Landmark Ruling On Whaling From The International Court Of Justice, Mark P. Simmonds

On 31 March 2014, the International Court of Justice (ICJ) ruled that Japan’s whaling activities in Antarctica did not comply with Article VIII of the International Convention for the Regulation of Whaling (ICRW), which permits whaling for scientific purposes. Copious and confusing media commentary followed the decision. This included seemingly conflicting reports from within Japan, which initially indicated whole-hearted compliance with the ruling, which required this whaling to cease, but later suggested that implementation by Japan might be limited to a brief halt followed by a launch of a new Antarctic ‘research’ programme including lethal take.

New forms of online citizen participation in government decision making have been fostered in the United States (U.S.) under the Obama Administration. Use of Web information technologies have been encouraged in an effort to create more back-and-forth communication between citizens and their government. These “Civic Participation 2.0” attempts to open the government up to broader public participation are based on three pillars of open government—transparency, participation, and collaboration. We believe that e-rulemaking does indeed have potential to increase both the transparency of, and participation in, regulatory policymaking. We argue in this paper that this potential can be realized only if the public interface at www.regulations.gov is substantially redesigned.

Rulemaking is one of the U.S. government's most important policymaking methods. Although broad transparency and participation rights are part of its legal structure, significant barriers prevent effective engagement by many groups of interested citizens. RegulationRoom, an experimental open-government partnership between academic researchers and government agencies, is a socio-technical participation system that uses multiple methods to alert and effectively engage new voices in rulemaking. Initial results give cause for optimism but also caution that successful use of new technologies to increase participation in complex government policy decisions is more difficult and resource-intensive than many proponents expect.

Historically in the United States, there has been little concern about the needs of incarcerated women and their family members, especially children. This began to change with the tremendous increase in the number of incarcerated women. The rate of women’s incarceration increased dramatically during the 1980s and today the number of female inmates continues to rise faster than the number of male inmates. In 1986, 19,812 women were incarcerated in the United States and this number rose in 1991 to 38,796. This study found that – based on certain configurations of communities and cost considerations – it is economically viable to consolidate public safety answering points (PSAPs) in Highland Heights, Lyndhurst, Mayfield Heights, Mayfield Village and Richmond Heights, Ohio. When comparing 2012 staffing and noncapital costs to estimated staffing and noncapital costs for a consolidated PSAP, the consolidated PSAP would provide an estimated collective reduction in staffing and noncapital costs of ranging from $775,400 to $1.19 million. What does it mean for a government or an authority to be representative? Obviously, when democratic governments rule according to what ‘people/citizens’ desire they can be said to be representative. However, citizens’ expressed desires are shaped by the environment within which they live. In those cases, desires cannot be taken to be the benchmark against which actions of representative governments can be judged. Hence, Przeworski (1999:2 citing Pitkin 1967) defines representation more broadly as ‘acting in the best interest of the public’.
