The Case Against Oligopoly: A New Perspective--

Campaigns of corporate aggrandizement have always attracted a wide assortment of camp followers, with politicians and academics among the most persistent. To the politician, corporate size is a convenient and headline-provoking punching bag (and, during election time, a plentiful source of funding), while many a professor has established a reputation--and made money--by criticizing, extolling, or analyzing its various components. In a series of public hearings, the Senate Subcommittee on Antitrust and Monopoly, with Dr. John Blair as chief economist, produced a subdued blend of both callings. Drawing heavily but not exclusively from the …

Legislative Ethics, 1973., James R. Nowlin Sep 1973

Legislative Ethics, 1973., James R. Nowlin

St. Mary's Law Journal

Approaching the 63d Regular Session of the Texas State Legislature, the need to establish new standards of ethical conduct for the attorney-legislators had increased substantially in public support. The “Sharpstown” Bank scandal and the recent indictments of several present and former state legislators, on numerous counts of theft of state funds, had severely eroded public confidence in the moral turpitude of state lawmakers. This study examines the Texas state legislative process and the conflicting interests that arise in the task of drafting and passing bills in the House of Representatives and the Senate. There were several attempts, prior to 1973, …

Selection And Retention—A Judge's Perspective, Robert F. Utter Aug 1973

Selection And Retention—A Judge's Perspective, Robert F. Utter

Washington Law Review

If all persons are to be treated equally in our courts, the process of selecting judges to oversee courts must be one that insures selection of efficient, intelligent and compassionate judges. It must also be one that insures selection and retention of judges who are truly able to administer, and give the impression that they are administering, their duties impartially to all. Toward this end, the Citizens' Committee on Washington Courts examined the current process for selecting judges and recommended a constitutional amendment which, if approved, would substantially improve the process by which judges are now selected in Washington state.

The Landmark Abortion Decisions: Justifiable Termination Or Miscarriage Of Justice?--Proposals For Legislative Response, Arthur G. Scotland Jul 1973

The Landmark Abortion Decisions: Justifiable Termination Or Miscarriage Of Justice?--Proposals For Legislative Response, Arthur G. Scotland

McGeorge Law Review

In 1967 the California Legislature enacted the Therapeutic Abortion Act. Although the Act was considered a liberalization of prior law, it retained significant limitations on the circumstances under which abortion was permitted. Recent United States and California Supreme Court decisions have invalidated major provisions of the Act and have specified guidelines for permissible restrictions on the abortion procedure. The author presents a comprehensive analysis of the current status of California abortion law and proposes legislation which conforms to the guidelines set forth in the aforementioned opinions.

Newsman's Privilege: A Survey Of The Law In California, Nicholas G. Tinling Jul 1973

Newsman's Privilege: A Survey Of The Law In California, Nicholas G. Tinling

McGeorge Law Review

Recent incidents of newsmen being imprisoned for refusing to disclose confidential news sources before courts and grand juries have focused attention on the conflict between the public need for evidence and the public interest in a free press, unhampered by governmental interference. The "newsman's privilege," i.e., a privilege to refuse to disclose a confidential news source, is the means for resolving this conflict. This comment examines the arguments for and against the need for a testimonial privilege, the existence and limits of common law and constitutional privileges, and the California statutory privilege afforded by Evidence Code Section 1070. The author …
