Is Executive Function The Universal Acid?, Stephen J. Morse

This essay responds to Hirstein, Sifferd and Fagan’s book, Responsible Brains (MIT Press, 2018), which claims that executive function is the guiding mechanism that supports both responsible agency and the necessity for some excuses. In contrast, I suggest that executive function is not the universal acid and the neuroscience at present contributes almost nothing to the necessary psychological level of explanation and analysis. To the extent neuroscience can be useful, it is virtually entirely dependent on well-validated psychology to correlate with the neuroscientific variables under investigation. The justice system in the United States has long recognized that juvenile offenders are not the same as adults, and has tried to incorporate those differences into law and policy. But only in recent decades have behavioral scientists and neuroscientists, along with policymakers, looked rigorously at developmental differences, seeking answers to two overarching questions: Are young offenders, purely by virtue of their immaturity, different from older individuals who commit crimes? And, if they are, how should justice policy take this into account?

Exposure to traumatic and stressful events has become increasingly commonplace and the impact of such experiences has been well documented. Trauma events in childhood have been associated with a number of factors, including maladaptive emotional and behavioral responses, increased vulnerability for exposure to additional traumatic events, and adverse experiences later in life. Juvenile justice youth have been found to have higher rates of trauma exposure, when compared to community samples of same-aged peers. In the United States, juvenile offenders are often excluded from the jurisdiction of the juvenile court on the basis of age and crime type alone. Data from national surveys and data from psycholegal research on support for adult sanction of juvenile offenders are often at odds. The ways in which questions are asked and the level of detail provided to respondents and research participants may influence expressed opinions. Respondents may also be more likely to agree with harsh sanctions when they have fewer offender- and case-specific details to consider. Coping responses develop throughout the lifespan of an individual. Unfortunately for some, difficult life circumstances may lead to the use of maladaptive forms of coping. This study investigated coping responses amongst male incarcerated juvenile offenders and examined which specific mental health symptoms may occur with specific coping responses. The goal of this study was to determine whether male incarcerated juvenile offenders utilize avoidant coping responses over approach coping responses. Also, this study investigated whether specific mental health symptoms, such as depression, anxiety, anger, and disruptive behaviors, were more prevalent amongst those who utilize avoidant coping responses. Scholars and policy makers have long been troubled by the potential for some youth to receive disparate sanctioning as a function of extralegal factors, especially against the backdrop of ethnic/racial minority group overrepresentation in the juvenile justice system as a whole. Beginning in the late 1990s, many states began to adopt a graduated sanctions model in response to the emerging ‘get tough’ zeitgeist of the day. Originally intended by the federal government to reinforce juvenile accountability and to ensure equitable treatment of all youth in custody, some stakeholders began to note concerns about uneven outcomes in the use of graduated …
