Corrective Advertising And The Ftc: No, Virginia, Wonder Bread Doesn't Help Build Strong Bodies Twelve Ways, Michigan Law Review

This Note will outline the development and theory of corrective advertising. In particular, it will discuss the residual effects of deceptive advertising, which are the basis for a corrective remedy. The Commission's statutory authority to require corrective advertising will then be explored: the analysis will compare corrective advertising with other types of affirmative disclosure required by the Commission and relate it to the present use of divestiture as a trade regulation remedy. Finally, the possible public benefit accruing from corrective advertising will be considered, along with some thoughts on what policies the FTC should pursue in order to maximize that …

In October 1969, the artificial sweetener cyclamate was banned from sale in the United States by Secretary of Health, Education, and Welfare Robert Finch. To justify his action legally Finch chose to rely'on the so-called Delaney Anticancer Clause of the Food, Drug, and Cosmetic Act of 1938. Consequently, the Delaney Clause, with its requirement that any substance producing cancer in animals be removed from the American food supply, became an immediate center of controversy. The Secretary himself criticized the Clause as an undue restriction on administrative decision making and as an unscientific limitation on scientific discretion.

The 20th century might well be considered the age when children acquired the right to exist. To some, the rights and privileges of children have developed so rapidly that they would categorize our culture to be child-centered and our future to be youth-directed. For the undeniable betterment of mankind, within the past 50 years, we have come to be aware of the inner life and intrinsic worth of the child as an independent being. The Citizens' Crusade Against Poverty through its chairman, Walter Reuther, established this Board of Inquiry to conduct an objective inquiry into: 1. The scope of starvation and hunger in selected poverty areas throughout the country; 2. The extent of nutritional knowledge at medical schools, among medical practitioners, and within the United States Public Health Service; 3. The extent and quality of public and private programs now under way to meet this need; 4. Immediate strategy recommendations to deal with the problem; and 5. Long-range recommendations to attack the basic causes of the problem.

The stated purpose of the book is to "examine...how the quality of the American diet has been allowed to deteriorate." the FDA, a part of the Department of Health, Education, and Welfare (HEW), has the primary governmental responsibility for food protection. The primary responsibility, of course, rests with the food industry itself. But it was the failure of the food industry to carry out this responsibility that long ago led to the passage of various pure food and drug acts, and to the creation of the FDA. This article will present an interpretation and criticism of the Commission on Pesticides and Their Relationship to Environmental Health's conclusions, with a special emphasis on the treatment and relevance of the DDT issue. Each of the fourteen recommendations will be reviewed where relevant to the four major goals set forth above. The crucial and often decisive role of the law as a lever for reform, as a catalyst for transmitting scientific information to the political decision-maker and as a medium for planning to protect against the effects of pesticides pollution on the environment and the population will be emphasized.
