Affixing The Service Mark: Reconsidering The Rise Of An Oxymoron, Peter J. Karol

This article explores the deep and to date unacknowledged contradictions underlying service marks (trademarks used in connection with services rather than goods). Namely, the Lanham Act statutorily mandates treating trademarks the “same” as service marks; yet it simultaneously loosens requirements for proving service mark “use” by allowing mere advertising to substantiate service mark rights. This shortcut is not permitted with trademarks as such. As a result of this imbalance, sophisticated trademark practitioners may now quickly secure vast service mark rights for clients in ways not available for trademarks.

Caregiver anecdotes attest that music and photographs play an important role for family members diagnosed with Alzheimer’s disease (AD), even those with severe AD. Tablets and iPads, which are prevalent, can be utilized with dementia patients in portraying favorite music and family photographs via apps developed in close partnership with geriatric facilities. This study addresses cognitive functioning and quality of life for people diagnosed with dementia via technology. Research has shown that technology instruments such as iPods, help stimulate those with dementia. The objective of this cross-sectional study was to describe the housing, feeding management, and characteristics (parity and stage of lactation) of cows on commercial automatic milking system (AMS) dairies and their associations with the standing and lying behavior patterns and milking activity (frequency and yield) of lactating dairy cows. Thirteen AMS herds were enrolled in the study, with an average herd size of 71 ± 30 (mean ± SD; range: 34 to 131) lactating cows. All of the herds used freestall barns, each set up for free cow traffic to the AMS. On-farm measurements were taken to determine stocking density …

Communicating Product Sustainability: Consumer Responses To Sustainability Labeling In A Retail Laboratory Environment, Siqi Feng

Inquiry: The University of Arkansas Undergraduate Research Journal

In effort to enhance sustainable development, manufacturers and retailers have collaborated to develop a standardized sustainability index based on supply chain life cycle information. However, it is unclear whether this index will help consumers make more sustainable purchases. Research conducted in a retail laboratory addresses consumer attitudes, purchase intentions, and product choices with and without a credible standardized sustainability index, and with or without provision of background sustainability information. Results from a pilot study and two mixed design experiments indicate that, on average, consumers focus more on brand equity than on sustainability levels when they make brand choices. While the …

With an increasing using of online booking, hotel room rate changing information becomes nearly transparent to consumers. Accounting For Product Substitution In The Analysis Of Food Taxes Targeting Obesity, Zhen Miao, John C. Beghin, Helen H. Jensen

We extend the existing literature on food taxes targeting obesity. We systematically incorporate the implicit substitution between added sugars and solid fats into a comprehensive food demand system and evaluate the effect of taxes on sugars and fats. The approach conditions how food and obesity taxes affect total calorie intake. The proposed methodology accounts for the ability of consumers to substitute leaner low-fat and low-sugar items for rich food items within the same food group. This substitution is integrated into a calibrated demand system in addition to the substitution among food groups, using recent food intake data and existing demand …

To Think Or Not To Think?: A New Perspective On Optimal Consumer Decision Making, Jonathan Hasford

Theses and Dissertations--Marketing and Supply Chain

This research introduces a new theoretical perspective (termed the Adaptive Processing Perspective) that reexamines how consumers should think before making decisions and the optimal outcomes that result. New insights into conscious (“careful deliberation”), unconscious (“sleeping on it”), and intuitive (“going with your gut”) thought processes are provided. Across four studies, empirical evidence demonstrates that consumers can make significantly better decisions by thinking more about routine choices, using their intuition for occasional purchase decisions, and distracting themselves before making major purchase decisions. Specifically, in study 1, increased conscious thought optimized routine decision making due to increases in openness to information. In …

The Salvation Army Kroc Center, a 12.4-acre family support, education, recreation, and cultural arts center located in the Rolando neighborhood of San Diego, is interested in designing an intervention program to alleviate the issue of low levels of physical activity and combat the childhood obesity problem. The Kroc Center is well suited to designing such an intervention because it works closely with six partner elementary schools in its surrounding neighborhoods. Research evidence indicates that obesity has spread through social networks, but lever points for interventions based on overlapping networks are not well studied. We report results from two surveys of representative samples of Americans with private health insur-ance. The first examines how well Americans understand, and believe they understand, traditional healthinsurance coverage. The second examines whether those insured under a simplified all-copay insuranceplan will be more likely to engage in cost-reducing behaviors relative to those insured under a traditionalplan with deductibles and coinsurance, and measures consumer preferences between the two plans. Thesurveys provide strong evidence that consumers do not understand traditional plans and would betterunderstand a simplified plan, but weaker evidence that a simplified plan would have strong appeal toconsumers or change their …

Brett Beach and Tim McCollum, co-founders of Madécasse, spent two years as Peace Corps volunteers in Madagascar. During that time, they fell in love with the country and its people. Recognizing the need of the Malagasy for stable jobs and fair wages and the connection between poverty and environmental destruction, Brett and Tim discussed possibilities for a social enterprise in the country.
