The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan Jan 1974

The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan

Hofstra Law Review

One out of every four adults in the United States has taken a psychotropic agent in the last year; one out of every two has taken a psychotrope at some time in his life. Since their introduction in the 1950s, the new psychotherapeutic drugs have attained a position of importance in the armamentarium of the physician. Whether the increase in the use of these drugs is the result of "turbulent times," of promotional efforts, or "of sloppy prescribing practices of clinicians is uncertain." There is, however, reason to believe that psychopharmacology will hold a unique position within drug liability in …

The Myth Of Reverse Race Discrimination: An Historical Perspective, Shirley E. Stewart

Cleveland State Law Review

This paper will analyze the competing considerations in America's struggle for true equality for all its people. The basic premise upon which the analysis will be made is that it is in the best interest of the country to achieve equality among the races, at every level of American society, as quickly as possible. This author views discrimination and the present effects of past discrimination, as experienced by black America, as an evil facing Americans of every color. The sooner this country can rid itself of the evil, the sooner it can be on its way to achieving a decent, …

The Myth Of Sisyphus: Legal Services Efforts On Behalf Of The Poor, Lawrence E. Rothstein Jan 1974

The Myth Of Sisyphus: Legal Services Efforts On Behalf Of The Poor, Lawrence E. Rothstein

University of Michigan Journal of Law Reform

In Greek mythology there is a story about the tyrant, Sisyphus, who is condemned to suffer everlasting anguish. Eternally, he rolls a huge rock up the steep side of a mountain only to have it roll down again just as he reaches the top. Such is the plight in which the poor person finds himself when confronting the legal system. If the poor individual is able to overcome the massive obstacles placed between him and full, fair litigation of his case, he finds that the rules to be applied to the case are stacked against him. This situation is not …

Various approaches which could be incorporated into a program of safeguards are introduced and briefly analyzed. Finally, the article discusses several overall design issues which should be considered in the construction of an adequate program of safeguards. The Demise Of Vertical Privity: Economic Loss And The Uniform Commercial Code, Martin V. Schwartz Jan 1974

The Demise Of Vertical Privity: Economic Loss And The Uniform Commercial Code, Martin V. Schwartz

Hofstra Law Review

The citadel of privity has undergone a massive assault in the field of products liability yet still remains a viable force in warranty law. In most cases, the privity requirement is held to be a function of the dangerousness of the product, the type of harm caused and the situs of the chose in action. As a prerequisite to recovery under a contract theory for breach of warranty, courts have required a finding of privity -- a direct nexus between vendor and vendee. While the strict application of the doctrine created harsh results, courts made inroads to mitigate its effects …

"A Strikeless Society on America's Horizon?" The question mark at the end of this recent headline

"A Strikeless Society on America's Horizon?" The question mark at the end of this recent headline on a syndicated newspaper column suggests appropriate skepticism about the substance therein, even thouperiod be the fullness of time for the emergence of significant new developments in labor peacemakinggh the column reported that the first eleven months of 1973 had been "the most serene labor climate in a decade with man hours lost at a 10-year low."' Well before the year-end "energy crisis" and attendant economic dislocations, however, …

Finally, four case studies are used to evaluate the Olympic organization's performance--that is, the efficacy of relevant policies, rules and procedures that are available to decision-makers to achieve the shared goals of the organization. Several modest proposals are advanced. Aside from these, however, a comprehensive prescription of alternative policies, rules …
