Shaffer suggests a new paradigm for law practice that is not based on rigid control of clients in an impersonal attorney-client relationship. He argues forcefully that disregard for the client's emotions ignores important "facts" that can be used in the law office and the legal process. Shaffer's work suggests the possibility of gaining personal satisfaction and of providing more adequate legal services by actively counseling and understanding clients. Such a humanistic approach to the practice of law can be rooted only in an awareness of the psychological and social defenses erected against both the attorney's clients and the attorney's impact …
Using A Prediction Model In Forecasting Appeals, Paul A. Rake
Using A Prediction Model In Forecasting Appeals, Paul A. Rake
IUSTITIA
Following the 1972 reorganization of the Indiana Court of Appeals into three panels serving defined geographical districts, the Court soon found itself floundering with too many unevenly distributed cases. Lacking a sufficient base of statistical data from which to formulate a plan to cope with the problem, various proposals, including redistricting the court, adding more judges, and developing a more sophisticated staff research, could not be measured for effectiveness or advisability.
In response to these problems, the Court developed a project to deal with the future caseload by constructing a regression model to predict appeals. This model generated estimates of …

Newly issued Proposed Regulations, under Section 355, follow recent decisions allowing horizontal divisions of a single business. In addition, the proposals introduce factors for determining whether a Section 355 transaction is a device for bailing out earnings" Mr. Lee analyzes these and other changes in the Proposed Regulations.

The Early Legal Career Of Howell Jackson, Terry Calvani
Vanderbilt Law Review
Felix Frankfurter observed in 1937 that "American legal history has done very little to rescue the [United States Supreme] Court from the limbo of impersonality."' Subsequently, numerous individual and collective works have focused on the more prominent figures in the history of that institution.' Unfortunately, there remain many justices of the Supreme Court who have received relatively little scholarly attention. Yet, as one political scientist has recently lamented, "[until] there is a fuller awareness of the inter-play between individual personalities and decision making, it is unlikely there will be 'an adequate history of the Supreme Court."
One such individual is …

United States v. Bronstein, 521 F.2d 459 (2d Cir. 1975), cert. denied, 96 S.Ct. 1121 (1976).
Our society has witnessed, in recent years, the growing menace of drug abuse in the United States. In an effort to curb the distribution and sale of controlled substances such as marijuana, police have resorted to novel means of ferreting out concealed drug caches. The use of specially-trained animals to detect odoriferous drugs among the personal effects of suspicious persons is currently favored by both courts and law enforcement agencies. Recently, in United States v. Bronstein, the United States Court of Appeals for the …

The Health Professions Educational Assistance Act Of 1976: A New Prescription?, John J. Greene
Fordham Urban Law Journal
The 1976 Health Professions Educational Assistance Act is a new congressional effort to promote the rational development, distribution, and utilization of the health professions through financial incentives. The Act represents a compromise solution to the issues affecting the quality, quantity and distribution of health manpower. It targets the four major problems of the current system: (1) the shortage of health professionals; (2) the geographic maldistribution of health manpower; (3) the specialty maldistribution of physicians and dentists; and (4) the influx of foreign medical graduates into the United States. This comment examines the effectiveness of past legislative responses to these issues …

The Federal Judicial District As Community In Obscenity Cases, Carl B. Rubin, Gary Winters
University of Dayton Law Review
Few problems have plagued the courts in the last decade with greater persistence than those associated with obscenity. The concept of obscenity varies from place to place and from time to time, and since it is essentially a subjective concept, it also tends to vary from person to person. The development of a concept of "community standard" recognizes that diverse viewpoints exist and has resulted in the consideration by courts of the concept of obscenity in light of a local standard rather than a national one. It has also incidentally relieved the Supreme Court of the United States from consideration …

Vanderbilt Law Review
The Employee Retirement Income Security Act of 1974'(ERISA) introduced a new era for a broad spectrum of American society. The new Act had a startling impact not only upon pension plan sponsors, participants, and beneficiaries, but also upon the myriad group of individuals and institutions providing services, advice, and counsel to the pension industry. This article primarily will consider the new law as it affects the fiduciary, creating new responsibilities and increased liability. Several areas in which the new law creates special problems then will be considered.
