Toward A National Policy On Population Distribution, Steven S. Anderson
Toward A National Policy On Population Distribution, Steven S. Anderson
Washington Law Review
The purpose of this comment is to explore some of the population problems in modern America. It is written from a lawyer's perspective, in search of pragmatic solutions to real problems. Accordingly, it concentrates on the effects which various laws and policies have on population distribution with a view toward isolating those factors which can be manipulated by government to distribute population in a more rational and desirable manner. Even if no affirmative distribution program is adopted, an increased awareness of the population effects of existing federal activities will serve to eliminate future policy choices which might exacerbate current distribution-related …
Constitutional Law—Equal Protection: Supermajority Voting Requirements—Gordon V. Lance, 403 U.S. 1 (1971), Anon
Washington Law Review
On April 29, 1968, the Board of Education of Roane County, West Virginia, submitted to its electorate a proposal calling for the issuance of general obligation bonds, the proceeds of which were to be used for the construction of new school buildings and the improvement of existing educational facilities. At the same election, by separate ballot, the voters were asked to authorize the Board to levy additional taxes to support current expenditures and capital improvements. Both proposals failed to receive the requisite sixty percent affirmative vote and were defeated. Following the election, respondents, a group of concerned parents, appeared before …

Possession And Control Of Drugs In Pennsylvania: What Is It?, Mark Louis Glosser
Possession And Control Of Drugs In Pennsylvania: What Is It?, Mark Louis Glosser
Duquesne Law Review
The rapid growth of drug prosecutions at the county level of the judicial system is now filtering upward to the Commonwealth's appellate courts. It was not until January 1971, that the Pennsylvania Supreme Court first considered the section of the Drug, Device, and Cosmetic Act which prohibits the possession or control of dangerous or narcotic drugs. Following this decision the superior court rendered two opinions which exclusively relied on the rationale developed by the supreme court. Prior to these decisions there was no judicial guidance as to what quantum of evidence was sufficient to convict for possession of drugs. The …

The Appointment And Disappointment Of Supreme Court Justices, Philip B. Kurland
The Appointment And Disappointment Of Supreme Court Justices, Philip B. Kurland
Articles
The recent controversy over President Nixon's appointments to the Supreme Court, and the institution of impeachment proceedings against Justice Douglas, have raised important questions concerning qualifications for, and behavior of, Supreme Court justices. In this Article, Professor Kurland discusses the important qualities that a Supreme Court justice should possess, the various competing pressures that often influence presidential selections, the Senate's proper role in the confirmation process, and, finally-with special emphasis upon the impeachment proceedings against Justice Douglas-the available means of removing incumbent justices.

Reapportionment--Nine Years Into The "Revolution" And Still Struggling, Michigan Law Review
Reapportionment--Nine Years Into The "Revolution" And Still Struggling, Michigan Law Review
Michigan Law Review
Malapportioned legislative districts traditionally have inhibited the effective working of government at the federal, state, and local levels. By 1960, the population disparities among legislative districts had attained such great magnitude "that the integrity of representative government was in many instances endangered." The underrepresented victims of malapportionment sought relief through the courts. Initially the Supreme Court, ever hesitant to enter the "political thicket," declined to address itself to reapportionment controversies. This era of judicial inaction ended in 1962 with the Court's ruling in Baker v. Carr, in which the plaintiffs overcame the formidable barrier posed by the political-question doctrine. …
American Civil Liberties And Constitutional Change, Donald P. Kommers
American Civil Liberties And Constitutional Change, Donald P. Kommers
Journal Articles
This essay is an attempt to analyze, for the non-American reader especially, some of the factors that affect the condition of civil liberties in the United States. It deals mainly with the U.S. Supreme Court and its effort to define the limits of personal freedom within the framework of the American constitutional system. This effort has been a main preoccupation of the Supreme Court during the last two decades or so as the social conflicts besetting America have taken the form, as they usually do, of constitutional conflicts that the Court must eventually decide. Most of these questions have represented …
Comparative Broadcast Licensing Procedures And The Role Of Law: A Fuller Investigation, Michael Botein
Comparative Broadcast Licensing Procedures And The Role Of Law: A Fuller Investigation, Michael Botein
Articles & Chapters
Professor Botein examines the validity of Professor Fullers widely read but seldom criticized theory that traditional administrative adjudication is unsuited to resolve certain kinds of social task, which Fuller has labeled "polycentric problems." Professor Botein focuses upon Professor Fuller's example of the FCC's comparative licensing procedure as a poblem unsuited to adjudication. Taking as his starting point Professor Fullers criticism of the FCC- a criticism Fuller never tested against the Commission's actual operations-Professor Botein examines Fuller's theory of polycentricity by analyzing its contentsJ applying it to concrete situations) and exploring whether there exists any alternatives better than the Commission's present …
