Rural Health Care And State Antitrust Reform, Michael S. Jacobs Jul 1996

Rural Health Care And State Antitrust Reform, Michael S. Jacobs

Mercer Law Review

Now more than a hundred years old, the federal antitrust laws seek generally to promote and preserve business competition. Over the past twenty years, courts and regulatory agencies have applied this broad goal in a narrow economic sense, defining "competition" not as rivalry, for example, but as those forms of business activity most conducive to "consumer welfare." Consumer welfare, in this sense, is thought to be maximized when markets produce the greatest output of goods or services at the lowest prices with the widest range of consumer choice. For purposes of analysis, antitrust courts view all markets and market participants …

An Analysis Of Structure, Organization, And Activities Of Community Dispute Resolution Centers In Virginia, Terri Colby Barr Jul 1996

An Analysis Of Structure, Organization, And Activities Of Community Dispute Resolution Centers In Virginia, Terri Colby Barr

Theses and Dissertations in Urban Services - Urban Management

This study is a comparative analysis of the structure, organization and activities of the nine non-profit (501 (c)(3)) mediation centers for the resolution of dispute (CDRC) in Virginia. Data for the analysis was collected through on-site interviews, in-depth case studies, and discussions with the leadership of the centers.

The CDRCs suffer from funding shortfalls which pressure them to shift their attention away from their mission. They are dependent upon the state's court contracts for mediation services in order to financially supplement their pro bono mediations and to generate operating capital. The large-budget CDRCs provide a considerable number of pro bono …

Part I articulates the problem by exploring the role of the city and its part in institutional reform. The first section explains what is meant by local autonomy. The second section examines what constitutes institutional reform. The third section discusses an example of the clash between local autonomy and institutional reform in the context of the ongoing struggle in Kansas City, Missouri. Reflections On The Limitations Of Rational Discourse, Empirical Data, And Legal Mandates As Tools For The Achievement Of Gender Equity In American Higher Education, Susan J. Scollay, Carolyn S. Bratt

Law Faculty Scholarly Articles

Scholars and academicians implicitly accept and subscribe to the notion that reasoned discourse supported by empirical data is at the core of the academic enterprise. Theoretically, then, organizational change within the academy ought to be attainable through the use of rational processes based upon the systematic collection, analysis, and interpretation of data to define the scope of the problem and to identify logical solutions. However, the centuries-long attempt to achieve gender equity for women in institutions of higher education belies the truth of that belief in the power of reason as a catalyst for reforming American higher education.

Modifying The Escalera Consent Decree: A Case Study On The Application Of The Rufo Test, Valerie D. White Jan 1996

Modifying The Escalera Consent Decree: A Case Study On The Application Of The Rufo Test, Valerie D. White

Fordham Urban Law Journal

This Note argues that modifying the Escalera degree is appropriate under Rufo and would allow NYCHA to maintain a safe environment for its residents. It expains the standard used in modifying a consent decree, pre- and post-Rufo, as well as the difficulties in applying the Rufo test. It traces the history of the Escalera Consent Decree, outlines the arguments for and against modification, and applies Rufo to the proposed modification of Escalera, arguing that modification is appropriate because the facts have changed significantly since the Decree was signed, and the modification sought is appropriately tailored to those changed circumstances.

The Brown V. Giuliani Injunction: Combating Bureaucratic Disentitlement, Maria Fazzolari Jan 1996

The Brown V. Giuliani Injunction: Combating Bureaucratic Disentitlement, Maria Fazzolari

Fordham Urban Law Journal

This Comment supports the preliminary injunction decision in Brown v. Giuliani, and demonstrates why judicial intervention is appropriate in welfare litigation to protect the constitutional rights of welfare recipients. It describes the New York City welfare administration system and its statutory framework, detailing the bureaucratic problems facing the system. It also describes "bureaucratic disentitlement," whereby largely obscure administrative proceedings function to effectively delay of deny welfare payments to eligible recipients. It examines the traditional judicial remedies and their general impotence in combating bureaucratic disentitlement, and the preliminary injunction decision granted in Brown and the justiciability of separation of powers issues …

It examines what is meant by local autonomy and institutional reform in the context of the ongoing struggle in Kansas City, Missouri. Finally, it argues for a more coherent system of balancing judicial involvement and local government autonomy in fashioning remedial …

The Continuing Evolution Of Policing: Community Oriented Policing In The Civilian Sector And Its Applicability In The Military Environment, Ralph George Schindler Jan 1995

The Continuing Evolution Of Policing: Community Oriented Policing In The Civilian Sector And Its Applicability In The Military Environment, Ralph George Schindler

Theses Digitization Project

The history of urban policing paints an evolutionary picture describing the various forces that impinged on society's earliest efforts at public policing and led to numerous reforms culminating in what has been termed the professional model of policing. The dynamics of an ever-changing urban society continued to present new challenges to policing and have driven police administrators and politicians to seek new methods of responding to society's criminal element.

Easing The Regulation Of A Pan-European Securities Market: Applying The Recommendations Of The Rudman Report To Easdaq, Maria A. Volarich

Fordham International Law Journal

This Note argues that the EASD should implement suggestions offered in the Rudman Report for Nasdaq because the success of EASDAQ depends on maintaining the trust of all its constituencies in the fair operation of the market. Part I discusses the development of the current regulatory structures of the US and EU securities markets. Part II examines the Rudman Report and the arguments of those who criticize and praise it. Part III argues that the Rudman Report's recommendations should be adopted by EASDAQ, because EASDAQ models itself on Nasdaq, and therefore will encounter the same criticisms of self-dealing and conflicts …
