In Pursuit Of Excellence -- A History Of The University Of Minnesota Law School, Part I: The Pattee Years -- A Time Of Accommodation, Robert Stein

Articles

In September 1888, William S. Pattee, the newly elected dean of the University of Minnesota's infant law department,' began, with the help of lecturers from the practicing bars of Minneapolis and St. Paul, to educate some 67 '"young gentlemen of zeal and promise' 2 in the law. Ninety years later, the University of Minnesota Law School continues this mission, with 62 full-or part-time faculty members, for the benefit of about 750 students. During this period, the school has been shaped by the administrations of six deans, has conferred over 7,500 J.D. or LL.B. degrees,3 has affected the lives of many …

Obtaining Jurisdiction Over Corporations In Virginia, Robert E. Draim, Emily M. Trapnell

University of Richmond Law Review

A working familiarity with the jurisdictional principles and procedures involved in initiating legal proceedings against both domestic and foreign corporations is essential to the successful resolution of the issues involved in such corporate litigation. The important individual and societal interests involved in corporate litigation highlight the necessity of bringing the corporate defendant within the jurisdiction of the state's courts.

United States Interests In A Convention On The Law Of The Sea: The Case For Continued Efforts, Jonathan I. Charney Jan 1978

United States Interests In A Convention On The Law Of The Sea: The Case For Continued Efforts, Jonathan I. Charney

Vanderbilt Journal of Transnational Law

Over 150 nations have been engaged in the negotiation of a multilateral Convention on the Law of the Sea at the Third United Nations Conference on the Law of the Sea for more than five years. The negotiations have included virtually every possible issue involving relations between nations with respect to the oceans, such as fishing, national jurisdiction, navigation, environment, scientific research, seabed exploitation, and transfer of technology.' The current product of that negotiation is the Informal Composite Negotiating Text (ICNT), a 198-page document containing 303 treaty articles plus seven annexes. Although the participating nations agree on much of the …

A Unified Theory Of Indian Tribal Sovereignty, Earl Mettler

UC Law Journal

The author examines the three areas of law, tribal power, state jurisdiction, and equal protection, in which Indian tribal sovereignty is an operative principle. The proper role of sovereignty in each area is derived, and a cohesive theory of tribal sovereignty is postulated, with a view to defining the proper scope of state and local action relating to Indian affairs.

Legal And Diplomatic Developments In The Northwest Atlantic Fisheries, Douglas M. Johnston Oct 1977

Legal And Diplomatic Developments In The Northwest Atlantic Fisheries, Douglas M. Johnston

Dalhousie Law Journal

Within the astonishingly brief timespan of five or six years, a fundamental change has been wrought in the international law of fisheries. Even to those only fleetingly familiar with current developments in the law of the sea, it is apparent that the establishment of 200-mile fishing zones in many parts of the world must signify a major legal change in the world of fishing. Indeed many of us have already become sufficiently accustomed to the new order that it may be useful to remind ourselves of the old order which has now yielded place to it. The classical approach to …

Multilingualism And The Cbc Mandate: An Example Of Ineffectual Regulation, William Charland Oct 1977

Multilingualism And The Cbc Mandate: An Example Of Ineffectual Regulation, William Charland

Dalhousie Law Journal

The control of broadcasting, more than any other field subjected to regulation, demands, by its very nature, political neutrality. Given that control is deemed necessary,1 almost total delegation of that control must be made to an independent tribunal in order to avoid charges of political interference with the freedoms of speech and expression. The presence of the CBC as apublic corporation, however, raises questions as to the source and substance of the CBC mandate. What body is responsible for creating the goals or objects of this corporation? Who bears the responsibility initially to interpret and shape programming to meet these …

Civil Rights, Alfred L. Evans Jr. Jul 1977

Civil Rights, Alfred L. Evans Jr.

Mercer Law Review

During the course of 1976, the U.S. Court of Appeals for the Fifth Circuit rendered approximately 125 opinions in cases dealing with the myriad ways in which the Constitution of the United States affects the civil relationships between citizens and their government and between each other. In view of the impossibility of going beyond a rather pointless two or three sentences per case, should it be attempted to cover all or even the bulk of these cases, I have once again selected but a few of those areas in which the Court has acted for a somewhat more detailed analysis.

Radiation From Nuclear Power Plants: The Need For Congressional Directives, Michael S. Baram Jun 1977

Radiation From Nuclear Power Plants: The Need For Congressional Directives, Michael S. Baram

Faculty Scholarship

Congress often responds to a complex problem by empowering an independent regulatory agency to enforce its legislative will. Acknowledging its own lack of knowledge and time, Congress gives the agency a measure of freedom to modify the legal requirements to fit a variety of circumstances that the legislature could not foresee. Ordinarily Congress restrains this autonomy by prescribing general criteria that the agency must consider and objectives that must be met.' These provisions enable Congress to measure the agency's progress and make necessary changes in the law. In addition, competition from other bureaus forces the agency to act vigorously or …

Emerging Law Of The Sea: The Economic Zone Dilemma, Thomas A. Clingan Jr. May 1977

Emerging Law Of The Sea: The Economic Zone Dilemma, Thomas A. Clingan Jr.

San Diego Law Review

The concept of the economic zone has its roots in some rather familiar doctrinal soil. Like many other theories of the past, it attempts to accommodate the desires of coastal States to achieve increased competence over adjacent seas for resource management (and other purposes) with the needs of States wishing to keep the seas open for maximum flexible use. This Article will examine the familiar efforts of the past and evaluate the progress of the economic-zone concept in the current law of the sea negotiations.

Secured Lending, Ken L. Lott, Robert G. Myers

The following topic will be discussed at some length: loans secured by inventory, accounts receivable, and stocks, bonds and similar collateral. Loans secured by cash value of life insurance, petroleum, ship mortgages and aircraft will be discussed briefly.

The New International Economic Order And The Law Of The Sea, Elizabeth Mann Borgese May 1977

The New International Economic Order And The Law Of The Sea, Elizabeth Mann Borgese

San Diego Law Review

The interrelationship between the development of the New International Economic Order (NIEO) and the new law of the sea oceans play an important and rapidly expanding role in the economic life of nations, it is impossible to build an NIEO without including the oceans. The principles developed by the Sixth and Seventh Special Sessions of the General Assembly and the Charter of Economic Rights and Duties of States must be applied to States and to the international community in their activities both in the seas and on land, or no NIEO can come into existence.

Kiev And The Montreux Convention: The Aircraft Carrier That Became A Cruiser To Squeeze Through The Turkish Straits, F. David Froman May 1977

Kiev And The Montreux Convention: The Aircraft Carrier That Became A Cruiser To Squeeze Through The Turkish Straits, F. David Froman

San Diego Law Review

On July 18, 1976, the 40,000-ton Soviet naval vessel Kiev, sporting a 600-foot flight deck and a complement of helicopters and fixed-wing aircraft, steamed into the Mediterranean after completing its transit of the Turkish Straits. The Montreux Convention, which governs transit of the Turkish Straits, limits the aggregate tonnage of all foreign naval forces in transit through the Straits to 15,000 tons. Only in the case of capital ships does it allow Black Sea powers to exceed this limit. Although the Convention's definition of capital ships includes cruisers, it specifically excludes aircraft carriers. Nevertheless, Instanbul's military port authorities accepted the …
