When Smoke Gets In Your Eyes: Proposed Ratification By The United States Of The Geneva Protocol On Chemical-Biological Warfare, Linda C. Fentiman
When Smoke Gets In Your Eyes: Proposed Ratification By The United States Of The Geneva Protocol On Chemical-Biological Warfare, Linda C. Fentiman
Elisabeth Haub School of Law Faculty Publications
In light of the Japanese proposal, the current disarmament talks, the Administration's review of the United States' chemical warfare policy, the Defense Department's request for appropriations for production of binary weapons, and the as yet unratified Convention on Bacteriological Weapons and Toxins, it seems more important than ever for the Senate to give its advice and consent to the ratification of the Geneva Protocol. Since the dispute between the Administration and the Senate Foreign Relations Committee is over the interpretation of the scope of the Protocol's chemical warfare prohibition, it seems particularly appropriate at this time to determine whether or …

Teacher Collective Bargaining
Fordham Urban Law Journal
This comment discusses the effect of collective bargaining by teachers on the formulation of public policy in education. Teachers usually draw on the expertise of superintendents of schools to advise them on this subject. Agreement terms from New York and California are analyzed. The focus of the analysis deals with the content of the contract and agreement clauses and the extent to which they reflect a shift of control over educational policy in specific subject areas. The emergence of teachers associations and unions has created a new pressure group potentially capable of influencing traditional state prerogatives in educational policy. California …
The Constitutional Framework Of Environmental Law, Philip Soper
The Constitutional Framework Of Environmental Law, Philip Soper
Book Chapters
For federal and state legislators .seeking legal solutions to environmental problems, "constitutional law" is a part of "environmental law" only in the indirect sense of providing the basic legal framework with which substantive environmental standards-like all legislative standards-must ultimately comport. When Congress, for example, enacts legislation to control pollution or to protect endangered species, the constitutional issue theoretically presented is whether such legislation exceeds limits placed by the Framers on federal legislative authority. These limits may result either from the lack of federal power to deal with the problem or from conflict between a federal regulatory scheme and the constitutional …
The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan
The Legal And Social Implications Of Psychopharmacology, Thomas P. Dugan
Hofstra Law Review
One out of every four adults in the United States has taken a psychotropic agent in the last year; one out of every two has taken a psychotrope at some time in his life. Since their introduction in the 1950s, the new psychotherapeutic drugs have attained a position of importance in the armamentarium of the physician. Whether the increase in the use of these drugs is the result of "turbulent times," of promotional efforts, or "of sloppy prescribing practices of clinicians is uncertain." There is, however, reason to believe that psychopharmacology will hold a unique position within drug liability in …

On The Voluntary Admission Of Minors, Louis Lessem
On The Voluntary Admission Of Minors, Louis Lessem
University of Michigan Journal of Law Reform
The past several years have been witness to dramatic changes in both the theory and practice of civil commitment. In the law, this development has taken the form of increased concern for the protection of the personal liberties of the mentally ill while among members of the medical profession it has been experienced as a part of the process of opening up the back wards. Legislatures in many states have responded by revising their mental health statutes to establish more rigorous standards for commitment, periodic review of the status of committed patients, and better procedural safeguards throughout the commitment process. …
Governmental Control Of Research In Positive Eugencis, I. Scott Bass
Governmental Control Of Research In Positive Eugencis, I. Scott Bass
University of Michigan Journal of Law Reform
This article examines the potential societal problems that would accompany the implementation of eugenics programs and considers possible mechanisms for dealing with these problems. Governmental control of research in positive eugenics is identified as a practical means of preempting the undesirable consequences of scientific advances. Since proposed government research controls would infringe upon academic freedom of inquiry, the constitutional issues raised by this clash are framed and analyzed.
