Videotaping Of Surgery For Use As Demonstrative Evidence In Medical Malpractice Litigation, J. Douglas Peters, Bernard J. Wilkes Iii

Duquesne Law Review

Medical malpractice claims are more than an insignificant concern for both the medical and legal professions, particularly in terms of the proof problems presented. The authors suggest that by videotaping surgery, malpractice claims could be handled more justly and efficiently, and they investigate the feasibility of videotaping surgery.

The investigator studied the application of the First Amendment of the United States Constitution to secondary school students' right to free expression. The investigator examined landmark cases such as Tinker v Des Moines Independent Community School District in order to depict the historical development of extending constitutional rights to secondary school students.

The study encompasses both landmark cases (those cases involving highly significant decisions that established a precedent) and relevant cases which led to the present judicial posture regarding secondary students' right to free expression. Findings of the case study reveal the present judiciary standard to rest on the application …

One of the most fundamental ethical duties of an attorney is that of maintaining secrecy concerning the confidences of his client. This duty of non-disclosure has been embodied in two of the Canons of Professional Ethics and has been recommended by the American Bar Association as one of the specifically ennumerated duties to be incorporated into the Oath of Admission to practice in all states and territories. In theory, the highly personal relationship between a lawyer and his client is, in many respects, like that of a confessor and his penitent, bound by the bond of silence. In practice, it …
