Bail Agents And Bounty Hunters: Adversaries Or Allies Of The Justice System?, Brian Johnson, Greg Warchol
Bail Agents And Bounty Hunters: Adversaries Or Allies Of The Justice System?, Brian Johnson, Greg Warchol
Greg Warchol
Bounty hunters are employed by the bail industry to locate and apprehend criminal defendants who “skip” bail and, subsequently, fail to appear for court appointments. While some scholars have examined bounty hunters, this work is concerned primarily with the origins, history, and legal challenges to the industry and its practices. Popular literature on this subject has created the “myth” of the bounty hunter, but it has failed to provide an accurate portrayal of the activities these individuals perform. Through the use of field research methods, this study provides a better understanding of the role that bail agents and bounty hunters …
Using The Survey Of Inmates Of State And Federal Correctional Facilities To Compare Female And Male Inmate Characteristics., Jacqueline Anita Black
Using The Survey Of Inmates Of State And Federal Correctional Facilities To Compare Female And Male Inmate Characteristics., Jacqueline Anita Black
Electronic Theses and Dissertations
The purpose of this study was to examine the differences between female and male prison inmates using the Survey of Inmates of State and Federal Correctional Facilities, 1997. Variables examined included current offense, criminal history, drug use history, victimization history, program participation in the institution, disciplinary infractions in the institution, family history, and interaction with family while in prison. Results indicate that male inmates have worse criminal histories and longer sentences than female inmates. Female inmates have more extensive drug use histories, greater victimization histories, more program participation in the institution, and more criminality in their families of origin than …

Police Officers' Perception Of The Validity Of The General Theory Of Crime., William Jaison Giesler
Electronic Theses and Dissertations
This study measured police officers perception of the validity of General Theory of Crime. Using a sample of 117 officers and an adapted version of the Grasmick et al. (1993) self-control scale, this study measures the level of agreement officers exhibit that low self-control traits are present in property and violent offenders. Measurement is also performed to determine variation in officers agreement based on the personal characteristics gender, age, education, experience, and rank.
Findings indicate officers show agreement with self-control items across the six dimensions of self control traits, as well as significant variation in agreement with the property offender …
Long-Term Employment Agreements With In-House Counsel: Employment Security Or Ethical Quagmire?, Richard E. Moberly, John Hutchins
Long-Term Employment Agreements With In-House Counsel: Employment Security Or Ethical Quagmire?, Richard E. Moberly, John Hutchins
Nebraska College of Law: Faculty Publications
The relationship between a company and its in-house corporate counsel involves a fragile mixture of the corporate counsel’s fiduciary obligations as the company’s attorney and the company’s legal and contractual responsibilities as the attorney’s employer. Although these roles and expectations often blend smoothly, the relationship can become problematic when the corporate counsel’s position as an attorney conflicts with the counsel’s status as an employee. Put another way, when a company’s expectations as a client are at odds with its responsibilities as an employer, the relationship between the employer-client and the employee-attorney can become strained and expose each to difficulty, if …
Criminality Groups And Substance Abuse, Dana Brown
Criminality Groups And Substance Abuse, Dana Brown
Masters Theses & Specialist Projects
This descriptive study was designed to determine whether substance abusers could be differentially characterized by past involvement in crimes and, further, whether there is a relationship between the type of substance abused and the degree of violence of the crimes committed. By comparing the socio-demographic characteristics, substance-use, and strain-inducing events reported by 598 residential and outpatient treatment seekers in the Kentucky Treatment Outcome and Performance Pilot Studies Enhancement Project, this study provides further understanding of the crime-substance relationship. This study utilized Robert Agnew's 1992 general strain theory. Results suggest that substance addicts and substance users can be characterized in terms …

The Citizen Police Academy: Assessment Of A Program's Effects On Community And Officer Attitudes, Shannon Cook
Masters Theses & Specialist Projects
The study was conducted in order to determine the effects of the Citizen Police Academy (CPA) program on community and officer attitudes. The two main goals of this program are to increase officer awareness of community concerns and to raise community awareness about the police department. Surveys were distributed to three groups: employees of the Bowling Green Police Department, all alumni of the CPA, and a random sample of the local community. Participants were asked their attitudes regarding crime prevention, awareness of police officers' activities, and the effectiveness of the CPA program. T-tests and ANOVAs determined that police officers who …

Managing Interjurisdictional Waters Under The Great Lakes Charter Annex, Mark Squillace, Sandi Zellmer
Managing Interjurisdictional Waters Under The Great Lakes Charter Annex, Mark Squillace, Sandi Zellmer
Nebraska College of Law: Faculty Publications
In spring 1998, the Nova Group of Sault Ste. Marie, Ontario, proposed to ship nearly 160 million gallons of Lake Superior water annually via tanker to Asia. See INTERNATIONAL JOINT COMMISSION, PROTECTION OF THE WATERS OF THE GREAT LAKES: FINAL REPORT TO THE GOVERNMENTS OF CAVADA AND THE UNITED STATES 44 (2000) (2000 IJC Report). Nova's proposal coincided with declining water levels in the Great Lakes, and the resulting public outcry and pressure from other Great Lakes governments persuaded Ontario to revoke Nova's permit just a few months later. The Nova proposal prompted the eight American states and two Canadian …

Detecting Patterns Of Fraudulent Behavior In Forensic Accounting, Boris Kovalerchuk, Evgenii Vityaev
Detecting Patterns Of Fraudulent Behavior In Forensic Accounting, Boris Kovalerchuk, Evgenii Vityaev
All Faculty Scholarship for the College of the Sciences
Often evidence from a single case does not reveal any suspicious patterns to aid investigations in forensic accounting and other forensic fields. In contrast, correlation of sets of evidence from several cases with suitable background knowledge may reveal suspicious patterns. Link Discovery (LD) has recently emerged as a promising new area for such tasks. Currently LD mostly relies on deterministic graphical techniques. Other relevant techniques are Bayesian probabilistic and causal networks. These techniques need further development to handle rare events. This paper combines first-order logic (FOL) and probabilistic semantic inference (PSI) to address this challenge. Previous research has shown this …

Drug Cartels And The International Organization Of Drug Trafficking In The 21st Century, Gary W. Potter, Karen M. Potter
Kentucky Justice and Safety Research Bulletin
This research is a brief overview of the new cartels emerging to dominate today's international traffic in drugs. In terms of geographic reach, economic impact, and imperiousness to law enforcemnt, drug cartels became the dominant form of organized crime in the last two decades of the 20th century. In the 21st century drug cartels have taken advatage of the massive increases in international trade and commerce and have learned from the mistakes of the earlier cartels. The new cartels are more numerous, flexible, chameleonic in their nature, and durable than any we have seen before.

The Combined Effects Of Criminal Justice Intervention On Domestic Violence: A Re-Analysis Of The Minneapolis Intervention Project., Nadia A. Bebawy
The Combined Effects Of Criminal Justice Intervention On Domestic Violence: A Re-Analysis Of The Minneapolis Intervention Project., Nadia A. Bebawy
Electronic Theses and Dissertations
Over the past 20 years, a plethora of research has been conducted on the effects of arrest in reducing recidivism of domestic violence offenders. The findings of such research have been varied. This study uses data from the Minneapolis Intervention Project to test the effectiveness criminal justice sanctions (i.e., arrest, jail, counseling, and the combination) on reducing recidivism of male domestic violence offenders. Results from bivariate analysis found that the criminal justice sanction of arrest and jail was related to recidivism. However, criminal justice sanctions could not predict recidivism.

Oleoresin Capsicum: An Analysis Of The Implementation Of Pepper Spray Into The Law Enforcement Use Of Force Continuum In A Selected Police Department., Lydia Denise Adkins
Electronic Theses and Dissertations
This study focused on the use of oleoresin capsicum (OC) as a means of force and also tested the effectiveness of OC.
A medium-size police agency was studied from 1991-2001. The following reports were collected for analysis: excessive force reports, reports of officers injured during arrests, use of hands-on restraint, and use of police baton.
This study revealed an increase in reported incidents of excessive force and a reduction in the number of officers injuired making arrests while using various defensive techniques.
Implementing OC into the force continuum remains a solid decision in review of this research. This study has …
The Determinants Of Policing Unfounding And Prosecutorial Case Rejections In San Diego, California Sexual Assault Cases, Elizabeth M. Keller
The Determinants Of Policing Unfounding And Prosecutorial Case Rejections In San Diego, California Sexual Assault Cases, Elizabeth M. Keller
Student Work
The vast amount of research that has been done on sexual assault in the past thirty years has yielded a great amount of knowledge bout the phenomenon of sexual assault and the way the criminal justice system responds to it. One hypothesis that emerges from this literature is that certain cases of sexual assault may be treated differently by police and.prosecutors because of characteristics of the victim, the suspect, or of the case itself This study tests that hypothesis, using data·collected by the San Diego Police Department's Sex Crimes Unit over a multi-year period in the 1990s. This study. specifically …

Reflections On Ranganathan’S Five Laws Of Library Science, Richard Leiter
Reflections On Ranganathan’S Five Laws Of Library Science, Richard Leiter
Marvin and Virginia Schmid Law Library
This article is adapted from a column that I wrote for Legal Assistant Today in 1996. The column’s audience was legal assistants, some of whom, I discovered over my seven years as a columnist for the publication, had responsibility for managing law firm libraries or library resources in addition to their other duties. So from time to time my column drifted into advice about managing libraries. This particular column came about at a time when I was mentoring some younger librarians and discovered to my surprise that they did not know of Ranganathan’s Five Laws of Library Science. When I …
Parental Understanding Of Miranda Rights, Abby Callis
Parental Understanding Of Miranda Rights, Abby Callis
Masters Theses & Specialist Projects
The current research focuses on parents' level of understanding of Miranda rights and parents' likelihood of encouraging their teenagers to waive their Miranda rights. The previous research suggests that parents alone may not adequately protect juveniles' rights during interrogation and waiver. Prior research also suggests that parents' and juveniles' past experience with the justice system may not help them during their current interrogation and waiver. A 17-item questionnaire was used to assess the two dependent variables and the two independent variables. The two dependent variables were parents' understanding of Miranda rights and parents' likelihood of encouraging arrested teens to waive …

“Bin Laden’S Brain”: The Abrasively Negativistic Personality Of Dr. Ayman Al-Zawahiri, Aubrey Immelman, Kathryn Kuhlmann
Psychology Faculty Publications
This paper presents the results of an indirect assessment of the personality of Ayman al-Zawahiri, deputy leader of the al-Qaida terrorist network at the time of the September 11, 2001 terrorist attack on the United States and allegedly chief strategist for al-Qaida operations and personal physician to Osama bin Laden.
Al-Zawahiri’s primary personality patterns were found to be Contentious/oppositional and Dominant/controlling, with secondary features of the Dauntless/dissenting and Ambitious/self-serving patterns.
The amalgam of Contentious (negativistic, or passive-aggressive) and Dominant (aggressive, or sadistic) patterns in al-Zawahiri’s profile suggests the presence of the “abrasive negativist” syndrome. For these personalities, minor frictions easily …

Risk Evaluations For The Courts: Is Service Quality A Function Of Specialization?, Kristine Botsford Mullendore, Anton Tolman
Kristine Botsford Mullendore
Psychologists are often asked to testify in court. However, concerns have been expressed in both the legal and psychological literatures about the quality of these services. This article presents survey results comparing the practice patterns of generally licensed psychologists with those of specialist forensic diplomates in providing risk evaluations. Results suggest that general clinicians frequently perform these evaluations, but forensic diplomates use more modern risk instruments, are more aware of the scientific literature, and provide the court with more information about the scientific basis of their testimony. The implication of these results for legal professionals, psychologist training, and practice are …

Misguided Instructions: Do Jurors Accurately Understand The Law In Death Penalty Trials?, Chasity Anne Stoots-Fonberg
Misguided Instructions: Do Jurors Accurately Understand The Law In Death Penalty Trials?, Chasity Anne Stoots-Fonberg
Electronic Theses and Dissertations
The Sixth Amendment of the U.S. Constitution guarantees individuals’ right to trial by an impartial jury. However, empirical research indicates that the jury system is flawed, especially regarding judicial sentencing instructions. More specifically, jurors frequently misunderstand or misinterpret State patterned instructions. On a more encouraging note, there is evidence that comprehension of jury instructions can be improved. Thus, this research assessed improvement in juror comprehension using revised sentencing instructions. For the current investigation, participants included 201 volunteers called for jury duty in Western Tennessee. Data were generated via a questionnaire, which allowed for the collection of information relating to participants’ …
