The Constitutionality Of Airport Searches, Michigan Law Review
The Constitutionality Of Airport Searches, Michigan Law Review
Michigan Law Review
This Note will discuss airport searches in comparison to several situations in which the courts have found that the requirements of the fourth amendment do not apply or are satisfied even in the absence of a warrant: border searches, administrative searches, stop-and-frisk searches, and searches under express or implied consent. None of these are perfectly analogous to the present airport procedures. Therefore, if airport searches are to be allowed, either the procedures must be modified to fit the established exceptions, or a new exception to the warrant requirement of the fourth amendment must be created.

IUSTITIA
This is an interdisciplinary Journal. It is based in law. Law, the nurture of all disciplines, serves as the linchpin which unites civilized society. In this context the relationship of law to all disciplines is similar to that of mathematics to all sciences. IUSTITIA serves, then, as a sounding board which reflects these underlying legal currents of thought in every possible area of interest. The intent is neither adversary nor advocacy. Enlightenment may well be our shibboleth for those who subscribe to tenets. Moreover, since our title is IUSTITIA, meaning body of law, it follows that our posture is res …

Sociocultural Impact Of Reservoirs On Local Government Institutions, Philip Drucker, Jerry Eugene Clark, Lesker Dianne Smith
Sociocultural Impact Of Reservoirs On Local Government Institutions, Philip Drucker, Jerry Eugene Clark, Lesker Dianne Smith
KWRRI Research Reports
This study of the probable sociocultural impact of a proposed reservoir in central Kentucky on the institutions of local governments of a community adjacent to the reservoir utilizes anthropological concepts of social values and cultural and social change as well as anthropological research techniques. Data on observed impact on the same institutions in communities adjacent to two recently completed Kentucky reservoirs permit inferences as to probable directions and extent of reservoir-related change. Specific aspects of impact considered include: effects of reduction of the county tax base due to Federal acquisition of lands, including necessity for increased severity of taxes and …

The Supreme Court's Jurisdiction--Reform Proposals, Discretionary Review, And Writ Dismissals, James F. Blumstein
The Supreme Court's Jurisdiction--Reform Proposals, Discretionary Review, And Writ Dismissals, James F. Blumstein
Vanderbilt Law Review
With judicial reform a matter of intense public debate, it is essential that one understand the political consequences that may result from the adoption of various reform measures. Moreover, it is important to recognize that an evaluation of any proposed change must proceed from one's conception of the role of the Supreme Court in our society and one's perception of the foundations of its legitimacy. Similar considerations also must shape one's analysis of the rule of four and the Court's practice of dismissing certiorari as improvidently granted. While discretionary review increasingly has politicized a large portion of the Court's work, …

The Case Against Oligopoly: A New Perspective--
Campaigns of corporate aggrandizement have always attracted a wide assortment of camp followers, with politicians and academics among the most persistent. To the politician, corporate size is a convenient and headline-provoking punching bag (and, during election time, a plentiful source of funding), while many a professor has established a reputation--and made money--by criticizing, extolling, or analyzing its various components. In a series of public hearings, the Senate Subcommittee on Antitrust and Monopoly, with Dr. John Blair as chief economist, produced a subdued blend of both callings. Drawing heavily but not exclusively from the …

New Approaches To Legal Study, Philip Slayton
New Approaches To Legal Study, Philip Slayton
Dalhousie Law Journal
Most lawyers - be they practitioners, judges, or just plain academics - have a fairly clear idea of what it is they must do when "studying law". Most lawyers, without giving the matter very much thought, concern themselves with interpreting statutes according to well-understood principles, analysing cases using time-honoured notions such as stare decisis, ratio decidendi, and obita dicta, and occasionally (very occasionally, with much trepidation and many disclaimers) venturing a policy suggestion or two. Not many have wanted to do much else, and few have suggested any virtue in trying anything new. But the winds of change appear to …
A Theory Of Justice, Richmond Campbell
A Theory Of Justice, Richmond Campbell
Dalhousie Law Journal
In A Theory of Justice John Rawls constructs a comprehensive social contract theory of justice to stand as a substantive alternative to utilitarianism. This work combines and develops the ideas of earlier essays, such as "Justice as Fairness" (1958), "The Sense of Justice" (1963), "Constitutional Liberty" (1963) and "Civil Disobedience" (1966), into a systematic moral and political philosophy of astonishing power and subtlety. I shall sketch its main principles, their derivation and justification, and then raise some questions about the supposed opposition between the standards of justice and utility.

Discretion In Felony Sentencing—A Study Of Influencing Factors, Barbara L. Johnston, Nicholas P. Miller, Ronald Schoenberg, Laurence Ross Weatherly
Discretion In Felony Sentencing—A Study Of Influencing Factors, Barbara L. Johnston, Nicholas P. Miller, Ronald Schoenberg, Laurence Ross Weatherly
Washington Law Review
The desirability and constitutionality of discretionary criminal sentencing can be ascertained only if the factors influencing sentencing decisions are known. The authors analyze data generated by a 1971 survey of Washington State superior court trial judges in order to identify the significant factors and to evaluate their relative importance in criminal sentencing. The results indicate that discretionary sentencing is influenced strongly by social biases in no way dependent upon the culpability of the offender, his personal behavior patterns, or circumstances of the crime.
On Criteria For Redistricting, Robert L. Morrill
On Criteria For Redistricting, Robert L. Morrill
Washington Law Review
The one month effort to reapportion the legislative and congressional districts of the State of Washington did not provide an extensive opportunity to probe either the logical human bases for or methods of reapportionment. However, on the basis of the redistricting experience and subsequent analysis and reflection, an appraisal of the generally accepted criteria for reapportionment is appropriate
The Landmark Abortion Decisions: Justifiable Termination Or Miscarriage Of Justice?--Proposals For Legislative Response, Arthur G. Scotland
The Landmark Abortion Decisions: Justifiable Termination Or Miscarriage Of Justice?--Proposals For Legislative Response, Arthur G. Scotland
McGeorge Law Review
In 1967 the California Legislature enacted the Therapeutic Abortion Act. Although the Act was considered a liberalization of prior law, it retained significant limitations on the circumstances under which abortion was permitted. Recent United States and California Supreme Court decisions have invalidated major provisions of the Act and have specified guidelines for permissible restrictions on the abortion procedure. The author presents a comprehensive analysis of the current status of California abortion law and proposes legislation which conforms to the guidelines set forth in the aforementioned opinions.
