Advertising Regulation: The Contemporary Ftc Approach, Gerald J. Thain

Fordham Urban Law Journal

This article deals with the Federal Trade Commission's traditional activities of adjudication and rule-making by discussing expansion of theories of violation, standards of proof and remedies in advertising cases brought under section 5 of the FTC Act. Specifically, the article discusses pending cases and the FTC's involvement in deceptive advertising, the "Unfairness Doctrine," and the problems associated with advertising targeted at children. The article then evaluates the FTC's alternative approaches to adjudication and rule-making through its substantiation program and stance on counter-advertising.

Recently, state systems of financing public education have been overturned or seriously threatened by several state and federal court cases based on the equal protection clause of the fourteenth amendment. Rodriguez v. San Antonio Independent School District, which invalidated the Texas system of educational financing, will be argued before the Supreme Court next term. This Comment will examine the doctrinal and policy problems that the Court will confront and the alternative solutions that are available to the Court when it considers the constitutionality of the Texas system, which is typical of the educational financing programs that have generated so …

Once again commercial fishing is the object of intensive study in certain quarters. Now, as in the past, this study is receiving nurture from the on-going negotiations regarding the broader issues of international law of the sea. Debate: The Right To Treatment - Encounter And Synthesis - A Summary Of Dr. Birnbaum's Initial Remarks [Comment]

Dr. Birnbaum first noted that the judicial history on the right to adequate care and treatment in public mental hospitals is brief and limited to mere recognition. In 1966 the United States Court of Appeals of the District of Columbia held that a criminally-committed person had the right to adequate treatment, based on a mental health statute. In 1968 the foundation for the right to treatment seemed to be expanded to the constitutional due process level. Finally in 1971, a further expansion occured when a federal district court in Alabama clearly said that a civilly-committed patient had a constitutional right …
