Solomon's Sword: Adjudication Of Child Custody Questions, Robert E. Shepherd Jr.
University of Richmond Law Review
It is significant that this story from the reign of King Solomon in the tenth century B.C. uses as its setting a battle over child custody to illustrate the legendary "wisdom of Solomon."' It is equally meaningful that after the passage of some three thousand years of civilization and supposed social progress, a twentieth century Amer- ican judge could remark that "a judge agonizes more about reaching the right result in a contested custody issue than about any other type decision he renders." And this agony intrudes into an ever-increasing number of cases.
Animal Cruelty Laws: The Case For Reform, Charles E. Friend
Animal Cruelty Laws: The Case For Reform, Charles E. Friend
University of Richmond Law Review
If, as Justice Arnold suggests in the foregoing quotation, our animal protection laws are indicative of the level to which "the justice and benevolence of men" has risen, then truly the human race is in sad shape. An examination of the history of the subject clearly reveals that man's inhumanity to man is exceeded only by man's inhumanity to animals. The popular image of animal existence fostered by innumerable Walt Disney movies and a plethora of children's books is so far removed from reality that it borders on the fraudulent. The fact is that neglect, torture and destruction of helpless …

French Nuclear Testing And Article 41--Another Blow To The Authority Of The Court?, Jerome B. Elkind
Vanderbilt Journal of Transnational Law
On the 23rd of July 1973, at 9:00 a.m. New Zealand time, members of the crew of the New Zealand vessel, Otago, witnessed a nuclear explosion on one of the islands in the Mururoa atoll. The blast, a small one in the low kiloton range, marked the beginning of the eighth series of French atmospheric nuclear tests, which have been conducted in the Pacific since July 1966 when France moved its nuclear test site from the Reggane Firing Ground in the Sahara. Since that time the French nuclear tests have been a perennial sore spot in the diplomatic relations between …
Legal And Institutional Barriers To United States--Soviet Trade: Soviet Perspective, Christopher Osakwe
Legal And Institutional Barriers To United States--Soviet Trade: Soviet Perspective, Christopher Osakwe
Vanderbilt Journal of Transnational Law
Traditionally, law, economics, and politics have always been interrelated elements. Within this interaction economics and politics have often alternated as the leading determinant of future development, whereas law has acted as an appendage of both or, at least, as a catalyst for future political and economic changes in the given society. This analysis of the close interaction between law, economics, and politics applies not only domestically but also internationally. If foreign policy is nothing but a continuation of domestic policy by other means, it follows that the foreign policy of a particular nation is shaped by a variety of factors …

Constitutional Revision: Virginia And The Nation, A.E. Dick Howard
University of Richmond Law Review
For about a quarter of a century-from the 1920's into the 1940's-no American state adopted a new constitution. By midcentury, however, interest in revising these fundamental laws had burgeoned. So widespread was the movement for constitutional revision that by 1970 a leading student of the subject commented that there was at that time "more official effort directed toward revising and rewriting state constitutions than at any time in the nation's history with the possible exception of the Civil War and Reconstruction era."

The Court, The Legislature, And Governmental Tort Liability In Michigan, Luke K. Cooperrider
Michigan Law Review
In 1961, when Justice Edwards of the Michigan supreme court said, "From this date forward the judicial doctrine of governmental immunity from ordinary torts no longer exists in Michigan," he went on to say that he was eliminating from the law of Michigan "an ancient rule inherited from the days of absolute monarchy," a "whim of long-dead kings." Justice Carr, dissenting, agreed that the doctrine in question "came to us as a part of the common law," for which reason he thought it was protected by the reception clause of the Constitution of 1850 from the overruling action of the …

Three Reviews Of R. M. Burns (Ed.), One Country Or Two?, L. C. Green
Dalhousie Law Journal
One Country or Two is an excellent book on the most critical subject faced by Canadians. It discusses Canada's nationhood and the issues of its survival as a political marriage of two peoples and two cultures. Ten main essays are edited by R. M. Burns, introduced by Principal John Deutsch, and provided with a reflective postscript by one of the essayists, Richard Simeon, who reviews some features of Quebec society in the light of the October crisis of 1970. All contributors are English-speaking Canadians and all except three are on the faculty of Queen's University. The essays are not uniform …
