Bradwell V. State: Some Reflections Prompted By Myra Bradwell's Hard Case That Made "Bad Law", Charles E. Corker

Washington Law Review

Bradwell and Slaughter-House deserve study together for a second reason. These two decisions provide useful lessons for our time about the Equal Rights Amendment (ERA).10 They demonstrate that the consequences of a constitutional amendment—particularly one written in abstract and grand terms like the fourteenth amendment or the ERA—are unpredictable and dependent upon imponderables such as the sequence of cases on the Court's calendar.

Recent Developments In Labour Law In Nova Scotia, Geoff England, Brian Hansen, Greg North

Dalhousie Law Journal

In the eighteen months since "Recent Developments in Labour Law in Nova Scotia" were last noted, the labour scene, both in Nova Scotia and generally across Canada, has been very active. A Case For Judicial Balancing: Justice Stevens And The First Amendment, Richard G. Birinyi Jan 1978

A Case For Judicial Balancing: Justice Stevens And The First Amendment, Richard G. Birinyi

Seattle University Law Review

This comment discusses four of Justice Stevens's opinions that analyze first amendment issues. Two dissenting opinions in Splawn v. California and Smith v. United States deal expressly with obscenity, and reject the Court's present method of analysis. Young v. American Mini Theatres, Inc. and Federal Communications Commission v. Pacifica Foundation both develop a balancing approach to ascertain the constitutionality of government regulation of nonobscene offensive speech. The comment concludes that Justice Stevens correctly identifies the factors necessary to insure proper Court protection of speech interests.

The Meaning Of Law In The Book Of Job, Herbert Fingarette Jan 1978

The Meaning Of Law In The Book Of Job, Herbert Fingarette

UC Law Journal

The law in all of its aspects permeates the Book of Job. In this Article, the author presents the story of the man, Job, in terms of its teachings concerning the law. This perspective must come before and be the basis for the law and its reasoning.

Fordham Urban Law Journal

Congress' intention of the Rehabilitation Act of 1973 was to eradicate discrimination based on handicap. Note examines how the Rules and Regulations promulgated to implement section 504 of the Act by permitting waivers under certain circumstances fall short of accomplishing this goal and examines the small, but increasing number of cases decided under the Act.
