In judging an offender’s culpability, mitigation, or excuse, there seems to be general agreement that it is appropriate for the criminal law to take into account such things as the offender’s youthfulness or her significantly low IQ. There is even support for taking account of their distorted perceptions and reasoning induced by traumatic experiences, as in battered spouse syndrome. On the other hand, there seems to be equally strong opposition to taking account of things such as racism or homophobia that played a role in bringing about the offense. The Rhetorical Devices Of The Keepers Of State Secrets, Stephane Lefebvre

This article examines a set of rhetorical devices forming a linguistic practice that are used repeatedly by secret keepers in the United States and the United Kingdom when legally and popularly arguing against the disclosure of state secrets. Each of these devices (using lists, using the future conditional, arguing from ignorance and authority, arguing from consequences, and arguing by analogy) play a role in shaping our social understanding of state secrecy. This study offered a preliminary look at the evidence to support the benefits of training South Georgia Police Officers on the phenomenon that is autism. Research suggested that there was limited experimental data available regarding why persons with ASD entered the criminal justice system, as well as how to manage them once they are there (Chovanec, 2013). Various regions of the United States embraced the importance of ASD training amongst their law enforcement officers; however, Georgia has only recently taken steps to do the same by the inclusion of a voluntary, online course regarding autism and de-escalation. Culpable Carelessness by Findlay Stark is a careful and considered contribution to the 'punishment for negligence' debate. As well as providing a comprehensive overview of the doctrinal and theoretical aspects of recklessness and negligence in the criminal law, it also offers novel insights for scholars already steeped in these debates. An additional methodological strength is that Stark takes seriously the connection between theory and law, offering useful potential jury instructions on recklessness and negligence.

This mixed methods study examined the attitudes, knowledge and perceptions of barriers toward Evidence-Based Practice (EBP) among Florida Juvenile Justice Service Professionals (JJSP). Previous research established individual factors such as age, gender, years of professional experience and educational attainment are related to attitudes and perceptions of barriers among social service and mental health professionals, but scant research has been conducted among juvenile justice providers (Aarons 2004, 2010; Rubin & Parrish, 2007, 2012; Jette et al., 2003). Most individual factors were found to have no significant effect on attitude and knowledge scores within this population with exception of gender and major …

This Essay considers the problem of understanding intellectual sharing/pooling arrangements and the construction of cultural commons arrangements. We argue that an adaptation of the approach pioneered by Elinor Ostrom and collaborators to commons arrangements in the natural environment may provide a template for the examination of constructed commons in the cultural environment. The approach promises to lead to a better understanding of how participants in commons and pooling arrangements structure their interactions in relation to the environment(s) within which they are embedded and with which they share interdependent relationships. The purpose of this interpretive four-phase study was to develop and apply a technique of multidimensional scaling (MDS) to present psychometric concept maps within the knowledge domain of security risk management. Additional and related purposes were to present the knowledge categories and subordinate concepts of security and consider the appropriateness of MDS to develop and present consensual concept maps.
The psychometric MDS security risk management concept map presented the expert knowledge structure of security risk management, demonstrating the inclusive and spatial locality of significant concepts, conceptual complexity of the domain and the central aspect of threat – ratifying the psychometric …
