Contrary to rumors that the Dodd-Frank Act is an incoherent mess, its 2,319 pages have two very clear objectives: limiting the risk of the shadow banking system by more carefully regulating derivatives and large financial institutions; and limiting the damage caused by a financial institution’s failure. The new legislation also has a theme: government partnership with the largest Wall Street banks. The vision emerged almost by accident from the Bear Stearns and AIG bailouts of 2008 and the commandeering of the bankruptcy process to rescue Chrysler and GM in 2009. Its implications for derivatives regulation could prove beneficial: Dodd-Frank will …

Coping With Disaster: Lessons Learned From Executive Directors Of Nonprofit Organizations (Npos) On New Orleans Following Hurricane Katrina, Steven L. Smith

This dissertation explores the issues and challenges that nonprofit organizations (NPOs) contend with as a consequence of a large-scale disaster, in this case, the Hurricane Katrina disaster in 2005. Through interviews with 10 executive directors of small and medium-size nonprofit, community-based NPOs in New Orleans, this study examines how their organizations coped with the consequences of the storm and the devastating aftermath. The critical issues and coping strategies the executives identified, and the lessons they learned offer insights into (a) nonprofit organizational responses to a catastrophic event, and (b) executive leadership that helped the nonprofit to survive.

This article delves into the interaction between federal and state laws prohibiting human trafficking. The article advocates for comprehensive human trafficking laws at the state level, including police training, victim aftercare, forfeiture, and prosecution as essential elements. It looks comprehensively at the existing state laws prohibiting human trafficking. Additionally it examines the five existing models for state law and suggests benefits and potential improvements for each model. The article concludes y advocating a holistic law prohibiting human trafficking in the Commonwealth of Virginia.

The last two decades have witnessed a proliferation of scholarly discourse on performance management. This discourse evolved out of a number of forces in the early 1990s from the new public management movement, which called for government to show its efficiency in expending public resources as well as prove that substantive results—or outcomes related to a program‘s effectiveness—had been generated by its activities. Senior centers off#11;er a variety of services to facilitate independent living of older adults. In the U.S., increasing suburbanization and aging of suburban residents necessitate reconfiguring senior services. We propose a two-echelon network of senior centers across large study areas and formulate a stochastic facility location/allocation model with mixed-integer recourse. We apply our model to Allegheny County, Pennsylvania, which has one of the oldest population in the U.S. Our model shows that a two-echelon network design is appropriate for increasing the occupancy of senior centers as community focal points while maintaining customized and accessible programming in small neighborhood areas.

How do undemocratic civic organizations become compatible with democratic civil society? How do local organizations merge older patriarchal, hierarchical values and practices with newer more egalitarian, democratic ones? This article tells the story of how volunteer fire departments have done this in Japan. Their transformation from centralized war instrument of an authoritarian regime to local community safety organization of a full-fledged democracy did not happen overnight. A slow process of demographic and value changes helped the organization adjust to more democratic social values and practices. The way in which this organization made the transition offers important lessons for emerging democracies …

As a continental hub that connects Asia, Africa, and Europe, the Middle East offers a strategic location for the trafficking of persons from poor to richer states. Extreme poverty, coupled with the corporate and royal wealth of the Gulf States, creates a regional dichotomy in which Middle Eastern states serve as ‘source,’ ‘transit,’ and ‘destination’ countries for human trafficking. Discrepancies in defining human trafficking within the region, as well as the controversial and illicit nature of the practice, cause research to be sparse and with very few first-hand sources. Arbitrary arrest and detention, oftentimes used to curtail the freedom of opinion and expression, as well as the right to association and peaceful assembly, has continued to characterize Iranian regimes since the 1979 Islamic Revolution. Such arrest and detention of human rights defenders (HRD)–who individually or with others act to protect and promote human rights—has demonstrated the repressive nature of the Iranian regime. Human rights lawyers, civil society representatives, journalists, and women’s rights movements and trade union activists are among the most commonly targeted HRD.

As a field of legal study and practice, administrative law rests on the premise that legal principles concerning agency structure, administrative process, and judicial review cut across multiple agencies. In practice, however, judicial precedents addressing the application of administrative law doctrines to a given agency tend to rely most heavily on other cases involving the same agency, and use verbal formulations or doctrinal approaches reflected in those cases. Over time, the doctrine often begins to develop its own unique characteristics when applied to that particular agency. As a consequence of liberalization policies in the European Union (EU), a number of formerly inward-looking incumbents in telecommunications and electricity transformed themselves into some of the world’s leading Multinationals. The relationship between liberalization and incumbent internationalization, however, is contested. Three political economy arguments on this relationship are tested. The first claims that incumbents most exposed to domestic liberalization would internationalise most. The second asserts that incumbents operating where liberalization was restricted could exploit monopolistic rents to finance internationalisation. This article evaluates EU policies on public services – particularly public network services - from the citizens´ point of view. It is first argued that citizens´ perceptions are important because the provision of fundamental services is at stake and because they constitute the infrastructure necessary for social and economic development. The main objective of this chapter is to analyze the public policymaking process in Paraguay, particularly with regard to the formulation and implementation of policies that affect the generation of remunerative employment. Concretely, the chapter addresses how the broad institutional (i.e., political, administrative and legal) environment influences—both negatively and positively—the potential for formulating and implementing a medium-term employment strategy for poverty reduction in Paraguay. The main policymaking focus of the employment strategy will be on the private sector. However, the potential contribution of an employment strategy for the public sector itself towards poverty reduction is also considered.

Public higher education is a large enterprise in the United States. Total state expenditures for higher education totaled nearly $152 billion dollars in FY2008, accounting for over ten percent of total state expenditures and representing the single largest category of discretionary spending in most states (NASBO, 2009).
