Soft law governance relies on nongovernmental institutions that establish and implement voluntary standards. Compared with traditional hard law solutions to societal and economic problems, soft law alternatives promise to be more politically feasible to establish and then easier to adapt in the face of changing circumstances. They may also seem more likely to be flexible in what they demand of targeted businesses and other entities. But can soft law actually work to solve major problems? The European Union has some of the highest environmental standards in the world. However, multiple member states fail at reaching the deadlines set by the European Union (EU). This thesis examines the effectiveness of the European Union’s environmental directives on gaining compliance from member states to reach the agreed-upon standards. This is assessed by using three European Union directives from different environmental areas and analyzing their requirements. Each directive represents either a hierarchical policy, negotiated policy, or voluntary policy transfer. This study hypothesizes that the hierarchical policy, represented by EU Directive 2008/98/EC, will be more effective at gaining compliance than …

Coastal wetlands such as mangrove forests and salt marshes provide a range of important benefits to people, broadly defined as ecosystem services. These include provisioning services such as fuelwood and food, regulating services such as carbon sequestration and wave attenuation, and various tangible and intangible cultural services. However, strong negative perceptions of coastal wetlands also exist, often driven by the perceived or actual ecosystem disservices that they also produce. These can include odour, a sense of danger, and their real or perceived role in vector and disease transmission (e.g. malaria). This review provides an introduction to the ecosystem services and …

The current “pledge and review” paradigm for global climate change mitigation, which many see as a major breakthrough, relies primarily on moral pressure, reputational incentives, and global public opinion to foster cooperation on mitigation efforts over and above those driven by maximization of narrow conceptions of national interests. The German Energiewende (“energy transition”) is often credited with being the most ambitious renewable energy transition in the world. Germany’s rapid transition is mainly led by their Renewable Energy Act of 2000, which has been amended several times in order to remain relevant during changing conditions. In contrast, the United States’ energy transition seems stagnant and lacks an overall direction from the Federal Government. This paper begins by exploring the current state of water resources planning and permitting. Then, considers current water demand in Virginia, as well as future challenges. Next is an examination of management structures from other states and a discussion of potential solutions to the water scarcity issue, including wastewater purification, the Hampton Roads Sanitation District’s (HRSD) Sustainable Water Initiative For Tomorrow (SWIFT) project, and desalination. Responding to the present and looming effects of global climate change presents a challenging task for policymakers at all levels of governance. The outcomes of climate change do present serious adaptation problems for global policy makers, but the implications of climate change are more immediately experienced by local communities and policy makers. Historical policymaking models suggest that economic well-being is an influential driver in local policy adoption. Against the background of a widely fragmented and diluted international environmental governance architecture, different reform options are currently being discussed. This issue brief considers whether streamlining international environmental regimes by grouping or ‘clustering’ international agreements could improve effectiveness and efficiency. It outlines the general idea of the clustering approach, draws lessons from the chemicals and waste cluster and examines the implications and potentials of clustering multilateral environmental agreements.

In this paper we structure, obtain and analyze results of an expert elicitation on the relationship between U. S. government Research & Development funding and the likelihood of achieving advances in cellulosic biofuel technologies. While there was disagreement among the experts on each of the technologies, the patterns of disagreement suggest several distinct strategies. Selective Thermal Processing appears to be the most promising path, with the main question being how much funding is required to achieve success. Thus, a staged investment in this path looks promising. With respect to gasification, there remains fundamental disagreement over whether success is possible even …

From June 27 to 28, 2011, the Federal Office for the Environment of Switzerland, the Global Environmental Governance Project of the Center for Governance and Sustainability at the University of Massachusetts Boston, and the World Trade Institute at the University of Bern hosted a workshop on International Environmental Governance: Grounding Policy Reform in Rigorous Analysis. The workshop started a dialogue between academics and researchers on one hand and policymakers on the other in order to provide analytical input to the political negotiations on institutional reform in the run-up to the UN Conference on Sustainable Development in 2012.

This honors thesis will examine current and theoretical "cap and trade" emissions trading schemes in an attempt to make recommendations on how to improve this regulated commodity market. The various control mechanisms available to regulators will be discussed: including allocation methodology, benchmarking, banking, variation in design frameworks, etc. To aid and support the proposed policy recommendations, this paper will investigate the design framework of the SOx emission trading scheme in the US, the Kyoto Protocol, and the European Union Emissions Trading Scheme (ETS). The relationship between R&D investments and technical change is inherently uncertain. In this paper we combine economics and decision analysis to incorporate the uncertainty of technical change into climate change policy analysis. We present the results of an expert elicitation on the prospects for technical change in carbon capture and storage. We find a significant amount of disagreement between experts, even over the most mature technology; and this disagreement is most pronounced in regards to cost estimates. We then use the results of the expert elicitations as inputs to the MiniCAM integrated assessment model, to derive probabilistic information about the …

There is a dual purpose to the Las Vegas 2020 Master Plan Conservation Element. The first purpose is to address the requirements of state law, as provided in the Nevada Revised Statutes (NRS) 278.150(4). This section of the NRS requires that governing bodies in Nevada counties with a population of 400,000 or more ensure that their master plans address a stipulated list of subjects, including a conservation plan.
