Jewish Law: Finally, A Useable And Readable Text For The Noninitiate, Sherman L. Cohn Jan 1988

Jewish Law: Finally, A Useable And Readable Text For The Noninitiate, Sherman L. Cohn

Georgetown Law Faculty Publications and Other Works

Why would anyone not studying religion be interested in Jewish law? It will be surprising for some to learn that some twenty to twenty-five law schools now offer courses in Jewish law. The literature in English is growing year after year. And the area is becoming one of serious study for scholars of law as distinguished from scholars of religion. Jewish law as taught in secular law schools is not that of religious ritual. It is the law of contracts, torts, damages, property, secured transactions, civil and criminal procedure, legal ethics, and consumer protection. In other words, it spans the …

Community And Fairness In Democratic Theory, Mark Tushnet Oct 1987

Community And Fairness In Democratic Theory, Mark Tushnet

Florida State University Law Review

This commentary responds to an article by Lea Brilmayer in this edition. Professor Tushnet challenges Professor Brilmayer's assertion regarding democratic theory that the process theory of United States v. Carolene Products is irreconcilable with the interest theory which stems from conflict of law analysis.

Asking The Right Questions, Lawrence C. George Oct 1987

Asking The Right Questions, Lawrence C. George

Florida State University Law Review

Professor George analyzes what he sees as Professor Brilmayer's major thesis: that neither modern choice of law nor equal protection principles provide a sound basis for jurisdictional doctrine. Concluding that she has failed to consider a possible Critical Legal Studies approach to the problems she poses, he suggests one.

The Strange Cases Of Alberta's Guarantees Acknowledgement Act A Study Of Choice-Of-Law Method, Vaughan Black Sep 1987

The Strange Cases Of Alberta's Guarantees Acknowledgement Act A Study Of Choice-Of-Law Method, Vaughan Black

Dalhousie Law Journal

Fifty years ago John Willis wrote Two Approaches to the Conflict of Laws: A Comparative Study of the English Law and the Restatement of the American Law Institute. There he described two different - perhaps even opposed - conceptions of the problem posed by cases involving geographically complex facts. It is a goal of this article to assess the status and the vices and virtues of those two approaches in Canada today. Such a task is not a mere updating of Willis' piece, though that alone might be a useful exercise. In the first place, Willis' analysis takes place largely …

Sin, Scandal, And Substantive Due Process: Personal Jurisdiction And Pennoyer Reconsidered, Wendy Collins Perdue Jul 1987

Sin, Scandal, And Substantive Due Process: Personal Jurisdiction And Pennoyer Reconsidered, Wendy Collins Perdue

Washington Law Review

As part of the attempt to understand modem doctrine, this article first reexamines Pennoyer v. Neff. This reexamination goes beyond the Supreme Court opinion and looks both at the underlying story of the case and the lower court opinion. The story of Pennoyer v. Neff is of considerable interest in and of itself. The cast of characters includes a bigamous United States Senator who was elected under an alias, a governor of Oregon who used his inauguration as a platform to decry his loss in the case, and an illiterate but litigious settler. In addition, the lower court opinion, all …

Scientific Responsibility And The Law, Harold P. Green Jun 1987

Scientific Responsibility And The Law, Harold P. Green

University of Michigan Journal of Law Reform

Because public policy is implicated by scientific misconduct, the legal profession should be interested in overcoming this problem. This Article studies the scientific misconduct problem and provides a personal view of the legal dilemmas that confront those who report misconduct. Part I describes how the scientific community currently deals with alleged fraud. Scientists primarily rely on the peer review system and toothless guidelines. Part II illustrates the problems in the present system through a case study of an allegation of misconduct. The author represented a man who reported scientific misconduct; the National Institutes of Health (NIH) investigation took five and …

The Evolution Of Turkey's Foreign Policy: The Truman Doctrine And Turkey's Entry Into Nato, Sinan Toprak

Masters Theses

This thesis examines the historical development of Turkey's foreign policy up to the period immediately following World War II, and its decision to join the North Atlantic Treaty Organization (NATO).

The study begins with a survey of Turkey's geopolitical importance. The narrative highlights political conditions from the Ottoman period to the years following World War II. Domestic political developments, as well as foreign relations of Turkey in the Republican period, are analyzed.

Oil Spill Liability And Compensation: A Review Of The Existing Mechanisms And A Look At The Future, Gary A. Reiter May 1987

Oil Spill Liability And Compensation: A Review Of The Existing Mechanisms And A Look At The Future, Gary A. Reiter

Marine Affairs Theses and Major Papers

This study provides an examination of the existing United States Federal laws and international regimes regarding oil spill liability and compensation, and the manner in which they have been implemented by regulation and policy. The presentation concludes with discussion of and arguments concerning various proposed Federal comprehensive liability and compensation legislation. Emphasis is placed on the unsuccessful legislative proposals of the 99th Congress and the effects that similar legislation, if passed by the 100th congress, may have on current response policies and Federal and state governments. In particular, the effects of the proposed legislation on state's sovereignty and response operations …

The Law Of The American West: A Critical Bibliography Of The Nonlegal Sources, Charles F. Wilkinson May 1987

The Law Of The American West: A Critical Bibliography Of The Nonlegal Sources, Charles F. Wilkinson

Michigan Law Review

This article is an attempt to collect some of the books, fiction as well as nonfiction, that deal with the true sources of the law of the American West. My effort is only to identify readily available works, not the myriad government documents, diaries, doctoral theses, and out-of-print books that afford invaluable depth on individual topics. Nor is there any pretension to complete coverage. Inevitably, there will be omissions when the sweep is as broad as this article's. But I will omit none of my personal favorites, those many books that have enriched my life and allowed me one of …
