The Public Welfare Standard And Freedom Of Expression In Japan, Lawrence W. Beer

Washington Law Review

This article analyzes the constitutional right of free expression, exercised by political demonstrations, in the political context of contemporary Japan, where consensus among political parties on the constitutional framework itself is lacking. The Japanese people possess an unusually strong sense of cultural unity, and strong emphasis is placed on harmony and consensus in social relations. On the other hand, the excesses and strident tone of many mass demonstrations strikingly illustrate the absence of consensus between groups and the pervasive tendency toward "groupism" which distinguish the Japanese from the American political setting. In 1872, Congress began protecting the American consumer by enacting legislation to prevent mail fraud. From this modest beginning, the consumer protection activities of the federal government have proliferated until today there are at least 33 government agencies engaged in 296 consumer protection activities. In 1961, the estimated annual expenditures by the federal government for direct consumer protection activities totaled 272 million dollars and the number of full-time federal employees engaged in such activities was almost 22,000. Among the one hundred or so business-type activities of the Government are certain operations of the Atomic Energy Commission. In this article we shall examine the origin, growth and usefulness of just one phase of these AEC activities, that is, the production and distribution of radioisotopes. This activity is singled out for emphasis partly because of the remarkable success story resulting from the use of such isotopes, but more especially because of an unusual and even unique aspect of "state trading" introduced into the business by the AEC. Today, automobile accidents constitute a major source of actions at law for negligence. Some of these mishaps may have sudden illness of the motor vehicle operator as the primary or contributing cause. The purpose of this note is to examine the question of sudden illness and its possible value as a defense when negligence is charged against an automobile driver.

A l l foods for stock sold in Western Australia are required by the Feeding Stuffs Act, 1928-1955, to be registered annually with the Department of Agriculture.

For the purposes of the Act, "Food for Stock" includes stock licks, which in turn embrace all preparations claimed to supply or primarily intended to supply mineral matter to stock.
