Extrajudicial Consumer Pressure: An Effective Impediment To Unethical Business Practices

Duke Law Journal

Although recent efforts in consumer protection have centered upon additional legislative assistance, several direct extrajudicial and non-official forms of self-help can be successfully employed by a dissatisfied consumer. This comment explores the legal limits on such forms of action conducted either by an individual consumer or by an organized group, with a view toward providing a standard which will enable protestors to remain within the law yet be effective in their actions.

The Governor's Private Eyes, Tamar Frankel

Faculty Scholarship

In his inaugural speech on January 3, 1967, Florida Governor Claude Kirk declared a War on Crime. For this purpose he announced the creation of a unique War on Crime Program. Its activities were to include a Citizen's Awareness Program, but its main function was directed to the investigation of crimes. As the Program's director, the Governor appointed Mr. George Wackenhut, the president of the Wackenhut Corporation, a large private investigation firm. Mr. Wackenhut agreed to provide his services for one dollar a year; his corporation was simultaneously retained to supply the Program with the necessary administrative facilities and investigative …

The Legal Problems Of The Rural Poor Jun 1969

The Legal Problems Of The Rural Poor

Duke Law Journal

"Providing equal justice for poor and rich, weak and powerful alike is an age-old problem. People have never ceased to hope and strive to move closer to that goal." Griffin v. Illinois, 351 U. S. 12, 16 (1956). The Duke Law Journal presents this report of its survey study of the legal problems of the rural poor. It is an attempt initially to lend some insight into the kinds of problems, the methods of resolution, the utilization of services, and the perception of legal or other remedies common to the rural poverty group. The second phase of the study is …

Vanderbilt Law Review

Despite the general prosperity of this country, a cursory survey of any American town or city will reveal that many Americans live in housing which is "substandard." Frequently one sees unpainted houses characterized by broken windows and inadequate sanitary facilities. In urban areas, the ever present tenement is often filled with too many people and not enough toilets; stairs are dangerous and refuse lies uncollected in the halls. Rooms without windows are common, while those blessed with windows frequently receive little light--the only view is another window of another building. Disease and discomfort are everywhere. These conditions, however, are neither new …

The Model Cities Program, Otto J. Hetzel, David E. Pinsky

Vanderbilt Law Review

The period from 1961 through 1965 saw a dramatic increase in the number of federal grant-in-aid programs and the total federal funding levels directed at curing the ills of the urban community. There was a persistent anxiety, however, that, despite the proliferation of new drugs administered to the patient for his array of symptoms, the progress was not satisfactory, and that time was running out. In October, 1965, a Task Force on Urban Problems was appointed by President Johnson to study urban problems and recommend action. The Task Force looked at the prior efforts and decided a new approach was …

Reimbursement Of Defense Costs As A Condition Of Probation For Indigents, Michigan Law Review May 1969

Reimbursement Of Defense Costs As A Condition Of Probation For Indigents, Michigan Law Review

Michigan Law Review

It is extremely difficult to obtain precise information concerning the prevalence of this practice. There is only one reported case on the subject, and empirical evidence is almost wholly lacking because of the wide discretion granted sentencing courts in imposing probation conditions, and because of the reluctance of appellate courts to review the exercise of that discretion. However, courts have frequently imposed costs on nonindigent probationers, and in many jurisdictions the statutes which authorize such a probation condition with respect to solvent probationers seem broad enough to include indigents as well. Moreover, two recent studies have unearthed specific data which …
