This is a story of change so sudden that it surprised even those who most fervently sought it. For nearly a decade, Seattle University School of Law has offered an extensive typical skills curriculum. All students are involved in an intensive two year writing program. The simulated Comprehensive Pretrial and Trial Advocacy Program trains over 150 students a year, while in the Law Practice Clinic, 60 students a year represent domestic and criminal clients. Course offerings that fill out the lawyering skills supports are offerings such as ADR, Negotiations, and Appellate Advocacy, along with judicial and public service externships and …

Trustees Of The Justice System: Quasi-Judicial Activity And The Failure Of The 1990 Aba Model Code Of Judicial Conduct, Mark Scott Bagula, Robert C. Coates

San Diego Law Review

This Article discusses the treatment of judges' activities to improve the law in the 1990 Model Code of Judicial Conduct. The 1972 Code of Judicial Conduct separated the guidelines for engaging in acts to improve the law ("quasi-judicial activity") from cautions against off-bench activity wholly unrelated to the law ("extra-judicial activity"). The 1990 Model Code of Judicial Conduct consolidates quasi-judicial activity and extra-judicial activity into a single canon - Canon 4. The authors argue that this consolidation provides judges with little encouragement to improve the law. They suggest that the failure to encourage judges to improve our justice system is …

Fair Notice: Assuring Victims Of Unfair Labor Practices That Their Rights Will Be Respected, John W. Teeter Jr Jan 1994

Fair Notice: Assuring Victims Of Unfair Labor Practices That Their Rights Will Be Respected, John W. Teeter Jr

Faculty Articles

Employers should always be required to read notices aloud to their workers as a standard remedy for violations of the National Labor Relations Act. Such a remedy would be a small but essential step in redressing the harm inflicted on workers by an employer’s unfair labor practices. Such notices are necessary for a series of reasons. First, millions of Americans suffer from reading deficiencies and cannot comprehend a printed notice. Second, even literate employees may not happen to observe the printed notice at the workplace. Third, a mere piece of paper is unlikely to reassure victims of unfair labor practices …

Culture Clash In The Quality Of Life In The Law: Changes In The Economics, Diversification And Organization Of Lawyering, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

There is no question that law practice has changed in recent decades. More lawyers work in larger units or newer forms of practice. Increasing numbers of lawyers come from previously excluded groups, including both women and minority demographic groups. After a period of economic boom there is general economic anxiety about the continued health and growth of the law "industry." This occurs as there is a general "speed up" in American work, the forms of law practice organization and billing for legal work are being renegotiated, and rates of dissatisfaction with the practice of law increase, especially among younger and …

Understanding Kaye Scholer: The Autonomous Citizen, The Managed Subject And The Role Of The Lawyer, Nancy Amoury Combs Jan 1994

Understanding Kaye Scholer: The Autonomous Citizen, The Managed Subject And The Role Of The Lawyer, Nancy Amoury Combs

Faculty Publications

The Office of Thrift Supervision's (OTS) unprecedented enforcement action against Kaye, Scholer, Fierman, Hays and Handler (Kaye Scholer) prompted howls of protest from the legal community. OTS, it was claimed, was using its excessive power to redefine the role of the lawyer. This Comment confirms that OTS sought to impose duties on Kaye Scholer that conflict with professional ethics rules. The Comment then goes on to suggest that the conflict over professional responsibility in the Kaye Scholer case reflects, more fundamentally, a conflict over the role of the citizen, and the citizen's relationship with the state. Our adversarial system of …

Lawyers At The Prison Gates: Organizational Structure And Corrections Advocacy, Susan P. Sturm Oct 1993

Lawyers At The Prison Gates: Organizational Structure And Corrections Advocacy, Susan P. Sturm

University of Michigan Journal of Law Reform

This Article attempts to fill the gaps in the discussion of public interest advocacy by exploring the roles of various legal organizations in providing representation to inmates challenging the conditions and practices in prisons, jails, and juvenile justice institutions. It is an outgrowth of a study conducted for the Edna McConnell Clark Foundation on the extent and quality of representation in corrections litigation. It puts forward an organizational change model of public interest advocacy as the most promising strategy for legal representation in the corrections area. It then identifies the major organizational providers of representation, assesses where they fall on …
