The Jurisprudence Of Judge Hardy Cross Dillard, Charles E.M. Kolb
The Jurisprudence Of Judge Hardy Cross Dillard, Charles E.M. Kolb
Vanderbilt Journal of Transnational Law
The purpose of this article is to provide a critical assessment of Judge Dillard's performance during his tenure on the International Court of Justice. Much of this article will be "jurisprudential" in scope, endeavoring to examine developments in international legal theory and international organizations during the past two decades and to assess recent decisions written by the Court. The approach will in part be an institutional one, taking into consideration the ability of an individual member of the Court to shape decisional outcomes of an international body which must resolve contentious litigation and render advisory opinions within the structure of …

Religion, Law And Ethics--A Call For Dialogue, Jerome Hall
Religion, Law And Ethics--A Call For Dialogue, Jerome Hall
UC Law Journal
The interrelation of religion, ethics, and law raises a multiplicity of questions. Problems of professional and ethical responsibilities are the most obvious, but not necessarily the most profound; basic problems of theory in any interdisciplinary study tend to the most intractable. In Jerome Hall's introduction to this symposium, he calls for broadbased dialogue on the theoretical and practical problems presented by the topic, religion and the law. In conclusion, he expresses the hope that such dialogue will yield practical benefits for laymen as well as professionals in the clergy and the law.
The Ideology Of Advocacy: Procedural Justice And Professional Ethics, William H. Simon
The Ideology Of Advocacy: Procedural Justice And Professional Ethics, William H. Simon
Faculty Scholarship
Conventional morality frowns at the ethics of advocacy. Public opinion disapproves of what it considers the lawyer's most characteristic activities. Popular culture can reconcile itself to him only by pretending that all his clients are virtuous. The lawyer's response takes the form of a dialectic of cynicism and naiveté. On one hand, he sees his more degrading activities as licensed by a fundamental amorality lying beneath conventional morality. On the other hand, he sees his more heartening ones as serving an institutional justice higher than conventional morality. The two moods divide the profession as a whole, and the division can …

On Contracting, R. A. Samek
On Contracting, R. A. Samek
Dalhousie Law Journal
Twelve years ago I drew attention in a paper to the importance of the discovery of performative utterances by the well known Oxford linguistic philosopher, John Austin, for a better understanding of the legal concept of contract.' In The Legal Point of View, I developed this concept into what I called the performative function of discourse,2 and in a recent paper I applied it to rebut an attack on the objective theory of contract. 3 My main aim in the present paper is to compare Austin's classification of infelicities, to which performative utterances are subject, with their legal analogues. Although …
Multilingualism And The Cbc Mandate: An Example Of Ineffectual Regulation, William Charland
Multilingualism And The Cbc Mandate: An Example Of Ineffectual Regulation, William Charland
Dalhousie Law Journal
The control of broadcasting, more than any other field subjected to regulation, demands, by its very nature, political neutrality. Given that control is deemed necessary,1 almost total delegation of that control must be made to an independent tribunal in order to avoid charges of political interference with the freedoms of speech and expression. The presence of the CBC as apublic corporation, however, raises questions as to the source and substance of the CBC mandate. What body is responsible for creating the goals or objects of this corporation? Who bears the responsibility initially to interpret and shape programming to meet these …
Parol Evidence In Washington: The Use Of Extrinsic Evidence To Address The Integration And Interpretation Of Documents, Arden J. Olson
Parol Evidence In Washington: The Use Of Extrinsic Evidence To Address The Integration And Interpretation Of Documents, Arden J. Olson
Washington Law Review
Washington judicial treatment of these related concerns, the integration and interpretation of written contracts, constitutes the focus of this comment. Part One will distinguish integration from interpretation and highlight factors which bear on the choices between conflicting approaches to extrinsic evidence. Part Two will examine the rules governing the ascertainment of integration, by which courts decide whether the parties embodied their transaction in a written memorial, rendering it subject to the parol evidence rule. Part Three will analyze the analogous rules governing the extent to which a court interpreting the parties' language may look to the circumstances surrounding the document's …

The Right To A 200-Mile Exclusive Economic Zone Or A Special Fishery Zone, Carl August Fleischer
San Diego Law Review
In this Article I shall first consider the rules contained in the Revised Single Negotiating Text (RSNT) in relation to claims put forward at the UNCLOS and in the actual practice of States. Then I shall view the rules of the RSNT in the light of other sources of international law, in particular the 1974 judgments by the International Court of Justice (ICJ) concerning the fishery limits off Iceland and the trend established by unilateral extensions of several States through national legislation. I shall end with a discussion of the status of the UNCLOS (and in particular of the Single …
