Voiceprints: The Determination Of Admissibility, Terry Timblin
University of Dayton Law Review
One of the most crucial issues facing courts in recent years is the admissibility of novel scientific evidence. There is obviously a strong temptation to use a scientific process or machine that purports to provide unbiased information free from the many competency and credibility problems associated with testimonial evidence. One such process, called spectrographic analysis, is now being favorably received by the courts despite its substantial shortcomings. Spectrographic analysis-popularly known as "voiceprints"- is a technique for the identification of voices with the aid of a machine known as the sound spectrograph. The purpose of this comment is to examine the …

Parodoxes Of Canadian Legal Education, H. W. Arthurs
Dalhousie Law Journal
If the history of Canadian legal education should ever be written, these years of the mid-1970s will surely be viewed as a period of critical significance. For at least a quarter-century, growth has been the predominant theme: growth in student numbers and faculty complements; growth in democratic decision-making by both faculty and students, but also - inevitably - in the bureaucratic structures of faculties; growth of physical facilities and indeed, of whole new faculties; growth of libraries and of the pace and variety of research; growth of curricula and of teaching methods; growth in professional esteem and in public contribution; …
The Enlistment Contract: A Uniform Approach, David A. Schlueter
The Enlistment Contract: A Uniform Approach, David A. Schlueter
Faculty Articles
The author explores the history of various jurisdictional and administrative issues that arise under consideration of a service member’s enlistment contract. He proposes a change to the Uniform Code of Military Justice to codify the constructive enlistment doctrine for establishing personal court-martial jurisdiction over service members whose enlistment contracts and entry onto active duty were facilitated by recruiter misconduct. The proposal later became part of amendment to Art. 2, U.C.M.J..

Toward A Revision Of The Minting And Coinage Laws Of The United States, David L. Ganz
Cleveland State Law Review
The time has come for change -for the recodification, revision, and modernization of American minting and coinage laws. The purposes of this Article are multi-fold; to examine current coinage laws, to discuss a revision proposed in1973, to present views expressed and heard by Congress in recent times, and to mesh these points in such a manner that a more viable series of minting and coinage laws will emerge. Involved in this inter-twining will be several competing interests: those of the Department of the Treasury and its subsidiary Bureau of the Mint; to the extent that their functions overlap, the Bureau …
Case Note: Environmental Law - National Environmental Policy Act - Potential Environmental Effects Of Urban Unemployment Require Preparation Of An Environmental Impact Statement, Elizabeth Manning
Fordham Urban Law Journal
In this case note, Elizabeth Manning analyzes City of Rochester v. United States Postal Service, 541, F.2d 967 (2d Cir. 1976). The City of Rochester and the Genessee-Finger Lakes Regional Planning Board sued to enjoin the Postal Service from constructing a 12 million dollar postal facility in a Rochester suburb, in contemplation of abandoning an older smaller facility within the city itself. Plaintiffs asserted that the Postal Service's change of location was "a major Federal actio[n] significantly affecting the quality of the human environment," and that the National Environmental Policy Act of 1969 (NEPA) required the preparation of an Environmental …

Legal Theory And The Obligation Of A Judge: The Hart/Dworkin Dispute, E. Philip Soper
Michigan Law Review
This article offers a review of the Hart-Dworkin dispute and a qualified defense of the positivist's model against Dworkin's attack. The defense is cast primarily in the form of the second possible response to a descriptive theory: Dworkin's attack fails, I suggest, because it involves descriptive claims that can be accommodated to the positivist's conceptual theory regardless of one's view about the plausibility of those claims.
