New York City Consumer Protection Law Of 1969, Thomas G. Morgan
New York City Consumer Protection Law Of 1969, Thomas G. Morgan
University of Michigan Journal of Law Reform
In recent years there has been growing concern over the lack of legal protection afforded the American consumer. Comprehensive consumer protection legislation has been introduced at all levels of government, and several significant proposals have been enacted into law. One such enactment at the municipal level is the New York City Consumer Protection Law of 1969, which establishes a framework for a broad ban against unfair trade practices and vests the city's Commissioner of Consumer Affairs with extensive powers of enforcement. In this note, the New York City ordinance will be analyzed and evaluated against the general background of existing …

Welfare, Due Process, And The Need For Change., V. Camp Cuthrell Iii
Welfare, Due Process, And The Need For Change., V. Camp Cuthrell Iii
St. Mary's Law Journal
President Franklin D. Roosevelt spoke of a “social duty” owed by the government to those unfortunate citizens who strive to maintain themselves but cannot. However, the nature of “social duty” remains ambiguous and unclarified today. The failure to define its nature has caused much of the confusion surrounding welfare law today. Specifically, the confusion has resulted in a wide judicial continuity regarding the weight given to the recipient's interest in welfare payments that ranges from stating that the interest may be sufficient to enjoin the Secretary of Health, Education, and Welfare from freezing state funds to stating that this interest …

Foreign Corporation Laws: Source And Support For Reform, William Laurens Walker
Foreign Corporation Laws: Source And Support For Reform, William Laurens Walker
Duke Law Journal
The original reason for foreign corporation laws is lost; their conceptual foundation is largely discredited, and, at most, the present utility of this expanding and complex scheme is minimal. In the face of these conditions the author turned to a search for alternatives and found in the "mutual exemption" statutes of Quebec and Ontario significant steps toward foreign corporation law reform. In the following article the author investigates, with the aid of information obtained through personal interviews and field study, the success which the two Canadian provinces have achieved with their unique arrangement.
Income Tax Deductions For Estate Planning Fees, Stephen E. Gilhuley
Income Tax Deductions For Estate Planning Fees, Stephen E. Gilhuley
Vanderbilt Law Review
The need to engage the services of a lawyer may arise in a variety of situations, and the possibility of deducting the fees for a lawyer's services from the client's personal taxable income will ultimately depend on which one of several competing policies of the tax law is properly applicable under the particular circumstances. Taxpayers and their attorneys should be aware of the deductibility of expenses incurred for legal services rendered in connection with the planning of the taxpayer's estate. Such estate planning services include the drafting of a will, the arrangement of inter vivos and testamentary gifts, the creation …
