The Less Restrictive Alternative In Constitutional Adjudication: An Analysis, A Justification, And Some Criteria, Robert M. Bastress, Jr.
The Less Restrictive Alternative In Constitutional Adjudication: An Analysis, A Justification, And Some Criteria, Robert M. Bastress, Jr.
Vanderbilt Law Review
The past two decades have witnessed enormous changes in both substantive constitutional law and the courts' approach to constitutional questions. The frequent application of the doctrine of less restrictive alternatives has been a factor of increasingly significant proportions in effecting these changes. Although the doctrine has long been part of our jurisprudence,' it did not begin to have a serious impact until the Warren Court years, and, despite its widely diversified use today, the concept is almost always applied without discussion. Succinctly and broadly stated, the doctrine requires that a state not employ a specific means to accomplish an admittedly …

Powers Of The State Of Kentucky In Implementing An Effluent Tax As A Part Of An Interstate Ohio River Basin Water Pollution Control Program, Anita L. Morse, Edward Zeigler
KWRRI Research Reports
This report is intended to set forth some of the problems and solutions involved in financing and regulating water quality control. The purpose is to record some of the major problems confronting those who legislate water quality, those who espouse technological answers, and those who see the problem in terms of economic solutions. The limits placed by political and institutional constraints on solutions to these problems are frequently not understandable.
Within this report are contained separate investigations: a study of federal-interstate relations and the interstate compact; a study of Kentucky's common law approach to water rights; a study of financing …

State Taxation—Use Of Taxing Power To Achieve Environmental Goals: Vermont Taxes Gains Realized From The Sale Or Exchange Of Land Held Less Than Six Years—Vt. Stat. Ann. Tit. 32, §§ 10001-10 (1973), Mary Miles Teachout
Washington Law Review
In 1973 Vermont became the first state to enact a tax applying specifically to gains realized from the sale of land. The tax, confined to gains on short-term land holdings and designed to control short-term land speculation, promises to become a new weapon in the growing arsenal of innovative land use measures designed to channel land transfer and development in environmentally and socially responsible directions. This note examines the new Vermont tax, assessing its advantages relative to more traditional land use measures. It analyzes a recent Vermont Supreme Court decision upholding the tax and concludes, as did the court, that …

The European Economic Community: Example Of Regionalization Of The Sea?, B. Deniaux
The European Economic Community: Example Of Regionalization Of The Sea?, B. Deniaux
Marine Affairs Theses and Major Papers
The European Law and power has not such a world-wide application nowadays, and it is rather against the rules created by the old European order that the nations formed during the second part of this century have begun a rebellion process. One can address the following questions: what exactly is nowadays the action of the European Community at sea: is there a common policy of the common Market toward marine related problems? If there is one, what is the actual impact of this policy at the international level, and especially these days, in regards of the Law of the Sea …

The Feasibility Of Adjusting For Inflation In Computing Taxable Income, Dwight Drake
The Feasibility Of Adjusting For Inflation In Computing Taxable Income, Dwight Drake
Washington Law Review
This Comment discusses the effect inflation (and deflation) has upon the measurement of taxable income, concluding, in short, that the present standard of measuring income for income tax purposes would be much more equitable if, instead of focusing solely upon the number of dollars received, it accounted for changes in the value of the dollar (as measured by a price index or price indices) by considering the purchasing power of the dollars received. In times of high inflation and in more stable times as well, this new standard for measuring taxable income would have a profound impact on the relative …

Knowledge of the deep ocean floor; continental shelves and margins is basic to many present and future uses of the sea. Such uses include mineral extraction, navigation of surface and subsurface vehicles, construction of structures on the sea bottom and along the margin, and exploitation of living resources of the shelf and of the water column. Uses of the ocean are directly impinged upon by technological changes resulting from research efforts. Applied science is nowhere more visible than in current development of offshore petroleum sources, development of new fisheries and speculation over possibilities for wealth awaiting mankind on the sea …
