Prosecutors wield the power of the criminal justice system (Medwed, 2014) and the ability to deprive a person of their constitutional rights (Imbler v. Pachtman, 1976). With such power, it is unsurprising that a leading cause of miscarriages of justice is prosecutorial misconduct (e.g., Joy, 2006; Ridolfi & Possley, 2010). New York State became the first state in the country to respond to this issue with a specialized Commission on Prosecutorial Conduct (CPC). While holding almost half of all civilian-owned guns around the globe and yet only 4.4 percent of the world’s population, the United States of America is heavily centered around gun rights due to the 2nd amendment in the U.S. Constitution. Residence restrictions are one of the most recent, and most controversial, public policies seeking to protect community members from registered sex offenders (RSOs) reentering society following incarceration. Residence restriction policies prohibit RSOs from living within a given distance of certain places where children might gather (e.g., schools, daycares, parks, and playgrounds). In doing so, the expectation is that RSOs will have a harder time finding and approaching young children whom they can sexually assault, thus driving sexual recidivism rates down.
