United States V. Johnson: Expansion Of The Feres Doctrine To Include Servicemembers' Ftca Suits Against Civilian Government Employees, Anne R. Riley Jan 1989

United States V. Johnson: Expansion Of The Feres Doctrine To Include Servicemembers' Ftca Suits Against Civilian Government Employees, Anne R. Riley

Vanderbilt Law Review

The United States Government traditionally has enjoyed sovereign immunity from tort liability. In 1946, however, Congress waived this immunity by enacting the Federal Tort Claims Act (FTCA). The FTCA gives federal district courts original jurisdiction over any claims for personal injury or death caused by the negligence of any governmental employee." This broad waiver of immunity, however, is subject to certain exceptions. Although Congress made no explicit exception for noncombat claims of service members, the Supreme Court of the United States in Feres v. United States' construed the FTCA as creating an exception that bars all claims for injuries to …

Japan's East China Sea Ocean Boundaries: What Solutions Can A Confused Legal Environment Provide In A Complex Boundary Dispute?, Kendrick F. Royer Jan 1989

Japan's East China Sea Ocean Boundaries: What Solutions Can A Confused Legal Environment Provide In A Complex Boundary Dispute?, Kendrick F. Royer

Vanderbilt Journal of Transnational Law

This Note addresses the ocean boundary delimitation conflict between Japan, China, Taiwan, and South Korea in the East China Sea. The author considers international law on boundary delimitation and concludes that the law is unclear on delimitations between states within four hundred nautical miles of one another. The International Court of Justice has held that equity is the norm to be applied to boundary delimitation disputes but it has not resolved the competition between the natural prolongation theory of delimitation and a theory based upon the Exclusive Economic Zone. The geology of the East China Sea brings this issue to …

British Environmental Law: Major Strands And Characteristics, Richard Macrory Jan 1989

British Environmental Law: Major Strands And Characteristics, Richard Macrory

Connecticut Journal of International Law

Law concerning the environment existed in the United Kingdom, which was one of the first countries to experience extensive and rapid industrial and urban development, long before the term "environmental" came into wide usage. A number of features, notably a high degree of discretion, a preference for local administration and a concern for practicality joined at times with a degree of parochialism, have long permeated much of the substantive law on the environment. Many of these characteristics are reflected in the description of the major strands of current law and administrative arrangements.' Although these traits frequently appear to give a …

Politics Across Borders: Nonintervention And Nonforcible Influence Over Domestic Affairs, Lori Fisler Damrosch Jan 1989

Politics Across Borders: Nonintervention And Nonforcible Influence Over Domestic Affairs, Lori Fisler Damrosch

Faculty Scholarship

It is time for a fresh look at the norm of nonintervention in domestic affairs, as applied to nonforcible efforts to influence another state's internal politics. The existence of such a norm is widely proclaimed, and it is commonly assumed to be a legal obligation rather than a mere practice of comity or aspirational objective. For governments, scholars and international organs alike, the "rule" against interference in internal politics seems to be an article of faith; but despite the frequency of its incantation in international discourse, how the norm applies to nonforcible conduct is inadequately understood.

This article considers the …

Reopening The Fair Gate, Toshihiro Tanioka Oct 1988

Reopening The Fair Gate, Toshihiro Tanioka

History Theses & Dissertations

On July 27, 1952, the Congress of the United States of America passed, over President Harry s. Truman's veto, the Immigration and Nationality Act of 1952, more commonly known as the McCarran-Walter Act. The act codified almost all existing laws relative to immigration and naturalization and newly incorporated more strict exclusion provisions.

This paper analyzes the legislative process from the passage of the act in 1952 to its major revision in 1965. The paper analyzes that the act was a mere reaffirmation of the pre-war immigration policy and thus not reappraisal or reformation in the drastically changed world milieu. The …
