quilting, weaving, and cutting away help me breathe, haptically process and memorialize these grieving objects, this grieving person. Weed-wacking towards intimacy, my work employs a range of materials to mourn the mundanity of a workday, fantasize transformative justice, and steward embodied grief to the surface.
