Cleveland State Law Review
Having briefly outlined the history of the formal development of the Act, it is the purpose of this Article to discuss in narrative form the legislative process on certain key provisions which were the subject of much debate and disagreement. These areas of disagreement include murder and felony penalties, especially minimum sentences; capital punishment to conform to the U.S. Supreme Court's Furman decision as well as other changes; parole eligibility for those serving life sentences for a capital offense; early release on parole, also known as shock parole; eligibility for probation; definition of reasonable doubt and jury instructions on reasonable …

Survival Of The Bargaining Agreement: The Effect Of Burns, Charles G. Bakaly, Jr., James S. Bryan
Vanderbilt Law Review
The purpose of this article is to examine some of the implications of the Burns decision for management officials contemplating a takeover and more specifically to consider the extent to which a successor employer may be bound by the provisions of its predecessor's bargaining agreement. Although the article focuses on the Burns case itself, some consideration also is given to the Court's earlier decision in John Wiley & Sons, Inc. v. Livingston and to the question whether Wiley provides a means of avoiding the mandates of Burns.

Taxing Stock Dividends And Economic Theory, Stephen B. Cohen
Georgetown Law Faculty Publications and Other Works
Since 1936, the Internal Revenue Code has treated elective stock dividends on common stock, which are taxed on receipt as shareholder ordinary income gain, differently from pro rata stock dividends on common, which are received tax-free. This difference in treatment was reenacted in Section 305 of the 1954 Code; and while the Tax Reform Act of 1969 changed many details of stock dividend taxation, the basic distinction between elective and pro rata stock dividends was, if anything, reinforced. The major purpose of the 1969 amendments to Section 305 was to impose a shareholder ordinary income tax on transactions with the …
