Abuse Of Trademarks: A Proposal For Ompulsory Licensing, Mara L. Babin Jan 1974

Abuse Of Trademarks: A Proposal For Ompulsory Licensing, Mara L. Babin

University of Michigan Journal of Law Reform

This article neither deals with the propriety of the Federal Trade Commission's (FTC) proposed order nor evaluates the effectiveness of compulsory trademark licensing as a remedy for unfair trade practices.8 Rather, the pending cereal industry case is used as a point of departure for an examination of the problem of trademark abuse and the responses of the courts, the Congress, and the FTC to it. Acknowledging the legality of compulsory licensing of trademarks, the article suggests legislation which will incorporate licensing and standards for its application. Such legislation would make licensing an accessible remedy for trademark abuse while accommodating both …

Ohio Mail And Visitation Prison Regulations And The Evolving Recognition Of Prisoners' Rights, Donald L. Uchtmann Jan 1974

Ohio Mail And Visitation Prison Regulations And The Evolving Recognition Of Prisoners' Rights, Donald L. Uchtmann

Cleveland State Law Review

Dynamic changes have occurred in recent years in the area of prisoners' rights. The antiquated view that prisoners were without any rights - that prisoners were "slave [s] of the State' – has been replaced by the more progressive view that a prisoner retains all rights of an ordinary citizen except those rights expressly or necessarily taken from him by law. As will be seen below, the areas of mail rights and visitation rights have been particularly dynamic. In light of the changing views regarding prisoners' rights, one may wonder what the current Ohio regulations regarding mail and visitation within …

The Expungement Or Restriction Of Arrest Records, Gregory J. Lake Jan 1974

The Expungement Or Restriction Of Arrest Records, Gregory J. Lake

Cleveland State Law Review

Over the past decade, concern has arisen regarding the adverse effects stemming from the misuse of arrest records. Crime cannot be condoned, but once an arrested individual has been exonerated, the arrest record should be expunged and not allowed to remain a "record" to be used against him in the future. The scope of the following analysis will not include conviction records, records of civil cases, or military records of arrest and/or conviction under the Uniform Code of Military Justice though many topics to be discussed will also be relevant to such records. Further, since the juvenile court is not …

De Minimis Curat Lex, Brian G. Driscoll Jan 1974

De Minimis Curat Lex, Brian G. Driscoll

Fordham Urban Law Journal

There is a great deal of civil litigation in Urban areas and courts are unable to deal efficiently and justly with the cases that are brought before them. Additionally, there are many cases concerning a small amount of money and disputes in which citizens are in lower and middle economic classes that are never brought before the courts. The nature of the judicial system discourages these small claims but even these relatively small claims may be significant in relation to the income of some of these potential litigants. Handling this problem needs to be done through the small claims court. …

The Fairness Doctrine: Time For The Graveyard? Jan 1974

The Fairness Doctrine: Time For The Graveyard?

Fordham Urban Law Journal

The comments examines the rationale for the fairness doctrine, the obligations arising under it, and the FCC's administration of the doctrine. It further analyzes the judicial construction of the doctrine with emphasis on the doctrine's functional role and Constitutional ramifications. The fairness doctrine is part of a basic broadcast philosophy that mandates viewpoints on any controversial issue of public importance be fairly presented. It is partially codified by the FCC. However, after litigation, it seems clear to the courts that the fairness doctrine and the first amendment cannot share a peaceful coexistence. It may well be that the Court is …

Book Review- Police Corruption: A Sociological Perspective, Peter J. O'Connor Jan 1974

Book Review- Police Corruption: A Sociological Perspective, Peter J. O'Connor

Fordham Urban Law Journal

The author reviews the book Police Corruption: A Sociological Perspective, edited by Lawrence W. Sherman. He concludes that Mr. Sherman's book affords a welcome insight into a persistent problem. Too often lawyers treat problems which are sociological in nature as legal problems only. For that reason, the reviewer highly recommends the book to all lawyers.

The Discharge Permit Program Under The Federal Water Pollution Control Act Of 1972 - Improvement Of Water Quality Through The Regulation Of Discharges From Industrial Facilities, Joyce P. Davis, Robert J. Glasser Jan 1974

The Discharge Permit Program Under The Federal Water Pollution Control Act Of 1972 - Improvement Of Water Quality Through The Regulation Of Discharges From Industrial Facilities, Joyce P. Davis, Robert J. Glasser

Fordham Urban Law Journal

There has been a significant growth of legislation designed to improve the quality of life in American by regulating the way industrial facilities interact with their environments. The new laws created by this legislation has given the federal government significant responsibilities in many areas formerly regulated by the individual states. This change in regulation is apt to impose stress on the modern industrialized society of America as a result of the impossibility to predict the overall effects of particular actions on the total system. Examining the nature of the actions and the probable direct interactions with the system, one may …

Book Review: Where Do I Go From Here? A Career Planning Manual For Lawyers, Kathleen Kruger Jan 1974

Book Review: Where Do I Go From Here? A Career Planning Manual For Lawyers, Kathleen Kruger

Fordham Urban Law Journal

Kathleen Kruger, the Director of Placement for NYU Law School reviews Frances Utley's book, Where Do I Go From Here? A Career Planning Manual for Lawyers. Kruger expresses doubt that one may "plan" a legal career, but that gathering as much information as possible can help and that Utley's book is helpful in this regard. Kruger concludes, however, that some of Utley's book is overly optimistic with respect to the number and variety of career options available to lawyers in the current market.

The Medical Malpractice Mediation Panel In The First Judicial Department Of New York: An Alternative To Litigation Jan 1974

The Medical Malpractice Mediation Panel In The First Judicial Department Of New York: An Alternative To Litigation

Hofstra Law Review

Legislatures and courts throughout the United States have, until recently, been dragging their heels in correcting abuses readily apparent to even the casual observer of malpractice litigation.' Although these abuses are susceptible of a uniform legal solution, each jurisdiction has been left to find its own direction. The legislatures and courts have faced the problem only when abuses actually occurred or were seriously threatened, and their efforts have been primarily directed toward corrective justices - the righting of wrongs already accomplished. Prevention is better than cure, and certainly much cheaper.

There now can be detected in the malpractice field the …

Consumer Involvement And The Consumer Product Safety Act, Joseph A. Page Jan 1974

Consumer Involvement And The Consumer Product Safety Act, Joseph A. Page

Hofstra Law Review

The purpose of this paper is to analyze those sections of the CPSA that invite consumer involvement; to present a brief survey of how the Consumer Product Safety Commission (CPSC), the independent agency administering the Act, has tried to interact with consumers in the first months of the Commission's existence; and to offer a few speculations on the longer-range prospects for meaningful consumer participation in the work of the Commission.

The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan Jan 1974

The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan

Hofstra Law Review

One out of every four adults in the United States has taken a psychotropic agent in the last year; one out of every two has taken a psychotrope at some time in his life. Since their introduction in the 1950s, the new psychotherapeutic drugs have attained a position of importance in the armamentarium of the physician. Whether the increase in the use of these drugs is the result of "turbulent times," of promotional efforts, or "of sloppy prescribing practices of clinicians is uncertain." There is, however, reason to believe that psychopharmacology will hold a unique position within drug liability in …
