Securing, Examining, And Cross-Examining Expert Witnesses In Environmental Cases, David Sive May 1970

Securing, Examining, And Cross-Examining Expert Witnesses In Environmental Cases, David Sive

Michigan Law Review

It is necessary at the outset to define the scope of the problem with which this Article will deal. Environmental cases are litigated in both judicial and administrative tribunals. The judicial proceedings include plenary actions and special proceedings and are heard in both federal and state courts. The administrative proceedings include licensing proceedings before federal agencies such as the Federal Power Commission and Atomic Energy Commission. Whether such administrative proceedings are deemed quasi-judicial or not, they are within the scope of this Article so long as they are adversary and involve testimony under oath, examination and cross-examination of witnesses, a …

Antitrust Law--Restraint Of Trade--Antitrust Implications Of The Exchange Of Price Information Among Competitors: The Container Corporation Case, Michigan Law Review

Michigan Law Review

Traditionally, it has not proved difficult to find policy considerations which justify the existence of programs of price information exchange among competitors. There has been widespread agreement that businessmen require knowledge of all the economic forces which affect their operations. Justice Holmes once said: "I should have thought that the ideal of commerce was an intelligent interchange made with full knowledge of the facts as a basis for the forecast of the future on both sides." Similarly, Justice Brandeis commented that "[t]he Sherman Law ... certainly does not command that competition shall be pursued blindly, that business rivals shall remain …

The Supreme Court: Viable Fallibilism Or Fatal Infallibility, Bernard Goodwin Mar 1970

The Supreme Court: Viable Fallibilism Or Fatal Infallibility, Bernard Goodwin

Vanderbilt Law Review

The recent growth in the importance and apparent power of the Supreme Court has been one result of our rapidly changing twentieth century society. In the social ferment of the last two decades, the Court, more than Congress, has expressed the conscience and intellectual consensus of American culture. Speaking as a practicing attorney and concerned citizen, the author of this article does not criticize the Court for stepping into this gap in our governmental structure, but he feels that the possibility of increased activism on the part of the Court indicates a serious breakdown in governmental checks and balances and …

The Use Of Arbitration In The Settlement Of Bilateral Air Rights Disputes, Ross T. Dicker Jan 1970

The Use Of Arbitration In The Settlement Of Bilateral Air Rights Disputes, Ross T. Dicker

Vanderbilt Journal of Transnational Law

In the field of aviation, world transportation is bound together by a highly complex and sophisticated arrangement in which each country designates a single carrier to carry its flag to foreign-countries. The United States has not followed this practice of designating one line as the nation's flag carrier and has twenty "international" carriers which transport passengers, cargo, and mail to foreign countries. Each one of these carriers is a private business concern, competing in most cases with another American carrier covering the same route, and in all cases with the air carrier of the country to which it flies. In …

The Effectiveness Of State And Local Regulation Of Handguns: A Statistical Analysis, Martin S. Geisel, Richard Roll, R. Stanton Wettick Jr. Aug 1969

The Effectiveness Of State And Local Regulation Of Handguns: A Statistical Analysis, Martin S. Geisel, Richard Roll, R. Stanton Wettick Jr.

Duke Law Journal

One aspect of the continuing debate over weapons control, apart from Constitutional issues, is whether legislation is inherently capable of reducing crime and deaths by shooting. The opponents of increased control, tacitly admitting that empirical evidence is one means for measuring the effect of weapons regulation, have contended that "[e]xpert opinion and compelling evidence seem to indicate that the amount or kind of crime in a community is not substantially affected by the relative ease with which a person can obtain a firearm." National Rifle Association of America, The Gun Law Problem 10. In the following study the authors employ …

Racial Imbalance, Black Separatism, And Permissible Classification By Race, Norman Vieira Jun 1969

Racial Imbalance, Black Separatism, And Permissible Classification By Race, Norman Vieira

Michigan Law Review

The Article will begin with a discussion of the School Segregation Cases which have been invoked both to sustain and to invalidate corrective racial classification. It will then review federal discrimination against Japanese-Americans and against Indians, as well as the more obscure discrimination found in immigration and naturalization laws. It will also consider, in some detail, the paradoxical rules governing the discriminatory selection of jurors and, in lesser detail, the cases dealing with domestic relations and racial designations. A concluding section will discuss black separatism and general policy matters relating to the correction of imbalance in the schools. The Article …

The Council-Of- Governments Approach To Governmental Fragmentation, Louis F. Comus, Jr. May 1969

The Council-Of- Governments Approach To Governmental Fragmentation, Louis F. Comus, Jr.

Vanderbilt Law Review

Much of the current literature in the field of metropolitan government either sets forth examples of governmental difficulties and inefficiencies which result from the urbanization of our population or merely assumes that such difficulties exist. In either case the prescription usually involves some sort of "metropolitanization" of urban governmental structure. Since such prescriptions are aimed either at metropolitan difficulties in general or at particular inefficiencies, it is useful to consider some of the more frequent complaints. One factor often cited as contributing to various urban ills is the archaic governmental structure of many county governments in metropolitan areas. Counties which …
