Water Quality Control: Integrating Beneficial Use and Environmental Protection (Summer Conference, June 1-3)
Conference organizers and/or faculty included University of Colorado School of Law professors David H. Getches, Lawrence J. MacDonnell and Charles F. Wilkinson.
Protecting water quality is essential to preserve the many beneficial uses of western water resources. This conference addresses the dominant federal requirements in the Clean Water Act, including the important major revisions enacted by Congress in 1987, with special attention to western problems regarding nonpoint source pollution. Developments in groundwater quality regulation are considered, as are selected issues concerning the implications of state and federal water quality regulation for the traditional exercise of water rights.

The Exclusive Economic Zone Of The Northwestern Hawaiian Islands: When Do Uninhabited Islands Generate An Eez, Jon M. Van Dyke, Joseph Morgan, Jonathan Gurish
San Diego Law Review
Hawaii is the only state in the United Stats that consists solely of islands. These islands are unique among the states in climate and life style, and they present unique problems to those who would define their jurisdiction over the adjacent ocean areas. The eight main inhabited Hawaiian islands are entitled to territorial seas, contiguous zones, exclusive economic zones, and continental shelves, which are measured in the same way that similar zones are delineated outward from continental land territories. To the northwest of these main islands is a chain of smaller insular outcroppings that are a wildlife preserve for sea …

Jack Shaw Bridge, Susie Van Kirk
Susie Van Kirk Papers
To adequately assess the historical significance of the Mad River suspension bridge near Mountain View, commonly referred to as the Jack Shaw Bridge, it was necessary to research not only the bridge but the surrounding area as well. Resulting information provides a context or association for understanding the bridge's role in local history.

International Organizations And The Law Of The Sea: Documentary Yearbook, 1985, L C. Green
International Organizations And The Law Of The Sea: Documentary Yearbook, 1985, L C. Green
Dalhousie Law Journal
It was only to be expected that upon the adoption of the 1982 United Nations Convention on the Law of the Sea, there would be a plethora of publications, academic and otherwise, on various aspects of the law of the sea. What is perhaps not generally known is the number of international organizations that have occasion to issue documents relating to the law of the sea, and, even when it is known, these are in such a variety of places that it is almost impossible for any but the most determined researcher to seek them out. The Netherlands Institute for …

A Guide To Maritime Boundary Delimitation, Ted L. Mcdorman
Dalhousie Law Journal
This is not a book for lawyers. This is not a book written by lawyers. It is a book written by hydrographers for hydrographers. However, because the book deals with maritime boundary delimitation it is a book of interest to an audience far beyond hydrographers, since ocean boundaries concern lawyers, political scientists, economists, sociologists, fishermen, resource-specialists and a wide range of other professionals.

The Legal Chapter In The Jin-Shu, Jutta Brunnée
Dalhousie Law Journal
Relatively little is still known of law and legal thinking in ancient China. This recent book by Robert Heuser sheds some light on this era. The book, published in German, draws upon a chapter of the Jin-Shu dynastic chronicle which surveys the events in the Chinese Empire of the first centuries, A.D.

Constructive Receipt Of Income Baxter V. Commissioner, Adam M. Ekonomon
Constructive Receipt Of Income Baxter V. Commissioner, Adam M. Ekonomon
Akron Tax Journal
In Baxter v. Commissioner, the court decided whether taxpayer Baxter had constructively received $13,095 of commissions he had earned in 1978. Baxter, a cash basis taxpayer, received a check in the mail for these commissions in early 1979. The check was dated December 30, 1978. Treasury Regulation Section 1.451-2(a) controls and provides, in part, that a taxpayer constructively receives income when it is otherwise made available to draw upon at any time, even though it is not reduced to the taxpayer's possession. However, there is no constructive receipt if "taxpayer's control of its receipt is subject to substantial limitations or …

The Choice-Of-Law Process In Product Liability Actions, David E. Seidelson
The Choice-Of-Law Process In Product Liability Actions, David E. Seidelson
Duquesne Law Review
Product liability actions generate a number of choice-of-law problems. Such problems need be no more complex or difficult to resolve than choice-of- law problems in other types of litigation. The court, aided by counsel, should possess the capacity to resolve all such problems in product liability actions. The author creates and then resolves through interest analysis a number of choice-of-law problems likely to arise in product liability actions and, in the process, compares the result thus achieved with the results that would be achieved by application of Professor Weintraub's proposed rule for resolving conflicts problems in product liability actions. The …
