As the myriad of complex circumstances surrounding incarceration and foster care debilitate the parent-child relationship, the likelihood of legal severance between an incarcerated parent and their child increases. Despite the nation’s mounting prison population over the last three decades, the growing interaction between the prison and foster care populations has received minimal attention in the literature. To date, the influence of the statutory grounds for involuntary termination of parental rights on the legal severance between incarcerated parents and their children has been largely ignored. Officer-involved domestic violence is a problem that should concern researchers, policymakers, the policing community, and the general public. Yet there is very little research in the area and no official data is available to discern the nature and prevalence of domestic violence in police families. Victims are reluctant to report officer-involved domestic violence and often feel helpless in the criminal justice system where the abuser is employed. This is complicated by provisions of the Lautenberg Amendment of 1996 which prohibit anyone convicted of a crime of domestic violence from carrying a firearm. This contribution to a symposium on the morality of preventive restriction on liberty begins by describing the positive law of preventive detention, which I term "desert/disease jurisprudence." Then it provides a brief excursus about risk prediction (estimation), which is at the heart of all preventive detention practices. Part IV considers whether proposed expansions of desert jurisprudence are consistent with retributive theories of justice, which ground desert jurisprudence. I conclude that this is a circle that cannot be squared. The purpose of this study is to better understand the attitudes towards wrongful convictions and levels of punitiveness among college students who may work in the criminal justice field in the future. It attempts to replicate Robert Ramsey and James Frank's 2007 study "Wrongful Conviction - Perceptions of Criminal Justice Professionals Regarding the Frequency of Wrongful Conviction and the Extent of System Errors." Assassins are often regarded as ahistorical figures of evil. In this article, I contest this view by analyzing the assassination of President William McKinley by Leon Czolgosz in 1901. There are two purposes to this article. The first is to situate McKinley’s assassination within the history and development of the social sciences, principally sociology, rather than assume that the assassin is a trans-historical representation of willful irresponsibility. The second is to describe and critique the discourse that made Czolgosz into a rational agent once he entered history as an assassin.

Siting of drug and alcohol treatment facilities is often met with negative reactions because of the assumption that these facilities increase crime by attracting drug users (and possibly dealers) to an area. This assumption, however, rests on weak empirical footings that have not been subjected to strong empirical analyses. Using census block groups from Philadelphia, PA, it was found that the criminogenic impact of treatment facilities in and near a neighborhood on its violent and property crime rates may be contingent on the socioeconomic status (SES) of the neighborhood. This study examines the shift of Attorney General Guidelines in the wake of September 11th, 2001, and the consequences for both federal law enforcement and federal prosecutors. Previous research has found that prosecutors are more apt to use an exceptional vagueness approach and try terrorists like traditional offenders. Likewise, terrorist are more likely to act like traditional offenders and plead guilty in the post-9/11 era. This study further supports the existing knowledge by providing evidence of increased plea bargain rates post-9/11 of terrorists. Purpose — We sought to examine relationships between women’s sexual orientations and their sexual assault experiences before and during university.

Methods — Self-reported responses on a web-based survey of 5,439 female undergraduates who participated in the Campus Sexual Assault study were analyzed to compare three groups: bisexuals, lesbians, and heterosexuals. Groups were compared in terms of the prevalence of sexual assault before and during university, and the extent to which sexual assault before university predicted sexual assault during university.

Findings — The prevalence of sexual assault before and during university was higher among bisexuals and lesbians compared with heterosexuals (25.4% …

The Japanese juvenile justice system has been widely regarded as operating based on the principles of reintegrative shaming. Reintegrative shaming, as opposed to a stigmatizing form of shaming, communicates disapproval of wrongdoing with respect, and emphasizes rehabilitation, reintegration, and restoration. Central to reintegrative shaming at the initial contact point of the criminal justice system in Japan are apology and diversion by the local police. Citing juvenile delinquency cases reported in a major national newspaper in Japan, this study analyzes to what extent the community reacted to the delinquency upon its commission. Mental disorder among criminal defendants affects every stage of the criminal justice process, from investigational issues to competence to be executed. As in all other areas of mental health law, at least some people with mental disorders, are treated specially. The underlying thesis of this Article is that people with mental disorder should, as far as is practicable and consistent with justice, be treated just like everyone else. The current study assessed whether there is an empirical foundation for different theories of rape including the feminist, evolutionary, social disorganization, psychopathy, and rapist type theories. Using a data set from the Federal Bureau of Investigation (FBI) on serial rapists collected in the early 1990's, the study included two phases. The first phase assessed whether FBI data supported the previously mentioned theories of rape by analyzing associations between individual variables that are thought to support each theory. The purpose of this study was to understand how offender age impacted residential substance abuse treatment (RSAT) program success in reducing rates of recidivism for offenders exiting the judicial system. Despite passing legislation in the 1980s and 1990s, which increased the penalties for certain crimes, offender recidivism remains high, with no apparent drop in the number of incarcerations and re-incarcerations, resulting in high costs and threats to the safety and quality of life experienced within communities. To address the primary problem of racial profiling by police, many states have passed legislation that require police departments to collect demographic data on those with whom the officer comes into contact; these data are later evaluated by supervisors. The problem lies in the possibility for police officers to disengage, or depolice, when faced with data collection policies that may be viewed as lessening the officer's discretion. A Specialized or Super Intensive-1 (SI-1) supervision level refers to a contact requirement imposed on special needs offenders (SNOs) under Texas parole supervision. SI-1 supervision requires greater contact with parole officers and treatment providers than supervision levels used on regular offenders (ROs), yet little is known about whether SI-1 supervision offenders violate terms of their parole or commit new crimes at a different rate compared to the regular offender population in the State of Texas. The partial defense of provocation provides that a person who kills in the heat of passion brought on by legally adequate provocation is guilty of manslaughter rather than murder. It traces back to the twelfth century, and exists today, in some form, in almost every U.S. state and other common law jurisdictions. But long history and wide application have not produced agreement on the rationale for the doctrine. This chapter in, Gene-Environment Interactions in Developmental Psychopathology (K. Dodge & M. Rutter, eds. 2011), considers the relevance of GxE to criminal responsibility and sentencing. It begins with a number of preliminary assumptions that will inform the analysis. It then turns to the law’s view of the person, including the law’s implicit psychology, and the criteria for criminal responsibility. A few false starts or distractions about responsibility are disposed of briefly. With this necessary background in place, the chapter then turns specifically to the relation between GxE and criminal responsibility. It suggests that GxE causes of criminal behavior have no …
