Transferring North Carolina Real Estate Part Ii--Roles, Ethics, And Reform, Dale A. Whitman
Transferring North Carolina Real Estate Part Ii--Roles, Ethics, And Reform, Dale A. Whitman
Faculty Publications
As we have seen in Part I of this article, prevailing practices in the transfer of North Carolina real estate are seriously deficient in their substantive protection of the buyer. Part II will explore whether these practices also violate the norms of professional conduct and will conclude with some proposals which should ameliorate both the substantive and ethical deficiencies which face the real estate buyer. Before doing so, however, it seems appropriate to discuss in some detail the roles of various actors in the typical transaction and the types of persons who fill those roles.

Clinical Experience And The College Work-Study Program, James T. Flaherty
Clinical Experience And The College Work-Study Program, James T. Flaherty
Cleveland State Law Review
Mark Twain is often quoted as the source of the remark that "Everybody talks about the weather, but nobody does anything about it." This quotation is appropriately used for many problems exclusive of the weather. It can also be applied to law school clinical experience and financial aid problems. As applied to weather and clinical programs, the quotation is not always quite accurate, as another often-quoted saying has been equally applicable: "It is better to light a candle than to curse the darkness." Without question, many candles have been lighted in the clinical area. It is the purpose of this …
Putative Father's Visitation Rights, John F. Harkins
Putative Father's Visitation Rights, John F. Harkins
Cleveland State Law Review
A problem contiunally encountered in the enforcement of child support payments ordered in a proceeding in Bastardy arises when the mother of the child, in whose custody the child remains, refuses to allow the putative father reasonable periods of visitation. In numerous cases, visits with child are denied, even when the putative father regularly pays the weekly support and, in addition, expresses a genuine affection and concern toward the well-being of the child. Assuming that the putative father desires an association with his illegitimate child which the mother refuses, what remedies does or should the putative father have?

Projecting future needs is a painstaking and hazardous affair. Avoiding such pain, however, is even more hazardous. There is good reason to attempt to project the next decade's need for, and potential supply of, new lawyers in Kentucky. Adequate legal services are an important ingredient in orderly economic growth and an essential element in preserving a free society. On the other hand, an over-abundance of lawyers can depress the economics of the profession to the point at which its ability to sustain desired standards of ethical conduct and to attract a high caliber of new talent are both threatened. Moreover, …
