Pornography As A Species Of Second-Order Sexual Behaviour. A Submission For Law Reform, R. A. Samek
Pornography As A Species Of Second-Order Sexual Behaviour. A Submission For Law Reform, R. A. Samek
Dalhousie Law Journal
The immediate subject-matter of law reform is law, and the immediate reason for reforming the law is dissatisfaction with the law as it is; but the ultimate subject-matter of law reform is the human behaviour contained in a social practice, and the ultimate reason for reforming the law is dissatisfaction with such behaviour. The immediate task of the law reformer is to bring about a change in the legal rules; but his ultimate task is to bring about a change in human behaviour. Hence, law reform ultimately presupposes a set of evaluative standards according to which human behaviour can be …

Misleading Advertising: Prevent Or Punish?, Patrick Fitzgerald
Misleading Advertising: Prevent Or Punish?, Patrick Fitzgerald
Dalhousie Law Journal
I "Promise, great promise," said Dr. Johnson, "is the soul of advertisement." But what if the promise isn't kept? What sort of crime is that? No crime at all, at common law. The common law allotted promises and their breach not to the criminal law but to the law of contract. More important still, the law saw the problem of advertising as part of a wider problem to be solved not by law but by a different institution - the market. The problem of advertising, after all, is one special facet of the conflict between seller and buyer.' According to …
Comparative Criminal Law Within The Soviet Union: A Review, William E. Butler
Comparative Criminal Law Within The Soviet Union: A Review, William E. Butler
Dalhousie Law Journal
The application of the comparative method to the study of two or more legal systems has led a jaded existence in the Soviet Union, for a variety of reasons. As a technique of inquiry, it has been acceptable only insofar as its utilization conforms to the general methodology of dialectical and historical materialism: "It is wrong to think," a Soviet jurist has argued, "that research procedures make up a series of instruments that, from an ideological and political point of view, are neutral."' Marxist jurists consequently have no sympathy for the view that ''comparison" is some type of "objective" or …

In Quest Of A "Decent Society": Obscenity And The Burger Court, Donald C. Harrison
In Quest Of A "Decent Society": Obscenity And The Burger Court, Donald C. Harrison
Washington Law Review
It is the thesis of this Comment that the Burger Court, in its search for constitutional certainty and structure, and for neutral principles of constitutional adjudication, has seized upon the Meiklejohn model and applied it to the area of obscenity. It has done so gropingly and in an effort to restrict, not to expand, openness of expression; nevertheless, as a repository of constructive constitutional theory, Miller and its companion cases may prove more beneficial to future first amendment adjudication than all the confusing obscenity decisions of the Warren years.

United States Multinational Corporations: The Impact Of Foreign Direct Investment On United States Foreign Relations, Clarke N. Ellis
United States Multinational Corporations: The Impact Of Foreign Direct Investment On United States Foreign Relations, Clarke N. Ellis
San Diego Law Review
This Article first provides a definition of MNCs and gives an idea of the scope of foreign direct investment (FDI). Next, the economic and political impact of FDI on both the United States (home country) and the host countries is examined. National perceptions of the economic and political effects of FDI are, in turn, important determinants of the foreign investment policies of host countries and the United States, and these policies are briefly discussed. The interaction of these sometimes complementary, sometimes conflicting foreign investment policies demonstrates the impact of FDI and U.S. foreign relations. The conclusion suggests that the ability …
Foreign Restrictions On U. S. Investment, Henry T. King Jr.
Foreign Restrictions On U. S. Investment, Henry T. King Jr.
San Diego Law Review
The past year has witnessed significant and far-reaching changes in legal restrictions encountered by the U.S. corporate investor in his overseas investment activities. New patterns of control and decontrol appear to be emerging in key areas of the world, and the U.S. corporate investor must be fully prepared to anticipate and deal with them. In some areas completely new styles of participation for the U.S. investor have evolved while in others existing patterns have been modified.
How Citizens Can Use The Initiative Power, Robert L. Scott
How Citizens Can Use The Initiative Power, Robert L. Scott
IUSTITIA
The purpose of this discussion is to demonstrate how the initiative power may be employed by citizens wishing to pass a law independent of the state legislature. Although the initiative power is granted in many state constitutions, in the past it has been used sparingly. However during these days of political activism the initiative power has been given new vitality. For example, in the area of environmental law it has been employed by citizens groups in such states as California, Illinois, and Wisconsin to reserve greater individual rights against environmental polluters.
