Defending Battered Women's Self-Defense Claims, Kit Kinports Jan 1988

Defending Battered Women's Self-Defense Claims, Kit Kinports

Faculty Scholarship

This Article contends that many battered women who kill their abusive spouses can legitimately raise the standard self-defense claim. No substantial extension of self-defense doctrine is required to justify the acquittal of battered women on self-defense grounds. Furthermore, no special "battered women defense" is necessary or even desirable in such cases.

Part I of this Article summarizes the results of psychological research studying abused women and battering relationships. It further explains the concept of the :battered woman syndrome" which describes the effects of sustained physical and psychological abuse by one's husband. Part II discusses the requirements of a successful self-defense …

Some Modest Proposals On The Vice-Presidency, Richard D. Friedman Jan 1988

Some Modest Proposals On The Vice-Presidency, Richard D. Friedman

Articles

There are many good things in the Constitution, but the vice-presidency isn't one of them. In Part I of this essay, I will argue that there are three basic problems with the vice-presidency: the method of nomination, the method of election, and the office itself. That just about covers the waterfront.' If we had to do it all over again, we almost certainly would not" create the system we currently have. We cannot undo history, but we do have a very strong incentive to develop a better system of succession to the presidency. Whom we choose as vice-president is a …

American Export Controls And Extraterritoriality, Isabelle Clement Jan 1988

American Export Controls And Extraterritoriality, Isabelle Clement

LLM Theses and Essays

This thesis examines the American extraterritorial approach to controlling the movement of strategic goods abroad on the basis of some connections with the United States. It considers the possible use of existing blocking legislation or principles in other countries to counteract the American use of the extraterritorial approach. Certain conclusions are then drawn about likely future developments.

Delimitation Of The Continental Shelf In The Aegean Sea, Aurelia A. Georgopoulos Jan 1988

Delimitation Of The Continental Shelf In The Aegean Sea, Aurelia A. Georgopoulos

Fordham International Law Journal

This note argues that the continental shelf between Greece and Turkey should be delimited under general principles of international law. Part I discusses the present dispute and its historical underpinnings. Part II examines the relevant treaty and customary international law applicable to continental shelf delimitations. Part III analyzes the positions of the parties and proposes a solution under principles of customary international law. This Note concludes that the continental shelf should be delimited by drawing a median line between the two states giving half effect to Eastern Islands and then adjusting the line to avoid enclaving them.

U.S.-Canadian Relations Regarding Diversions From An International Basin: An Analysis Of Article Ii Of The Boundary Waters Treaty, Tim A. Kalavrouziotis Jan 1988

U.S.-Canadian Relations Regarding Diversions From An International Basin: An Analysis Of Article Ii Of The Boundary Waters Treaty, Tim A. Kalavrouziotis

Fordham International Law Journal

This Note argues that article II of the Boundary Waters Treaty, when applied, has failed to resolve international water disputes between the United States and Canada. Part I of this Note examines the history of the negotiations and the text of the Treaty. Part II reviews the subsequent application of article II to international water disputes. Part III analyzes recent U.S. proposals to divert water from Lake Michigan to drought-stricken areas in the context of the Treaty and customary international water law. This Note concludes that article II of the Boundary Waters Treaty is inadequate to resolve water disputes between …

Exploring The Foreign Country Exception: Federal Tort Claims In Antarctica, David J. Bederman Jan 1988

Exploring The Foreign Country Exception: Federal Tort Claims In Antarctica, David J. Bederman

Vanderbilt Journal of Transnational Law

On November 28, 1979, an Air New Zealand DC-10 aircraft carrying tourists bound for an expedition to Antarctica crashed into the side of Mount Erebus, the highest peak on the frozen continent. All aboard perished. Four years later, the families of some of the New Zealander skilled in the accident brought suit against the United States Government under the Federal Tort Claims Act (FTCA). They claimed that the negligence of the air traffic controllers at the United States scientific base at McMurdo Sound, Antarctica, was the proximate cause of the crash.

This Article considers numerous aspects of this litigation and …

Estimating The Residual Demand Curve Facing A Single Firm, Jonathan Baker, Timothy Bresnahan Jan 1988

Estimating The Residual Demand Curve Facing A Single Firm, Jonathan Baker, Timothy Bresnahan

Scholarly Articles in Law Reviews & Journals

This paper presents an econometric technique for estimating the single firm residual demand curve that does not require the estimation of demand cross-elasticities. The technique is particularly suited for the estimation of firm market power in product differentiated industries, where cross-elasticities are notoriously difficult to measure. One estimated parameter is directly related to a firm's markup of price over marginal cost when product differentiation is extensive, when an industry consists of a dominant firm and a price-taking fringe, when a Consistent Conjectures Equilibrium is the correct oligopoly solution concept, when firms are Stackelberg leaders relative to their environment, or when …
