Pollution Control In An Era Of Economic Redevelopment: An Overview, Kurt A. Strasser Apr 1993

Pollution Control In An Era Of Economic Redevelopment: An Overview, Kurt A. Strasser

Connecticut Journal of International Law

The worldwide growth of interest in environmental protection is one of the most startling legal developments of the late Twentieth century. As recently as twenty-five years ago, the presentation of an environmental law panel at a symposium such as this would have been unimaginable. At that time, in neither East nor West was environmental law an important area of social concern or a topical area of interest to practical lawyers. Environmental protection was often paid lip service, but the reality was that it counted for little. Indeed, the question of tradeoff between environmental protection versus economic development, however inaccurate today, …

Consent Decrees Resulting From Institutional-Reform Litigation May Be Modified Upon Showing A Significant Change In Law Or Fact And A Modification Appropriately Tailored To That Change., Christy J. Lindsay Jan 1993

Consent Decrees Resulting From Institutional-Reform Litigation May Be Modified Upon Showing A Significant Change In Law Or Fact And A Modification Appropriately Tailored To That Change., Christy J. Lindsay

St. Mary's Law Journal

In Rufo v. Inmates of Suffolk County Jail, the Court held that courts may modify consent decrees resulting from institutional reform litigation upon showing a significant change in law or fact and a modification appropriately tailored to that change. The case of Swift v. United States set a strict standard for modification of consent decrees, requiring movants to demonstrate extreme, unexpected hardship and oppression. However, there is a modem trend toward adopting a more flexible standard. The Court deems the “flexible test” as particularly appropriate in the case of the institutional reform consent decree because of its speculative, long-term nature. …

Let A Thousand Policy-Flowers Bloom, Nell Jessup Newton

Journal Articles

This article will analyze recent legislative efforts. The first section of the article examines the two proposed national tribal organizations, a National Native American Advisory Council and a Tribal Judicial Conference, and demonstrates that they will not in fact represent all Indian tribes. The second section of the article criticizes the plan to create a national policy center in Washington, D.C., the National Indian Policy Institute. While agreeing that some of the data gathering and dissemination functions proposed for the center are needed, the article notes these functions can be more economically obtained than by creation of a new center. …

Lawyers At The Prison Gates: Organizational Structure And Corrections Advocacy, Susan Sturm Jan 1993

Lawyers At The Prison Gates: Organizational Structure And Corrections Advocacy, Susan Sturm

Faculty Scholarship

The rise of the public interest law movement ushered in an era of intense debate over the best way to provide legal representation to those unable to afford private counsel. This debate has involved two related dimensions of public interest representation. First, advocates and observers of public interest practice disagree over the proper role of lawyers acting on behalf of poor and underrepresented clients. They offer competing visions of representation spanning a continuum, from providing equal access to the courts for as many poor people as possible, to attacking the causes and effects of poverty and powerlessness.

The second dimension …

Federal Common Law And The Need For Uniformity In The Regulation Of Federal Savings And Loan Associations And Federal Credit Unions, Raquel Maria Prieguez

San Diego Law Review

Federal courts have authority to fashion federal common law in a few narrow instances. Through an examination of relevant precedent in the area of federal common law, this Comment identifies essential factors necessary for the fashioning of federal common law where the rights and duties of the United States are involved. It then applies the findings to the issue of whether state or federal law should govern in actions against officers and directors of federal savings and loan associations and federal credit unions for breach of fiduciary duties or breach of bylaws. This Comment also finds that some federal courts …

Capital Markets In Eastern Europe: The Financial Black Hole, Istvan Abel, John P. Bonin Oct 1992

Capital Markets In Eastern Europe: The Financial Black Hole, Istvan Abel, John P. Bonin

Connecticut Journal of International Law

Hungary is recognized as the transforming country that has made the greatest strides to date in developing its capital market. But the Hungarian example is not yet a success story; the legacies of the past weigh heavy. Since all of the transforming countries are struggling with the problem of creating capital markets, a close look at the Hungarian experience to date will provide insight into what may be reasonable expectations for. the speed with which flexible capital markets can be created during the transition. Without meaningful progress toward developing efficient financial intermediation early in the transition, privatization will be impeded …

Merchant Vessel Crew Levels: An American Perspective, Douglas A. Nemeth Jan 1992

Merchant Vessel Crew Levels: An American Perspective, Douglas A. Nemeth

Marine Affairs Theses and Major Papers

This paper, with an emphasis on policies of "effective manning," provides a critical appraisal on the issue of crew levels aboard large merchant vessels (those greater than 1,000 gross tons). Non-traditional approaches to crew organization and management are discussed. Special regard is made to addressing the various domestic and international laws, regulations, and conventions that pertain to ships' manning. The relationship between the seafarer and ships' safety is emphasized as it pertains to reduced crew size. It is argued that U.S. manning laws and regulations should be amended to permit not only smaller crews, but organizational changes aboard ship that …
