Criminal Law Revision In Delaware And Hawaii, Frank B. Baldwin Iii Jan 1971

Criminal Law Revision In Delaware And Hawaii, Frank B. Baldwin Iii

University of Michigan Journal of Law Reform

Criminal law revision has not been limited to the largest states, which have greater resources and legal facilities, but has also occurred in Delaware and Hawaii, states which have relatively small numbers of legal practitioners, no local school of law, and relatively small populations. In both states, criminal law revision efforts were quite similar, in that an early decision was made to rely heavily on published revised codes of other jurisdictions and on the Model Penal Code, rather than undertaking an extensive initial study and preparing a unique code. The following article will compare the criminal law revision projects in …

Local Government In Sweden, Terrance Sandalow Jan 1971

Local Government In Sweden, Terrance Sandalow

Articles

Ever since the publication of Marquis Childs' The Middle Way, Americans of liberal persuasion have tended to point to Sweden as a model, a nation which simultaneously has achieved rapid economic growth, eliminated poverty, and maintained individual and political freedom. Swedish cities, and especially Stockholm, are reputed to be among the best planned in the world. Yet, for all the admiration that has been expressed, there has been surprisingly little investigation by Americans of the legal and governmental framework within which the Swedes have accomplished so much. The modest aim of this paper is to report the major outlines of …

"Fair Market Value," "Just Compensation," And The Constitution: A Critical View, W. Harold Bigham Dec 1970

"Fair Market Value," "Just Compensation," And The Constitution: A Critical View, W. Harold Bigham

Vanderbilt Law Review

It has become almost an article of faith that "fair market value"constitutes the only fair and workable measure of damages for a landowner whose real property has been taken for public use. The courts apply it woodenly;' the magic words are solemnly intoned to jurors, commissioners, and arbitrators. Even the learned scholars in the field give it at least implicit recognition. Moreover, it continues to flourish despite widespread public dissatisfaction with both the substantive test for damages and the procedures through which the land is obtained. The taking of private property for the federal interstate highway and urban renewal programs, …

Ancillary Costs In The Purchase Of Homes, John C. Payne Nov 1970

Ancillary Costs In The Purchase Of Homes, John C. Payne

Missouri Law Review

The basic legal doctrine governing the transfer of land is relatively simple. Or, to be more accurate, it is not especially difficult to comply with the minimum requirements of the law. Theoretically, the grantor must merely execute and deliver a conventional document. In practice, however, land transfers are sufficiently complex to require the services of a number of persons besides the immediate parties. Real estate brokers, attorneys, mortgage lenders, public officials, and others play their parts and generally demand compensation. It follows that in the sale of land two distinct costs must be met: first, the gross purchase price; and …

Californians Need Beaches--Maybe Yours, Susan P. Finlay, David J. Van Til Jul 1970

Californians Need Beaches--Maybe Yours, Susan P. Finlay, David J. Van Til

San Diego Law Review

Our nation faces a serious problem of congested recreational resources as a result of a rapid increase in population compounded by concomitant increases in urbanization and leisure time. These factors simultaneously increase the demand for more public recreational areas and reduce the amount of space available. Necessarily, this expending demand comes into conflict with the private property rights of those who hold title to lands particularly suited for public recreational purposes. A recently litigated aspect of this conflict involves the ownership of the beach areas of our nation's sea coasts. Public interest demands public use, access, and enjoyment; traditional property …

On The Road To Educational Failure: A Lawyer's Guide To Tracking, G. Emlen Hall Jun 1970

On The Road To Educational Failure: A Lawyer's Guide To Tracking, G. Emlen Hall

Faculty Scholarship

Tracking, using the term in the broader sense to include all ability . grouping, represents a solution to an insoluble dilemma. While individualized instruction has long been touted as the great desideratum in American education, no one has ever been willing to pay what it would cost to give each child a different education. Educators thus devised what they considered to be the-next best thing, educational units large enough to be economically viable but small enough to isolate students with what were thought to be roughly similar educational needs. These needs are determined by an unformulated formula employing "objective testing," …

Judicial Sanctions And Legislative Redistricting In Washington State, W. Basil Mcdermott Jun 1970

Judicial Sanctions And Legislative Redistricting In Washington State, W. Basil Mcdermott

Washington Law Review

This case study of the impact of Baker v. Carr on the State of Washington attempts to discern the nature of the role of the judiciary in the implementation of new reapportionment rules. Redistricting is usually thought of as a highly political area, outside the normal involvement of courts. Now that federal judges are under a mandate to consider the problems in this area, it is important to understand the capacity of the judicial system to discharge its role. By exercising their power with restraint, the federal judges in Washington sought to influence the political system to do its duty …

Securing, Examining, And Cross-Examining Expert Witnesses In Environmental Cases, David Sive May 1970

Securing, Examining, And Cross-Examining Expert Witnesses In Environmental Cases, David Sive

Michigan Law Review

It is necessary at the outset to define the scope of the problem with which this Article will deal. Environmental cases are litigated in both judicial and administrative tribunals. The judicial proceedings include plenary actions and special proceedings and are heard in both federal and state courts. The administrative proceedings include licensing proceedings before federal agencies such as the Federal Power Commission and Atomic Energy Commission. Whether such administrative proceedings are deemed quasi-judicial or not, they are within the scope of this Article so long as they are adversary and involve testimony under oath, examination and cross-examination of witnesses, a …
