Enforcement Of Money Judgments Against Real Property In New York
Enforcement Of Money Judgments Against Real Property In New York
Hofstra Law Review
New York's statutory procedures for collecting money judgments through forced sales of debtors' real property were revised in 1963 when the Civil Practice Law and Rules was enacted. Experience since 1963, particularly in those areas of the State where population growth has generated housing shortages, indicates that the new procedures have created a situation which is unfair both to debtors and to legitimate creditors.
Because the CPLR draftsmen believed that the procedural requirements in the old Civil Practice Act unduly hampered the judgment creditor, the revisions embodied in the CPLR are designed to facilitate the collection of judgments. The new …

Kent State - Justice And Morality, John P. Adams
Kent State - Justice And Morality, John P. Adams
Cleveland State Law Review
In the months that followed the killing at Kent State, it became apparent that there was another ministry which was needed. It was not a matter of exercising the "moral authority" as the President suggested, to condemn "... violence and disruption as instruments of change ...." Rather, it became apparent that "moral authority" would be needed to assure that accountability would be established for the abuse of governmental authority and the misuse of military firepower against civilian student dissenters. Violence had been used as an instrument to prevent change, and the moral authority of the religious community needed to be …
Interstate Land Sales Regulation: The Case For An Expanded Federal Role, Robert R. Maxwell
Interstate Land Sales Regulation: The Case For An Expanded Federal Role, Robert R. Maxwell
University of Michigan Journal of Law Reform
Public awareness of the need for protection from fraudulent vendors of undeveloped land recurs periodically and has led to brief flurries of legislative and journalistic attention since the Florida land boom of the 1920s. Despite the rush of state and federal legislation enacted in recent years to combat sharp practices in the land development field, the need for stronger regulation has been revealed by testimony at public hearings held by the Office of Interstate Land Sales Registration as well as by numerous news accounts of questionable tactics employed by some land development promoters. The recent actions of the Federal Trade …
Laird V. Tatum: The Supreme Court And A First Amendment Challenge To Military Surveillance Of Lawful Civilian Political Activity
Hofstra Law Review
The First Amendment was adopted to elevate and defend the central right of a free people: the right to peaceably dissent, to argue, to persuade, and to demonstrate. The United States Army was created to preserve and protect our society. Laird v. Tatum, a class action challenge to military surveillance of civilian politics, demonstrates with frightening precision the degree to which the force of protection can and has imperiled the instrument of freedom.
There was no evidence in the record before the Supreme Court to show the extent to which lawful political activity was chilled and deterred by Army …

Two Proposals For Change In Virginia Law- A Class Action Procedure And A Consumer Fraud Law, Henry E. Howell Jr.
Two Proposals For Change In Virginia Law- A Class Action Procedure And A Consumer Fraud Law, Henry E. Howell Jr.
University of Richmond Law Review
This article encompasses two proposals for change in the law of the Commonwealth of Virginia, one procedural and the other substantive. A proposed class action procedure law and a substantive consumer fraud law are set forth in the appendix and discussed, herein. Credit law reform is beyond the scope of this article. The proposals are independent, although similar, in that they are designed to help the small claimant obtain relief for injuries for which there is presently no practical remedy under Virginia law.
