Insurance, Maximilian A. Pock Dec 1976

Insurance, Maximilian A. Pock

Mercer Law Review

Of the 45 "insurance" cases handed down during the current survey period less than half merit serious scrutiny and comment at this time. Of the remainder, some address themselves solely to procedural issues with "insurance" law providing but a fortuitous backdrop, while others involve only factual disputes raised largely in duels involving the grant or denial of motions and counter motions for summary judgment.

To preserve editorial continuity the cases decided during the current survey period will be discussed in conformance with the general outline and subject matter headings used in past years. Where certiorari to the supreme court has …

Alien Checkpoints And The Troublesome Tetralogy: United States V. Martinez-Fuerte, Victor Salerno Dec 1976

Alien Checkpoints And The Troublesome Tetralogy: United States V. Martinez-Fuerte, Victor Salerno

San Diego Law Review

The thesis of this Comment is that the foregoing contention cannot withstand careful examination. The Government's need to conduct routine checkpoint operations is no greater than its need to conduct roving patrol operations. With the former, the intrusion on fourth amendment rights is as onerous, and the overall burden on lawful traffic is more considerable. In addition, the Court made several questionable factual assumptions and altered the traditional allocation of the burden of proof with respect to warrantless law enforcement conduct. This Comment will summarize the factual context of the case, examine the Ninth Circuit's holding, which the Supreme Court …

Reapportionment : An Oregon History And A Critique Of Baker Vs Carr, Ann Frissell Lackey Jul 1976

Reapportionment : An Oregon History And A Critique Of Baker Vs Carr, Ann Frissell Lackey

Dissertations and Theses

This study explores the ways in which federal and state authorities have sought to deal with a difficult problem of political power in the context of the U.S. Constitution. Oregon reapportionment history offers an appropriate introduction to a critique of the national reapportionment decisions of Baker vs Carr and Reynolds vs Sims. Its Constitution stipulated population and the ratio derived from a population based formula were the means by which apportionment was to be determined and noncompliance had been particularly evident from 1933 to 1952. Also, by the initiative process and a decision by the Oregon Supreme Court, Oregon had …

The Automobile Exception: What It Is And What It Is Not -- A Rationale In Search Of A Clearer Label, Charles E. Moylan Jr. Jul 1976

The Automobile Exception: What It Is And What It Is Not -- A Rationale In Search Of A Clearer Label, Charles E. Moylan Jr.

Mercer Law Review

The so-called "automobile exception" to the warrant requirement of the fourth amendment would pose few conceptual difficulties but for the simplistic assumption on the part of many lawyers and judges that the "automobile exception" has something to do with automobiles. It is the burden of this article to establish that that is not necessarily so. There are many legitimate warrantless searches of automobiles that do not remotely involve the "automobile exception." Conversely, there are some legitimate warrantless searches of non-automobiles that do. Our only real problem is that of coming to grips with the word "automobile."

"Automobile" means one thing …

Provincial International Status Revisited, Thomas A. Levy May 1976

Provincial International Status Revisited, Thomas A. Levy

Dalhousie Law Journal

The question as to whether the Canadian provinces possess international status caused much ink to flow in Canadian legal discourse from 1965 to 19681. Although the practical problems incident to an alleged provincial international personality remain with us in the mid 1970's, the lawyers have maintained a low profile from 1968 to 1971. In 1971 Anne-Marie Jacomy-Millette's doctoral dissertation was published as L'introduction et l'application des trait~s internationaux au Canada.2 In 1973 Ivan Bernier's magisterial doctoral thesis was published under the title International Legal Aspects of Federalism.3 Although no new ground was broken, Professor Bernier stated the existing comparative and …

Residential Mortgage Lending: Charting A Course Through The Regulatory Maze, William F. Earthman May 1976

Residential Mortgage Lending: Charting A Course Through The Regulatory Maze, William F. Earthman

Vanderbilt Law Review

One specific issue addressed by this symposium is the practice of "redlining." If what is meant by "redlining" is discrimination in residential mortgage lending, I am certainly opposed to such a practice. If, however, what is meant by "redlining" is the consideration and analysis of the effect of the surrounding neighborhood on the property which secures a particular residential mortgage loan, then there are other problems which must be addressed and focused upon. It has been stated that a lender redlines a specific geographic area located within the larger geographic area normally serviced by that lender when the lender refuses …

Interstate Corporate Income Taxation-Recent Revolutions And A Modern Response, Eugene F. Corrigan Mar 1976

Interstate Corporate Income Taxation-Recent Revolutions And A Modern Response, Eugene F. Corrigan

Vanderbilt Law Review

In recent years significant technical advances have enabled large corporations to sell into states from great distances and with a minimum of contact in those states. Nevertheless, the states and their political subdivisions are confronted with the claims of corporations that jurisdictional barriers to corporate income taxes should be raised, that improved enforcement techniques should be prohibited, and that certain classes of income should be immunized completely from state taxation. These revolutionary technical advances have created both major tax administration problems and tax administration opportunities for the states. Some of the latter, however, remain unexploited. This article examines the ramifications …
